The minutes of the meeting of July, 6th were read and approved with the following correction:, paragraph:4 of item 5, page 207: "Mayor Kenerson reported that acting under.authority. given him by the New.York State.War Emergency Act, Section 16,, ' he had appointed Bernard J. Reilly to act as.representative,.of. the Village of Cayuga Heights in his capacity as, County Director of Civilian.Protection , ii 2. Mayor Kenerson presented "the.complaint of Mrs Becker" who stated,that some neighbors.next door made so much' noise . that it interfered with.her sleep...The:matter was referred:to_,Engineer Crandall as Police,,Commissioner,`and after investigating';the facts he decided °that. the neighbors were 'creating no general disturbance" and that the matter did not. therefore come 'under hie•)urisdiction: He told.her that this was a. private matter, and. she: should' take it ., up directly with the family involved 5 "..: idayor.Kenerson "presented.the complaint of Mrs. - .Libby, namely.that she had been told that her;.tenants:could,.not park their care over night on Overlook Road between' Hillside Drive: and Kline Road. Mrs.'Libby was under the impression that this, stretch of road was "a private road and therefore the'-Village ordinances ' regarding parking'did not prevail. Engineer.Crandall wrote the Mayor, sending,a copy to Mrs. Libby, in_which.he pointed out that inasmuch "as,the•V111age had undertaken to maintain this road some ,years ago it was now to all intents and purposes;a Village road and that the parking ordinance was applicable.,,Mrs. Eibby :replied that she was satisfied with this explanation and that.she would see to it that the tenants no longer violated the:Village ordinance ". 6. Mayor Kenerson reported receipt of a letter, from Ralph " Croskey', Jr., Summer.House Manager of the Sigma,:Chi:Fraternity, with ,regard to the disturbance that took place,in the - :vicinity of Sigma,Chi some weeks..ago. This disturbance consisted principally . of excessive noise on I the street in front "of'Sigma:6hi early ;one" Sunday morning. As the members :of Sigma Chi "had been warned that ' the Village Policeman had been given orders to. arrest any future violators of the peace, Mr. Croskey endeavored tc defend" the ;.. position of his House and furnished several.letters.from. neighbors as loose cartilages. The Engineer stated- that.VanZile had-been somewhat uneasy because of the fact that;many.of his friends had. obtainbd positions at much higher salaries in connection with the;,'.. war effort, but that his action in telling him his salary would not stop during this temporary disability had resulted in his becoming more reconciled to his position. The principle of allowing the, police officer full salary during:temporary illness was confirmed by the Trustees, although it was agreed that if the illnesa,ehould be extended the.car allowance :should.be disallowed. 9. Engineer,Crandall.presented. the proposed:,water. contract with the water district organized to .,the north of.` the: Village ' Considerable. discussion developed as, :to that` part' of the. contra :ct which pertained to. the share of'costs.to be borne by the water` ' ; district in case of repairo or. replacement of..mains within.the Village which.service the water, district IT;WAS VOTED that subdivision No ,2 of the contract should '` be revised.-to read, a9 follows In case'of major, replacement of:` , c: jointly used Village water mains, the oost thereof shall bepro, rated lietween the parties,. on .a basis to`,be mutually agreed upon eliminating the laet -three lines readingi. except in special' cases where -the cos f, remedying conditions may el, `prorated by mutual;: agreement" IT: WAS 'VOTED that the contra +ct as, prepared by Engineer'Crandall with the above revision made therein be` approved, and'that.thel, Mayor and Clerk were authorized to sign the.contract'if and when" approved by:the.water: district., 10. It'was reported :,that,Justice of Peace °Meigs:'had " .the collected`$3O -in fines and awaited inetrudtions as tb whether these were to be turned over 'to the•Village Treasurer or, to the Town of Ithaca. Trustee Shirey stated that`it .was hie opinion 'that if the fines'.were,collectedI in•violat'ion of the Village ordinances they should:be turned over to Treasurer Guise,..but'if collected for a violation of any other law,`or drdinance they.sh ould be turned.over to the appropriate official, of.'the.Tbwn or: State. Treasurer Guise was instructed.to adeept such ";fines from:Justice. of.the Peace Meigs,and. pay the bill rendered by'Mr...Meiga,.for.: services in connection:therewith out of the :.funds ", so, :rec,eived.' 11. Clerk Trousdale brought up the question of enacting,a., ". Village ordinance "to "provide for, :a fine`in cases where care pass:" through atop signs.. The argument in: favor of "such an ordinance would be' that such fines could be turned, over:: to, the ,,Village and retained.by the Village, whereas at present anyone,passing, through 214- a stop sign is violating 'only a State law and the fine must go.to the State. It was .pointed out that.moet of.Ahe fines ,so turned ' over to the Village�..would: not increase.Village' funds inasmuch:as:' the bill rendered _by the;Justice'of the Peace would ih: "most cases:.` be the. equivalent of the ?fines turned`: over Engineer Crandall.saidi. that it has been the policy of A,14 Board in the past to enact only such Village ordinances that were not covered by" State:Aaw and: that } he did not ,think it' advisable, to duplicate any of the State laws by''' enacting Village ordinances ae;'this would result .An' the enactment of an enormous,number of ordinances which:would,;acoom'plish very .-littl6 in the way of revenue .for. Village. It was decided that it was not,,necessary to have a stop sign ordinance._for.the.VilZage.' 12. The status of .the water contract between the Village of Cayuga Heights and the City'of Ithaca'wae.brought _ up 'And ,it was,` noted that this had been properly, signed :by lAayor Kenerson and Clerk Trousdale, 'an d.had.been submitted to the ,City for the signa -, tures of their officers,' but.,that;the,Village.had not yet received back a aigned copy:::' 13. The next meeting was'set for September 14th 'at' 7 :30, Pii. at the residence of Trustee Shirey. 14.
