HomeMy WebLinkAboutZoning Ordinance 1949 (pg.3)61a ZONING ORDINANCE OF THE VILLAGE OF CAYUGA HEIGHTS An ordinance to establish building zones, to-de- termine the character of buildings, and to regulate businesses. A zoning Commission having been heretofore appointed by the Board of Trustees of the Village of Cayuga Heights and such Zoning Commission having made a preliminary report and having held a public hearing thereon before submitting its final report, and the Board of Truetaes of the Village of Cayuga Heights having held a public heafing, now, Be It Resolved that the Board of Trustees of the Village of Cayuga Heights, by virtue of the authority in it by law vested, hereby ordains and enacts the following ordinance: Sea. 1. DISTRICTS. For the purposes of this Ordinance, the Village of Cayuga Heights is hereby divided into three zones or districts, which shall be bounded and composed as follows: Zone No. 1. This zone shall include all the Village not inalMd in Zones 2 and 3. Zone No. 2. This zone shall be bounded on the east by the Village line, on the south by the Village line, and on the west and north by Kline Road, and Oak Hill Road to a point at the western extremity of lot #160, and thence easterly along the southern boundary of lot #1609 ,'-161, 41629 i#163, #168 and '#169 as shown on the Map of, Cayuga Heights, Renwick Heights and Lands Adjoining, on file in the office of the Clerk of Tompkins County, which line when it leaves Oak Hill Road is intended to follow the former nottherly line of the Country Club property, excluding so much of said territory so bounded as lies within Zone 3. Zone No. 3. This zone shall extend along Kline Road from Highland Road to Overlook Road, extending seventy -fire feet south of the middle of Kline Road within the above limits. Sec. 2 ZONE NO. 1. In Zone No. 1 no building or premises shall be used and no building shall be erected or altered for other than one or more of the following uses: 1. A one family dwelling. 2. A two family dwelling. 3. A street railway right of way. 4. A school house operated for the convenience of the residents of the Village. 5. Any municipal purpose. 6. A church. 7. A librc}ry. ®. Truck gardening.. 9. The office of a•doctor, surgeon; dentist, lawyer, architect, musician or artist, provided that he reside on the premises and that the building be designed to be in character with the district. 61b Sec. 5. GARAGES. Garages shall be restricted as follows: 16 In Zone No..l no garage shall be erected on tiny property to accommodate more than one motor car in addition to those commonly* used by the occupants of that property. 2. In Zone No. 2 no garage shall be erected on any property having accommodations greater than are reasonably necessary* for the use of the occupants of that property. Sec. 6. VOLUIYM RESTRICTIONS Iii Zones Nos. 1 and 2, no building or buildings shall be erected or altered so as to occupy more than fifteen percent of the lot' on which it or they, is or are placed. I! 10. Boarding or renting rooms, provided there is no conspicuous display of advertising.and provided that this use of the property* is accessory to the prinoipal use as a home. 11. Inconspicuous real estate signs, advertising the sale, rental or lease of the premises on which they are located. 12. A restaurant or tearoom, provided that the approval of the Board of Appeals is obtained and provided that at least three quarters of all the persona owning property in the Village of Cayuga Heights within three hundred feet of any ,part of the property to be used for such purpose consent to such use. 13. Accessory uses customary or incident to the above uses. .14. The.location and use of that part of the Lake View Cemetary which Use within the Village is recognized as it exists, but no extension of such use within the Village is permitted. Sec. 3 ZONE N0. 2. . "Within Zone No. 2, in addition to the uses allovrjd in Zone No 1, there -will be permitted "the following uses: 1. Club houses. 2. Apartment houses not over three stories high'and providing,not more than four apartments on a "single floor. Sec. 4. ZONE ITO. 3. Within Zone No. 3 there will be permitted, in ad - dition to the uses permitted in Zones No's. l and 2, such businesses as may be conducted without unreasonable noise, odors, or disorder and without conspicuous display of adver- tising, providing that the buildings to be used for such purposes be in keeping with the character of the neighborhood and that the plans for such buildings be submitted to the Board of Appeals and its approval of them be given. " Sec. 5. GARAGES.
