Trustee Scofield raised the'_question•asAo the propriety of designating the, annual,hydrant' charge made by, the City. of Ithaca• against the Village': as, "hydrant rental ": He`,pointed• out Ahe fact that since the`Village owned the hydrants the City could -h'ardly be` in a position to charge the - Village rent.for, them.' Since This- charge by the City in reality represents maintenance. and hydrant service, IT WAS VOTED that the item that appears'in °the budget, as "hydrant rental" be designated as "hydrant service'!. in the. future... �. It was recommended to the Treasurer that he make a notelon his books •referring.to.the minutes of Sept. 9, 1940. 5. Engineer Crandall reported that he had notified the City Water Superintendent to shut off.the water to the Franklin Cornell III property. He stated that the sluice on Wyckoff. and Kline Roads bad been completed at a cost of.about $130.. ' He reported that building permits.had.been.issued to Prof. Betten on Corson Place,-to 0.1N. Silcox on.Devon and:Cayuga Heights Road and to Prof.' Hurd on Oak H111-.Road'.' All three of these .houses are now under construction'. .He said that,a recent.check had been made.on cars,,illegally parked within the Village, at which time nine cars "were given:' warning tags. A second check within a.few days- revealed that.. the r 113 cars had disappeared. The Engineer reported that the O'Connell sewer, had been connected, _leaving Prof. Durham the only person still unconnected. The latter stated that he had let the contract to build his: sewer to Perkins and had tried all summer without success to get' him to construct it. 7.. .Engineer Crandall explained the'sewer' and water situation regarding the.two.houses' recently constructed.by Mrs. Cicchetti on Triphammer.Road.. He reminded 'the Board-':that Mrs. Cicchetti had paid $75 to connect with the water service when her first house was.built. 'She did.not,.however, connect to the Village sewer line. When her second house was built she applied for another permit to connect to the water service, and although the.Village Board voted at'their August 5th meeting.to permit her to connect to the water system upon payment of,the usual $75 assessment, the Engineer.refused to issue the permit unless Mrs. Cicchetti would connect with the sewer also..- His reason for this was that Mrs. Cicchetti had planned to construct a septic tank in front of the corner house, which would drain down Upland Road and into Pleasant Grove Creek, causing a possible,:' pollution of the water. Since the Village recently passed.a sanitation ordinance to avoid just such a condition`as this, the Engineer.told Mrs. Cicchetti that if she wanted the permit..for . water at $75 she must pay an additional aeseseinent.of $150 which would allow her to connect.to the sewer also. :Mrs. Cicchetti:, . finally consented to. this arrangement. IT WAS VOTED .to'authorize'the:lssuance'of a,sewer permit to Mrs: Cicchetti at 819 Triphammer Road, upon payment of•the 4150- 114 assessment and $27 per year for sewer service. The question of a sewer connection for Mrs. Cicchetti's first house was discussed, and the Engineer pointed out that in his opinion'.the house could not be sold until such.sewer connection was made. He stated -that in :all probability Mrs. Cicchetti would be force,d.to sell within a year, and the situation could be remedied at that 'time. 8. The.Engineer_ also stated that Mr.,Silcox was unable to make use of the sanitary eewer.in the conatruction.of his house on Cayuga.Heights Road'since the- house would be,too low. He,had requested a permit by the Village Board to build aseptic, tank, Jl and Mr. Crandall had asked him for specifications.so -that they might be approved -before the permit was. issued IT WAS VOTED that,the Engineer be authorized.to,issue.the necessary permit on presentation of the,plans for the septic tank and their approval. 9• The Engineer reported that Prof. Betten could not reach the water main.on Corson Place.or the_one on Wyckoff Road,.'and it was necessary to extend a.four -inch main for 150,',feet. Si. n.ce it is the policy.of the Village.to lay no water.,mains unless the Village gets.some benefit from them, it.was, arranged to have Prof. Betten and Prof. Curtis, who'owns an adjacent.lot,:divide the cost of laying,the main.. Mr. Crandall stated .that Prof. Hurd's lot had ino ; water, and it had been. decided to put in four -inch service.back;'of:'the.lots in this vicinity instead.of, in.the street The Engineer reported. that .the. water ,service.at:Sunset Park which was put in some years ago by.Mr. Newman is never used.. 1 115 A water service is needed, however, in the Village tool house, and the Engineer had therefore arranged to have the service trans- ferred from Sunset Park to the tool house. 