MINUTES of a regular meeting of the Village Board held on
Tuesday, Sept. 2, 1952, at 7:30 P.M. at the home of Mayor
Shirey, 106 Northway Road.

4. The Mayor asked Trustee Whiting to report on his conver-
sations with Prof. Freeman. Trustee Whiting stated that he had
had talks with Prof. Freeman in which the latter said it was hard
to believe from appearances that the four Indelicato houses on
Triphammer Road, the Austin house on the corner of Triphammer &
Upland Road, and the Cioolietti house on the corner of Upland Rd.
& Cayuga Heights Road did not exceed the 15% limit. Trustee
Whiting said that he was sure they did not exceed the limit as the
Engineer had checked this fact but thought it would be a help to
the Trustees if they could be furnished information in doubtful
cases such as these that would enable them to satisfy complainxants
or people inquiring for specific information. He thought if the
trustees had available the number of square feet in the lot and
the number of square feet to be occupied by the house and the
percentage it would be helpful. The Mayor agreed with this and
the Engineer said he would furnish such information in the future
so tha t it could be entered in-the minutes and thus be available
to the Trustees or anyone interested.
A long discussion was held regarding the complications of
Mr. Austin removing his old garage from the lot at the corner

of Triphammer and Upland Road to 211 E. Upland Road. As the
moving of this garage will exceed the 15% limit on the lot at
211 E. Upland Road a hearing will be held by the- Zoning Board of
Appeals on Sept. 10th.
6. Treasurer Guise reported a cash balance on Aug. 31st of
$16,001.92 and he reported that Mr. Indelioato had paid the
$400 sewer connection charge for his four new houses on Triphammer
Road and that the annual sewer charge as far as the Village is
concerned would be $16.90 per year each.
7. The Engineer reported that he had let the contraot. for
street resurfacing to the Ithaca Paving Co. in the amount of
$2,754-57 and that the work had been completed. The Engineer
reported that the first mowing of lots had been completed and
practically all of the second mowing.
9. The Engineer reported on a request of Garrett Felton for
a sewer connection, pointing out that the policy had.been so far
to permit sewer connections only on adjacent perimeter properties
to the Village; that this case involved a new policy in permitting
a sewer connection on a property not adjacent to the Village line.
He stated that Mr. Felton's septic tank had never been satisfactory
due to soil conditions and that he was desirous of connecting with
the Village sewer even though he realized the expense might run
.around $1,000. The Engineer pointed out that Mr. Felton was close
enough to the Village so that if his septic tank did not function
properly it was in the interest of the Village to permit the
connection to prevent his sewage from getting into the Triphammer
Road gutter. Questioned as to whether or not this would set a
,
bad precedent because of possible future applications from people

even farther east, the Engineer said that a request from the '
Sheldon property which is opposite would be reasonable, however if
the next house east should make such a request it would be un-
reasonable due to the fact that they are far enough from the
Village and soil conditions are such that the Village would not be
contaminated. It was the opinion of the. Engineer and the Trustees
that no sewer connections should be made unless the Village might
be affected by the overflow from the septic tanks.
IT WAS THEREFORE VOTED that Garrett Felton be given
permission at a fee of $200 to connect with the Village sewer line
with the understanding that he would pay the cost of installation
and the usual annual payment to the Village of 016.90.
The Engineer reported that a speeding case had been brought
to his attention in which a 015 fine had been imposed by the
'
Justice of the Peace.
The - Engineer reported that an accident had occurred on the
curve on Hanshaw Road opposite Stickler's new house a few hours
previously in which one car sideswiped another without personal
injury. This brought to mind the efforts of the Village to get
the State to put up a speed limit sign of 15 miles per hour and
a line in the middle of the road. It was felt that this had
helped and possibly prevented more accidents.
The Engineer reported that he hoped the sidewalk on Triphammer
Road would be completed in the month of September and was con-
sidering having the work done by the Village workmen rather than
letting it out on contract,. and he reported that some sidewalk

repairs had been done this summer by the workmen.
The Engineer reported that some difficulty existed with the
catch basin in front of Sherwood Holt's house on Sunset Drive.

This might be corrected by running a pipe line in a northwest
direction aovoss his property to dump into the oreek or a pipe
could be run across the, road in a northeast direction across
Gilbert Weeks' property to dump in the creek. As the latter
seemed more advisable and as Gilbert Weeks offered no objection
It was decided that Mr. Holt would furnish the cost of the forty
feet of pipe and that the Village would do the work.
9. Trus.tee Randel said there was some expense involved in
having public, hearings of the Zoning Board of Appeals, mentioning
that advertising ran from $3 to $5. He asked if it would not be
reasonable to assess a fee of $5 against each person who presented
a petition for an exemption from the Zoning Ordinance. After
discussion
IT WAS VOTED to assess a fee of $5 to accompany each
application to the Zoning Board of Appeals.
10. It was reported that the University would request tax
exemption on the University owned house on the corner of Triphammer
and Oak Hill Road occupied by President Malott. After a discussion
of the merits of the proposed application it was decided that this
should be decided at the next meeting when properties would be
assessed.
11. IT WAS VOTED that the next meeting would be held on Oct.
13th at 7 P.M. at Engineer Crandall Ia offioe and that the Trustees
would meet for dinner at 6.ololook at the Hotel Marilyn.
12. IT WAS VOTED that the next regular meeting should be set
at the time of the Oct. 13th'meeting.
