The matter.taas laid on' the'table 'with " MR 0 hereinafter described and known as by the Village of Cayuga Heights, WHEREAS, the said petition of Section 349 of the Village Law, WHEREAS,, there is included of a majority of the Town Board of County, New York, dated January. 3, annexation.of the'land hereinafter C j , Cayuga Heights Water District and complies with the provisions and with the said.petition, consent the Town of Ithaca, Tompkins 1953, consenting to the .described to the Village of ayuga Heights, NOW THEREFORE, it is hereby RESOLVED, that the Village of Cayuga Heights hereby consents to the annexation of and does hereby annex to the said Village of Cayuga Heights property described in the said petition and.knowrn as'Cayuga Heights Water District and more particularly bounded and described as follows: COMMENCING at the northwest corner of the Village of Cayuga Heights in said Town of Ithaca; thence easterly along the north boundary of said Village fo the northeast corner thereof; thence southerly along the east boundary of the Village of Cayuga Heights to the north boundary of the City of Ithaca; thence easterly along the north boundary of the Ci$y of Ithaca to'the northeast corner of said City; thence northerly in line with the east boundary of'the City of Ithaca to the north boundary of the Town of Ithaca; thence westerly along the north boundary of the Tgwn of Ithaca to the west line of that was formerly the Central New York Southern Railroad (Short Line) right of *.aay; thence southerly along the west line of said right of way to a point where' the north boundary line of the Village of Cayuga Heights, if 3xtended westward, would intersect said line; thence easterly in a line with the north boundary line of the Village of Cayuga Heights to the center line of Remington Road; thence southerly and south- westerly along the curve of the center line of Remington Road to the east line of the Lake Road; thence southerly along the east line of the Lake Road to the middle line of Pleasant Grove Creek; thence easterly along the middle line of Pleasant Grove Creek to its intersection with the west boundary of the Village of Cayuga.Heights; thence northerly along the wrest boundary of the Village of Cayuga Heights to the place of beginning." It was noted that the petition was filed with'the.Super- visor on Dec. 4, 1952 and a public hearing was held on Dec. 27,1952 0 1 1 150 6. IT WAS VOTED RESOLVED: WHEREAS at a regular meeting of the Board of Trustees of the Village of Cayuga Heights, held on Nov. 19, 1952 at the schoolhouse in the said village, the Treasurer of the said village was directed to return his warrant and tax roll and an account of the taxes, assessments and charges remaining due, containing a description of the lands upon which such taxes were unpaid as the same were placed upon the tax list, together with the amount of the taxes, assessments or charges so assessed and the interest thereon, together with a sworn statement that the taxes, assessments and charges mentioned in such account remain unpaid, and that after diligent efforts he has been unable to collect the same, and WHEREAS at a regular meeting of the Board of Trustees of the Village of Cayuga Heights held at 102 Northway Road in the said village on the 6th day of January 1953 the Treasurer did comply with the.aforesaid directions, his said statement being attached hereto showing a balance unpaid of $214.40 NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of Cayuga Heights do credit the Treasurer with the amount of $214.40 according to the provisions of Section 126 -a of the Village Law of the State of New York. 7. IT WAS VOTED RESOLVED that the properties on which the following taxes and assessments are unpaid be advertised for sale on Feb. 3, 10, and 17, and if still unpaid their sale be authorized on Feb. 24, 1953 at 5:15 P.M. at the schoolhouse according to the provisions of Section 126-d of the Village Law of the State of New York: 1) Robert V. and Epsie Morse, 106 Overlook Road. Bounded on the north by Pope, on the east by Overlook Road, on the south by O'Connell,. and on the w$st by Wyckoff ,. Road. Residence. 1952 Property tax $104.00 Interest penalty 8.84 `112.944 2) John D. and Fannie R. M. Ogden, 207 E. Upland Road. Bounded on the north by Upland Road, on the east by Cleary and Dixon, on the south by Kenerson and on the west by Nevin. Residence. 1952 Property tax 093.60 Interest penalty 7.96 B. The Clerk reported that he had written to Superintendent Laverty of the City of Ithaca regarding the noise from loudspeakers 1 at Stewart Park and Percy Field during the summer months and had received a favorable reply from Mr. Laverty saying he would 1 ] =5 "1 take.steps to correct the-situation. The Clerk read a letter received Prom Prof. T. W..Mackesey in'.'which he stated that. he was concerned 'over. rumors afloat that the :.new construction on Country Club Road would be "Ia motel anId,appealted to the Truetees.to` put a r etop.'to such, rumors if untrue."," The Trustees were'at`a loss"to know"how to'prevent"the ' circulation of'untruthe" and' mi set ate ments { of,:fact .It-was brought,out. that the °apartment construction permit waei- issued on the basis of an. apartment house constructed,in: accordance,.with:the ordinances of the:Village .9: : Mayor "Shirey appointed the Trustees, to..sit as a Committee - of the-Whole to' prepare the budget for the `year 19537 4. Clerk:Trousdale reported 'that he had received a letter from Fire Chief_ Travis. on Dec. 9;;, 1952 `'requesting ".that the Village make the. computation for the cost of the fire service '. contract for 1953.` The Clerk.said he had made "such a computation".resulting in a cost of 03',k5-.59 as compared with 03,703.06 for 1952, that Trustee Randel "had' cheoked' the."figures andffound `them ,correct. Th)e Clerk said he had sent the computation to the City and had had assurances from City Clerk Springer that the computation was correct and would be approved by the Common Council at their next meeting. IT WAS VOTED'to authorize the Mayor and the Clerk,to. sign the contract with the City,of Ithaca for fire, service for the year 1953:1 f they found the contract to be in orde'r, when presented by the City.