10. Engineer Crandall presented the following letter from F. A. Rogalsky, Secretary of the Westview Terrace Corporation, regarding the construction of.a sewer line to serve the We are willing to provide a sanitary sewer to the owners of the vacant lots to the east and Mr. Brainard provided said owners pay for that portion of the sewer extending from their lot to our sewer. An easement to use such.sewer will also be granted., Mr. Brainard, however,.declines to pay for his portion of such extension and we feel that this burden or any part thereof should not fall entirely on our shoulders. We respectfully request, therefore, that your Board reconsider the matter so that we may proceed without delay. Yours very truly, Fred A. Rogalsky Secretary,: ' FAR.R. WESTVIEW TERRACE Inc. The Engineer pointed out that the only available sewer is ' on Highland Road, and that it was doubtful if the owners of the proposed apartment house: Sept. 21, 1940 J. B. Trousdale, 102 Northway Road, Cayuga Heights, N. Y. Dear Mr. Trousdale: On February 13, 1940, we received a letter from Carl Crandall to erect a group of attached dwellings in the Village. This permit was granted under five conditions all of which we are glad to comply with excepting number 2 which rbads.as follows: ' 'You are to provide a sanitary sewer extending to the east line of the property in the vicinity of the entrance driveway and low enough in elevation to accommodate the vacant lot and the Brainard lot to the east which otherwise would be barred from any sewer outlet, and those two lots to have the easement to use such sewer.' We are willing to provide a sanitary sewer to the owners of the vacant lots to the east and Mr. Brainard provided said owners pay for that portion of the sewer extending from their lot to our sewer. An easement to use such.sewer will also be granted., Mr. Brainard, however,.declines to pay for his portion of such extension and we feel that this burden or any part thereof should not fall entirely on our shoulders. Engineer ,Crandall. stated, that :the Corporation was ? will ing to: conetruct'.their:;` own , sewer, from Highland Road to the corner of their lot,: but that they:were. unwilling to extend the line across the southeast.!corner of .their lot to a.; point at the junction of•.the.Baldridge. and Palmer.lots.;:Mr. Crandall explained that his reason for asking'the;corporatiori to build the added.section.of. sewer line. at this, time '.wae: to, 'save, the Village trouble and.embarrassment'at some future .time when such; sewer would be.neceesary:in order to serve :the "Brainard house and possibly others on the Baldridge,and..Palmer lots. .He: estimated the probable cost of ouch an'extension'to be,,about,0550 and_. explained that the corporation could, be compensated for this expense by deeding over to'the Village the'lower end of;the.'eewer line with the understanding that the Village maintain and.operate it. Furthermore, the :Village could relinquieh.their rights .to.any, assessments which might -be.made against any person who might hook into the sewer later on, such assessments to.be.turned';over to the corporation. Further compensation might be. offered the corpora= tion by a generous attitude by the Village Board:of Asseesore.in making their assessment of the apartment house% The Engineer :stated.. that if the Board did not wish to insist that the corporation . build the sewer line extension, they could ask for`an eassment .k 117. which would allow the Village to dig up their property in order to put in the sewer extension at some future time.. After considerable discussion, IT WAS VOTED that the requirement for the.coristruction.of a sewer extension at this time be waived,.provided the corporation grant an easement over their property for the extension of the sewer line, and provided they deed the main sewer line to the Village and waive any rights to subsequent assessments against other.property owners to that line. IT WAS VOTED that the Engineer's report be approved. 11. The Clerk reported the receipt of the signed garbage contracts with Mr. Mosher as drawn up by Trustee Shirey, also the statement from the Insurance Company that Mr. Mosher carried compensation insurance. 12. IT WAS VOTED.that a special meeting be held.on October 21st at 7:00 P.M. for the purpose of making assessments. 13. IT WAS VOTED that the Hoard meet from 6 to 10 P.M. on November 19th for the hearing of Grievances, and that a regular meeting be held on the same date at 7 :30 P.M. 14.
