PRESENT: C. J. Kenerson, Mayor. H. J. Shirey; Trustee` Sherwood Holt, Trustee C: H. Guise, Treasurer Carl Crandall, Engineer, 1. The minutes of the meeting,of August 5th were approved with the following •correction in Item 5: !'Engineer- Crandall Crandall reported that Col. Nicholls had called his;attention..to . a condition existing at the edge -of Overlook -Road adjacent to,his property, which was a source of danger ". 2. The Mayor reported that he and Engineer Crandall in accordance with the Trustee action taken at the meeting on August 5th had met with a committee representing the City to discuss the bill of 040 levied as rental on each hydrant within the Village. It was brought out in the meeting that Fred Hart, the State Auditor, had indicated that it was illegal for the City to accept 0500 retainer for fire service in lieu of adequate hydrant rental. The representatives of the City and Village therefore agreed that this $500 be discontinued, and that the hydrant rental be raised from #12 to 040, the former rate. The following letter from the City Clerk confirmed this understanding; September 6, 1940 Hon. C. J. Kenerson, Mayor Village of Cayuga Heights 102 Iroquois P1. Ithaca, N. Y. Dear Sir; I am pleased to inform you, that as a result of the conference with your committee from the Village of Cayuga Heights, the Common Council, at a meeting held September 4, 1940, rescinded the action taken by the Common Council on May 5, 1937 in fixing a charge of 0500.00 per annum for fire protection for the Village. The Council, however; voted to continue the arrangement whereby the Village is to pay to the City 050.00 for each trip made in answer to an alarm plus such additional reasonable expense for additional "pieces of fire apparatus beyond the first, and of course it is understood that the hydrant rental is to remain at 040.00 per hydrant per annum in accordance with the bill recently rendered the Village. Very truly yours (signed) F. H. Springer p City Clerk It 108 IT WAS VOTED that the Board accept the report ' of.Mayor Kenerson regarding the conference with the City of Ithaca officials. 5. IT WAS VOTED, RESOLVED that the action taken by the Ithaca Common Council regarding charges for fire service and hydrant rental, as indicated in City Clerk Springer's letter of Sept. 6, 19409 be approved, and the Village Clerk was instructed to notify the City of the fact that the Board of Trustees of the Village of Cayuga Heights Is entirely satisfied with the arrangement decided upon by the Common Council. 6. IT WAS VOTED that the hydrant rental bill in the amount of #720, representing a charge of $40 each on 18 hydrants be paid at this time to the City of Ithaca. 7. Treasurer Guise made his financial report indicating a cash balance as of Sept. let in the amount of $9,946.69. He reported that the Personius note had been paid in full and that he had written F. C. Cornell, Jr. regarding his note but had received no reply. In view of this fact, , Engineer Crandall was directed to discontinue the water service to the Cornell property in accordance with.the Trustee action of August 5th which authorized the water to be shut off if water connection charges were not paid by Sept. 1st. i. 8. In view of the satisfactory financial condition of the Village and particularly since it wae.evident. that some budgeted expense items would not need to be paid during the current year, IT WAS VOTED that an additional #1,000 be paid on the Highway Certificate of Indebtedness at this time. 109. ' 9. The Engineer reported that the shrubbery had been out back at the corner of Devon Road and Cayuga Heights Road in accordance with the action of the Trustees on August 5th. He reported that the culvert by the Aussie Gaskill and Cornell properties, which had been a source of trouble at the time of heavy rains, had been removed. He stated that a building permit had been granted Dr. Durand to remodel his house, and another building permit had been granted Dr. Campbell for the construction of a garage. The Engineer reported that he understood Dr. Betten had let a contract for a new house on Sunset Drive, but as yet no building permit had been requested. 10. The Engineer brought up for discussion the troublesome situation existing at the intersection of Kline Road and Wyckoff Road due to the inadequate drain pipe running under Kline Road. He recommended that a new sluice be constructed running under the intersection of Kline and Wyckoff Roads of sufficient size to properly handle the drainage from these streets. IT WAS VOTED that the Engineer be authorized ton construct such a sluice at an estimated cost not to exceed $200, such expense to be charged to the Permanent Improvements fund in the budget. 11. IT WAS VOTED to renew the garbage contract for the year beginning Oct. 1, 1940 at a price of $1,800 on the same basis as the last contract, bxoept that a new paragraph was to be written into'the agreement to provide that Mr. Mosher carry ' Workmen's Compensation Insurance and file a certificate of the F- same with the Board. The Mayor requested Trustee Shirey to ®Y negotiate the new contract. 12. The date for the next meeting was set for. October 7th at 7 :30 P.M. 13. Adjourned at 9 :15 P.M.
