MINUTES of a regular meeting of the Village Board held on
Tuesday, Jan. 4, 1949 at 7 :30 P:M. at the home of. Trustee.

2. Trustee Randel.:a member:.of. the Zoning Board of'Appeal &,
.reported that a hearing 'we s`held on Dec: 160'1948 at the home of
H. J..Shirey, Secretary, of,.the•Zoning;Board , of Appeale. This
hearing was,.for' the. purpose of.coneidering the application of
Lakeland'Homes, Inc. for permission.to: construct an ' apartment house
eon the corner of Triphammer Road and Dearborn'Place;.6uch apartment
house.to exceed the 15,% limit, as, provided in the Village :Zoning'
Ordinance. About fifteen people attended:the hearing._ The
objections were mostly,to the construction ,of.an apartment house in
this location rather than objections to the fact that the proposed
apartment house would.cover more than 15% of the lot. It was
pointed out•that this lot was in the area where it was legal to
construct apartment houses in accordance -with the Village Ordinance,
The Zoning Board of Appeals decided that..this.,company would be
permitted to proceed. The proposed plan will ,cover:l9% of the total
lot, part of which,is.in the:City, and 22% of:the. portion of-the
lot in the Village will :be' covered by the ..build ing It was
reported that the structure will' contain 24 apartments It was
also reported that this company planned to build a three= s,tory.'
structure instead of a two -story in case their petition had been

denied on the grounds of exceeding the 15% :limit'.

Cedric H. Guise, being duly sworn, deposes and says
that he is the treasurer and collector of the Village of Cayuga
Heights. He herewith returns to the Trustees of said Village
the 1948 Tax Warrant and the 1948 Tax Roll, with a list and
description of the properties against which accounts owing to
the Village remain unpaid as of January 4, 1949, with interest
penalties computed to February 28, 1949; he further affirms
that he has made repeated and diligeiit efforts, without success,.
to collect the same.

6. IT WAS VOTED, RESOLVED: Whereas at a regular meeting of the
Board of Trustees of the Village of bayugaHeights, held on Nov.
16, 1948 at the schoolhouse in the said Village, the Treasurer of
the said Village was directed to return his warrant and tax roll
and an account of the taxes, assessments and charges.remaining due,
containing a description of the lands upon which such taxes were
unpaid as the same were placed upon the tax list, together with
the amount of the taxes, assessments or charges so assessed and
the interest thereon, together with a sworn statement that the
taxes, assessments and charges mentioned in such account remain
unpaid, and that after diligent efforts he has been unable to
collect the same, and
WHEREAS at a regular meeting of the Board of Trustees of the
Village of Cayuga Heights held at 1002 Triphammer Road in the said
Village on the 4th day of January 1949 the Treasurer did comply
with the aforesaid directions', his said statement being attached
hereto showing a balance unpaid of 4195.4o,
NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the
Village of Cayuga Heights do credit the treasurer with the
amount of 0195.40 according to the provisions of Section 126 -a
of the Village Law of the State of New York.
7. IT WAS VOTED, RESOLVED: that the properties on which
the following taxes and assessments are unpaid be advertised for
sale on February 2, 9, and 16, and if still unpaid their sale be
` authorized on Feb. 23, 1949 at 5 :15 P.M. at the schoolhouse
according to the provisions of Section 126 -d•of the Village Law
of the State of New York:

8. The Engineer reported that the grading on the Alpha Tau
Omega lot had been satisfactorily complem.ed and the Fraternity
had paid the cost thereof.

9. The Clerk read a letter from Prof. L.. "A..Burckmyer, Jr.
which stated that,the School Board,was concerned,.over - the
dangerous intersection at the Parkway and Northway Roads and ;.

appealed to the Village,: authoritiea',to erect some'kV.11;of atop
• sign at this intersection to insure 'greater, safety for school
children,'a large',numbar of whom uae this' crossing. Several
kinds of signs were considered by the Trustees, such ae an

10.. Police `Justice Shirey"reported..tbat.he.,had had two.
cases brought before. him in the month of.December and that the
business of his "office was:relatively quiet. He said it_was his
belief that the number of cases of speeding had 'declined ' due to "
the fact that people in. the vicinity' were becoming "aware•of the
presence of a police officer'and':'police. justice.., He. said•:he "
noted•a decrease in the number of complaints regarding speeding.,

12. Trustee Randal, a member of the.Fire Service:, Committee
reported that the City had drawn up a contract for Fire protection"_

Re said that he and.Trustee Sayles had checked this figure and f
found it in accordance with the! formula. previously approved by the,•
City, which formula had been worked out: in'.:. a. conference between
the Village Committee and the City`Committee..,The contract

engine.' company ' for.any alarm of;.fire.and more if deemed advisable
by the' Ithaca Fire, Department, 2);that.In* case: of.' a, serious fire

injury or death. No mention 'was made in the'tontract of the fire
hydrant rental matter, but it was understood:that the!Village
would be billed for fire hydrant rental the'same:as.in the past.
Another change in the contract compared with 'pre viouIs contracts
was the fact,that no extra charge.will be made'for - answering a call.
IT WAS VOTED that.the. Mayor 'and the Clerk be.authorized'to
sign the above described contract with the •City covering the
year 1949.
