MINUTES of a regular meeting of the Village Board held on
Tuesday, June 6, 1950 at 7:30 P.M. at the home of Mayor
Kenerson, 102 Iroquois Place.

1. The minutes of the May 1•2th meeting were read and approved.
2. The following bills paid on authority of the Mayor were
approved:

4. Mayor Kenerson reported that he had called upon City
Clerk Springer to look over the City of Ithaca ordinances, and
found that they were in a rather voluminous book. After spendung
an hour loo''ing through the book he concluded that it would be
quite difficult to get any information from the City ordinances
that would aceist the Village in revising the Village ordinances.
He reported that there was only a single copy on file in the City
Clerk's office and this was made up by pasting newspaper
publication notices on blank sheets of paper.
The Mayor read a letter from W. C. Geer in which he complained..
about the condition of the roads in the vicinity of his house

and the Clerk was requested to reply to the letter.

5. Treasurer Guise reported a cash balance on May 31st of
$1,409.51. He called attention to the fact that it was

the fiscal year on Feb. 29th five or six thousand dollars to
carry the Village along until tax monies were received in June.
6. The Engineer reported he had received a letter from the
Sigma Chi Fraternity in which they asked for reimbursement in the
amount of 6W56.60 for materials used in repairing the fence that
was damaged by the flash flood in the summer of 1947; this fence
being located between the property of the fraternity and the
Village property adjacent. Inasmuch as the fraternity had
furnished all the labor and a portion of the materials and that
the construction of the fence was in the interest of public
safety to the users of the sidewalk
IT 11AS VOTED to reimburse Sigma Chi in the amount of w656 .6o
to cover a. portion of the cost of construction of the fence on
their property.
7. Engineer Crandall called attention to the fact that
the Congregational Cruxch was in the process of having dirt
hauled for fill at their property on Highland Road and that the
truck driver had dumped considerable dirt in the street due to
the fact that there was no driveway giving access to the
property. The Engineer estimated that it had cost the Village
„25 to clean the dirt out of the street as a result of this
operation. He also called attention to the fact that the Church
was planning to get a bulldozer on the property and that the
' curbing might be damaged, and he recommended that the Church be
billed for '25 to cover costs already incurred by their grading
operation and told that the;, would be billed for any further
expense caused to the Village.. Mr. Crandall stated that he felt
that the Village had no authority to spend tax payer's money
for work of this kind. The Trustees discussed the matter for
30 minutes and
IT WAS VOTED that the Clerk be instructed to write to Mr.
Fogg, Chairman of the Board of Trustees of the Congregational
Church, and explain that the grading opbration on their property
on Highland Road had caused the Village an expense of'9%25 and
to bill them for this amount and explain that it would be
necessary for the Village to bill them for any additional costs
incurrea in dumping dirt on the public highway or for any
dam ^ge that might be done to the curb in erse a bulldozer was used
in grading the property.
9. The Engineer reported that Prof. Feller's house was.
now for sale and he brought up the matter of the sewer connection
at this property. An examination of the minutes revealed that
on June 7, 1949 Prof. Feller was given an extension of time to
Dec. 1, 1949 to get his sewer connected. In the absence of any
evidence that Prof. Feller had connected to the sanitan, sewer
system
IT WAS VOTED that the Clerk be directed to write to Prof:
Feller and state that in accordance with the sanitation ordinance
of the Village he is sub 'ject to a ,4,",100 fine if he has not connected
to the sanitary sewer system and furthermore in accordance with
tl_e ordinance that the Trustees hereby give him 30 days notice
to connect; that if connection is not made within 30 days that
the Village will proceed to have the connection made �hd the
charge thereof assessed against the properly. ,
9. The Engineer reported that the questionnaires regarding
apartments in zone 1 were still being received and that he there-

Zoning Board of Appeals would expire on June 30th.
IT 14AS VOTED that W. S. Randel and.Paul Brainard be re-
appointed as members of the Zoning Board of Appeals for terms of
three years each, expiring on June 30,.1953•
12. Air. Shirey reported that he had looked into the legal
I ore did not have a. final report to make on the matter of the
revision of the zoning ordinance.
The Engineer stated that there was 02,000 in the budget for
permanent impmovemente and requested a-directive as to how this
money might be spent. After a discussion regarding construction
of new sidewalks and curbs
IT WAS VOTED to request'the Engineer to proceed with the
construction of the sidewalk.on Triphammer Road from the corner
of Triphammer and Midway north to the Village line, and to
complete the sidewalk in front of the new Cicohetti house on
Triphammer and to proceed with fill on the 'Austin property at
the corner of Upland and Triphammer Roads.
10. The Engineer reported on a request from J: R. Simpson
on Strawberry Lane for the erection of a dead.end sign at the
entrance of Strawberry Lane and a request of Mr. Simpson for
minor road repairs to be billed to the residents inasmuch as
stiiawberry Lane is not a Village street. It was decided that
Mr. Simpson should be notified by the Clerk that the residents on
Strawberry Lane should erect if they wish a private street sign
`and that they should _Hire a priyate contractor to repair the
road, inasmuch as the Village policy prohibited doing contract
work for private individuals.
11. The-Clerk called attention to the fact that the terms
of office of Mr. Randel and I•Ir•. Brainard as members of the
Zoning Board of Appeals would expire on June 30th.
IT 14AS VOTED that W. S. Randel and.Paul Brainard be re-
appointed as members of the Zoning Board of Appeals for terms of
three years each, expiring on June 30,.1953•
12. Air. Shirey reported that he had looked into the legal

steps necessary in order,to annex: a portion of the town of Ithaca on
the fringe of the Village, with particular reference to the land
on the east side of Triphammer Road. The Cleric read a memorandum
that Mr. Shirey had prepared on this subject. It was evident
from :Sr. Shirey's investigation of the laa that any action in
this regard would have to originate from the persons outside of
the Village. The Clerk reported that he had had a phone call from
a resident as to what action the Village-proposed to take in the
matter of annexation of property adjacent to the Village, and
the Trustees decided that anyone interested in this subject should
be furnished a copy of Mr. Shirey's memorandum on the subject and
told that action should originate from persons outside the Village
and that,if.any petition was received from such persons,the
Board would be pleased to consider the matter.
Mr. Shirey•reported that he had had two recent arrests,
one of which was for speeding in which he imposed a $25 fine.
Mr. Shirey reported that the Cooper boy had been found operating
a home -made automobile on the streets of the Village and that
Officer VanZile had had Mr. Shirey inspect the vehicle. I':r.
Shirey said he told the boy, who was about 12 years of age, that
this was an automobile, that it had no license, that the boy had
no license to o_oerate an automobile, and that he should get it
out of the Village and keep it out of the Village.
