MINUTES of a special meeting of the Board of Trustees of i
the Village of Cayuga Heights held on May 15, 1953 at 5:30 P.M-
at the home of Clerk Trousdale, 102 Northway Road.
PRESENT; Henry J. Shirey, Mayor
A. W. Chamberlain, Trustee
E. A. Whiting, Trustee

were present by-invitation of the Mayor.,
1. Mayor Shirey called on Harry Gordon, who had requested
permission to attend the Village.meeting in order to make a
statement. Mr. Gordon stated that he 'and Mr..LaValley were
present representing the ,County Hoard.of Health. Mr. Gordon said
that a problem was facing the members of the Town Board and`the
Health Department, namely that the sewage problem in the annexed.
portion of the Village was causing complications, due to the
fact that persons in this area were asking the Town Board and.
the Board of Health for information regarding possible sewers in
the area, and that the Board of Health did not feel it was in a
position to properly answer the questions. A typical question
was "What should I do about.my present septic tank? It does not
operate properly. It.is overflowing causing concern to myself and
to my neighbors and I do not know whether I should extend the
laterals or how to cope with my neighbors who are making complaints
against me." The basic problem that seemed to be'facing many of .
the residents in the annexed area was that they.did not know how
to proceed from the sanitary standpoint. They did, not wish to spend
many. hundreds. of dollars in trying to.correot their.septic .tank
situation if sewers were about to go through,• and they.did not:, �.,
know what action the Board of Health might take. Mr.

that he.did not feel that they should be giving orders to these
residents when the Health Department was not familiar with the
Village plane regarding.installat- ion'of sewers. He suggested that
it`.mo uld .be 1 helpful . to.. the Town Board,. Board :of ; Health,', Village
Trustees, and to "all thee: residents of..the Village; if. the Village
Trustees would publish a statement indicating what,the'Village
plans were, the steps `:to,be; taken , and the approximate time
involved to:aohieve a °.completed sewer system
Mr. LaValley.supplemented Mr. Gordon�s;'rem.rks and pointed'
out a, specific case, that of Mr. Allen of,Fofrest Drive, who was
co mplaining.about; his ''upper neighb ors 'on'ComstockRoad because

the ,effluent from their septic tanks was overflowing on his
property V The problem was complicated by the fact that the.
constant rains during the last few weeks made the septic tanks
particularly ineffective.
.Engineer Crandall said that the various steps involved were:
1) the, surveying, planning, and engineering work to lay out
a sewer system;
2) negotiations with the City for receiving the, effluent or
the construction` of a Village sewage disposal plant;'
3) obtaining the estimated cost;
4) getting the residents of the annexed a -ea`to vote the
necessary bond issue to take care of the cost;
5) the construction of the.system.
He thought that. he earliest possible:date.that all these:
steps co.uld.be accomplished would.be. minimum of,jthree.,years, but
if lucky breaks were encountered on all items above mentioned it
might be accomplished ln;:less than. three years on the. othe'r
,.hand, if any difficulties were encountered on. any one. of ithe items
upwards of $1,000:for a satisfactory a eptictank,withj proper
laterals and then find.a sewer line 'going right''past his property
which he would be forced'to use, 'thus making his: investment. in.
the septic tank:worthlsea The Engineer eaid'that the engineering:,;
work could be underway this summer to consummate'the.firet step_ .

Trustee Marcham a aid ; that he thought it would be. advisable
for all the, step s :necessary•to, be, ' taken in the. pro gram to be
mentioned in the publicity so that the. residents in the annexed
area would have full recognition of the problems 1 m *olved and why
such a project. can not be accomplished over night. The Engineer
said that he would write up'an article - for.publicity purposes and
forward it to the Mayor,.who, if he thought it was satisfactory,
could bubmit it to the newspapers and local radio station. .
As Mr. Gordon and Mr. LaValley were completely satisfied
with Mayor Shirey's statement that the Village Trustees would be
glad to prepare such a statement and have it published, they lef t
the meeting at 5 :55 P•M
IT WAS VOTED RESOLVED: That Engineer Crandall be requested
to prepare plans and specifications as soon as possible for the
sewer mains and manholes in the recently annexed portion. of the
Village, and that.the cost for such plan e.and. specifications would
be presently paid from Village.funds, but later on when funds were
available from -the proceeds of the bond issue, such cost would.be
charged to the project cost and properly pro =rated over the
property owners benefitted.
2. IT WAS VOTED RESOLVED. That the amount of $41,619.02
be levied upon the taxable.property of the, Village of ',Cayuga Heights

b Engineer. Crandall reported that the Electric & Gas:
Corporation`wishet to bring in a hi. gh pressure gas line at the
Community Corners in order,to provide "satisfactory gas service
for residents in.the,area. In.order to do this they.found it
1;10 uld be neeessary:to :build a small structure approximately 14 by
14 feet, one story high, on a 50 :foot by 100.foot,lot on the
west. side of "Pleasant Grove Road, about opposite . the property of
.Philip Krebs. The Engineer "pointed out: that this was within the
authority of :the Board: to grant such permission .under,.the terms
�,of the Zoning Ordinance.
IT WAS VOTED that the New York; State Electric Corpora-
tion.be permitted- "to, build, the. above' structure "in ,order,to:hous "e
high:pressure "gas-line, equipment to: serve the residents: of. the.
area, with the provision, however, that the;archi.tectural
appearance of the structure receive.prior approval from.': the '

Community Corners Corporation.
7. The ..Engineer.: stated that Profl Credle'of the -Board of
Education,of Union Free School District # 61 had'requeeted'ihe
Village to remove the,`ashes and trash' from :the school . .,
IT WAS VOTED that :pursuant to.the request,of,Prof: Credle,
President of School District 6, the Village of.Cayuga Heights will
co
remove the ashes and trash from., the, school "property at'no charge, „
if such,material -ls,placed outside :the buil'ding.convenient` for the
Village truck to pick up, such: arrangement :to be effective June lst.
g. Mayor Shirey explained that he, had made`a study of; the,
law regarding the legality of transferring the .Village funds from
,the First Nat, onal -Bank to'The Tompkins County •Trust'Co. He stated
that the.law on the. subject was on the hazy''side and to .be sure:._
that the Village was not doing anything illegal. he wrote for-, an
opinion from the Attorney General, who advised that the account
might not'be kept`in the Tompkins County Trust Co. because of,the,
fact that Trustee Chamberlain was Vice President of such bank.
Consequently Trustee.Chamberlain moved.and Trustee Whiting
seconded the following resolution which wae'duly voted:;;
RESOLVED: that the action taken regarding the official bank.
depositary for the year 1953-54 on April 6 and amended on April'29
be rescinded and that the following action be taken:
RESOLVED: That the First National Bank of Ithaca, N. Y.:b3
designated as the official depositary of Village Funds,for, the year
1953 -54.

Assessors of the Town of Ithaca for the purpose of reaching a
reconcilement in the difference of assessments by the Village
Assessors and the Town Assessors.
