MINUTES of a regular meeting of the Village Board held on
Monday, July 12, 1943, at 7:30 P.M. in the Schoolhouse.
PUBLIC HEARING on the Stop sign ordinance from 7:30 to 9130 P.M.

1. The minutes of the meeting of June 7th were approved-with
the following correction of item 10, page 259: "IT WAS VOTED that
Trustee Maxfield be requested to investigate the-possibilities of
a new insurance policy for the Village to cover possible liability
for damage-done to other persons-by city fire trucks-and he was
requested to determine if-insurance on a per trip basis would be
advisable; he was also authorized to obtain such a policy if in his
' opinion the cost was- reasonable.1'
2. The following bills paid on authority of.the Mayor were
approved:

3. The following additional bills were approved for payment;
HIGHWAYS
State Insurance Fund - Add'1 premium 54.78
Moran;- Gleason & Knight - Road surfacing-_ 1,565.00
4. The-Treasurer reported a balance as of June-30th—of
06,975.71. He reported that he had collected to date #16,294.43
in.taxes and..that...the. amount of uncollected.taxes to-date was
$1,005. In view—of—the.—large cash balance;
IT WAS VOTED to pay the sewer and hydrant rental bills at

this time.
Treasurer Guise brought.to•the attention of the.Trustees
communications he had received from the State Civil,Service
Commission indicating that in the future- copies of payrolls of
all employees:of the Village-must-.be-certified. Engineer Crandall.
was•of.the opinion that it would.be possible to getpayrolls'
certified for several months or.a year. . in . advance �_thus.making::,,it:.,,
unnecessary to have each semi- monthly'or monthly payroll certified.
.Treasurer Guise was requested to send ,in a payroll for such
certification.
Treasurer Guise also..read.a communication from a.'State Retire -.

ment Fund official, indicating that.all Village.policemen and•.firemen
must become members of the State.Retirement.System'as . of.their.

date of appointment. -and.that.no salary;-payments shouTd.:be.made in
the month of July until`such.firemen and:policemen.had:become'
!: members of the plan. As the proper l oprocedure.was',not -clear In-
this case, it was suggested that Treasurer Guise'varit'e'to'Albany for

further information.
Treasurer Guise stated that he had received one type of payroll
form from the State Retirement Fund and another type-of payroll
d from the Civil Service Commission and he was requested.to.make an
investigation to find out whether two different.types of payrolls
must be used or whether one would suffice. As the communications
from Albany referred to certain exceptions in a law recently passed,
Trustee Shirey was requested to look up the new law to see what
bearing it would have on Village procedure.
5. Engineer Crandall reported that the street tree spraying
had been completed by Arborists, Inc. and the road surfacing had
been completed by Moran, Gleason & Knight. He also noted that
Hanshaw Road, being a State road, had-been re- surfaced by the State.
The Engineer stated that the mowing of grass this year had
presented an unusual problem. The men who formerly mowed -grass
for individuals in compliance with the Village Ordinance were -not
available this year, with the - result that none of the individual
property owners had done any mowing, thus the Village found it
necessary to do the entire job. After much searching the - Engineer
said he had located.a farmer ten miles out on the Darby Road who
agreed to do the work,: Due,to - the d1stance,,_bI6 hoboes' were housed
in the Village tool shed. Progress with the -work was.slow due.to
a series of breakdowns of his equipment. Due to the many delays in
Setting the grass cut and the fact that.there was much more grass
to cut than normally, the Engineer stated that-it would not.be
possible to cut all the grass twice this.year as was customary.
6. Police Commissioner Crandall reported that the robber whose
activities were reported in the last meeting had been captured. He

admitted being a deserter from the Army and that he had broken
into a total of 19 houses -in Cayuga Heights and the City of
Ithaca.. The Engineer reported that Prof. Harold Reed's house had
been broken into, apparently by someone looking for food;.and that
a situation developed at Kappa Delta Rho which might have been-
very serious. Officer VanZile-approached.-Kappa Delta-,Rho house
one- night• about two weeks -ago at 10 :30 P.M. inasmuch as this house
was now empty and :the University had been-moving-out some-of the
furniture during.the day. As he neared•the, house he was-fired
upon either by a revolver or a high - powered rifle. VanZile
started to return to his carito - get - his ,revolver and.waa..fired,
upon again. One shot duet missed him on.the left.and..the..other
shot dust missed him on the right, but both shots -•hit the -car..
The robber then-went over the bank towards- -the•Mason property
where he had a car parked and made..a get -away before VanZile was.
able-to get his license number. This case remains unsolved.
The Engineer reported that Officer VanZile had .received .
several requests to shoot rabbits. This matter was covered by
a Village ordinance.
7. The Clerk reported that .the. necessary. . notices had,.been
posted regarding the public hearing for consideration:of.the
proposed new Village ordinance regarding stop signs.
The Clerk brought. up, the matter of the. witholding..tax':and,
IT WAS. VOTED that the percentage.. method. rather ,than'..the..
bracket method should be used in computing :the witholding. tax .,
for Village employees.
8. The Mayor-reported that he -had received a letter from
Sherman Peer, Chairman of the Zoning Board of-Appeals, which

he read to the Trustees. He also read a letter from Prof. Nevin
which had been addressed to Chairman Peer in which he requested
permission-to keep hens in his tool shed. The substance of
Sherman Peer's letter was that he did not think the Zoning Board of
Appeals had authority to rule on the matter inasmuch as new
construction was not involved. Engineer-Crandall brought out that
the Village ordinance regarding Zoning gave authority to the Zoning
Board of Appeals to determine not only new construction but the
use of property already constructed and that they did have authority
to rule on matters of this character. Inasmuch as they had not
made a ruling, it was felt that the Village action of April 5th
settled the matter:
IT WAS VOTED that the Clerk be-instructed to write to Prof.
Nevin, who had received a copy of Sherman Peer's letter in which
the Village action was stated, saying that the Village - Trustees
were taking no action as a result of the letter from Mr. Peer.
9. It was reported that no citizens of the Village had
attended the Public Hearing with regard to the adoption of the new
ordinance-with reference to stop signs.
IT WAS VOTED that the ordinance as incorporated in the minutes
on page 260 be adopted, effective August let.
IT WAS VOTED to authorize the Clerk to publish and post the
new ordinance in accordance with the.law.
10. Trustee Maxfield reported that-in accordance with the
request made at the meeting. on June .7th he had,.obtained an.insurance
policy from McKinney Agency providing for.liability.insurance for
any person in the Village who might be injured as a result of an
Ithaca Fire Department truck entering the Village of Cayuga Heights.

The cost of such policy is 011 .50 per trip..
11. The next meeting was set for August 2nd at 7 :30 P.M.
at the , home -of Trustee Maxfield-.
