9. Engineer,Crandall reported-that" the:Chamberlain, property
had now been connected to the Sanitary Sewer System;,A
He reported also that the sidepath on Triphamme,r"Road
was finished and that he had granted a.permit to Mrs. Albert,,.

IT J9AS VOTED to affirm the . action ,of ..Engineer; Crandall
in issuing this permit.
The Engineer also reported the issuance.of a:new..building
permit to.Mrs. E.'Cicchetti for the construction of a house on..the
northwest corner of Triphammer Road ` and, East, Upland -Road
10. Mr. Crandall reported that'it Was 'not neceesary.to hire
extra police on Hallowe'en.this year,, that', no serious damage was done.
It was noted, however, that the. inclement 1 weather•<<had.a':good deal to?

12. IT WAS VOTED that -the Village adopt the following
ordinance: ic. _ i on' ,
111. All owners or occupants of property in the Village
of Cayuga Heights shall forthwith and at their own expense
connect all occupied buildings located on such -properties
with the sanitary.sewer system of the Village wherever a
sewer main has been provided by the Village in an adjoining
or adjacent street to receive such connections'.
2. The use of privies, cesspools, septic tanks, outhouses,
or other private means of sewage disposal is hereby,
forbidden, except that special permits may be obtained from
the Village-Board for the installation of modern sanitary
septic tanks wherever a sewer main has not yet been provided
by the Village. The sanitary condition of, and effluent from
septic tanks constructed under such special permits shall..be
properly maintained at all times.
3. Upon violation of Part 1 of this Ordinance by any owner
or occupant of property, the Village Board of Trustees may'
cause the occupied buildings situated thereon to be connected
with the Village sanitary sewer system and assess the cost
thereof upon the land on which the improvement was made, but
such connection may be so made and the cost so assessed only
after written notice of violation to the owner or occupant
and the expiration of thirty days after the date of such notice.
4. Any violation of Part 2 of this Ordinance by any owner or
occupant of occupied buildings in the Village shall constitute
disorderly conduct, and any such person shall be deemed.a
disorderly person, and shall be punishable by a fine not .
exceeding 0100 for each offense."
13. Trustee Shirey made a very comprehensive report on his
investigation of the Workmen's Compensation Law as it might effect
the Village's liability in the case of Mr.-Mosher and his employees.
A lengthy letter had been received from.the State which bore out,
Trustee Shirey's former contention that the Village was in the:
position of owner, that Mosher was an independent contractor and.,
that the Village could not be legally.liable -if any accident befell

either Mr. Mosher or -employees:' How ever;``the'Trustees felt

that as a matter of principle.and'to save the Village from: °possible

embarrassment'or criticism all contractors with the Village should .
be expected to carry proper insurance:

MINUTES of a special meeting of the Board of Trustees of the
'
Village of Cayuga Heights held at the Schoolhouse at 7:30 P.M. on
Nov. 21, 1939•
1. On this date the Board of Trustees sat for four hours,
from 7 :30 P.M. to 11:30 P.M. as a Board of Assessors to:hea'r:
grievances and complaints,with,riegard to the assessment roll .es
prepared by them.for.the.year 1940, and as filed with the Village
Clerk on Oct. 23, 1939.
2. Complaints were received from the following:;
.1) From Tompkins County Trust Co, regarding the assess-
ment on the property at 115 Ridgewood Road:

The claimant appeared in person requesting a reduction
of 4500 on his property on Northway Road, stating that he had paid
only #11,000 for it and that in consideration of assessments of
the other houses on the street he thought his property.should be
assessed for $10,000.
ACTIOTS: .IT WAS VOTED to reduce.the assessment from 010,500
to 010;000.
5) IT WAS ALSO VOTED to reduce the �aese`ssment;.,on the;
property of Mrs. Pauline, E: Congdon at 210 E.., Upland' Road.'from .'
$7,800 to ;6,800 since the recent, sale of a lot by her to 2drs
E. Ciechetti, and to. add, sheet to the aseessment1.roll.for

ACTION: Since' the assessment' had been reduced thi's year to"
$100000 IT WAS VOTED that the assessment remain unchanged.,

bring the assessment in line with the Blood.Estate -lots which
it adjoins.
4) Edgar A. Whiting, 115 Northway,Road-.
The claimant appeared in person requesting a reduction
of 4500 on his property on Northway Road, stating that he had paid
only #11,000 for it and that in consideration of assessments of
the other houses on the street he thought his property.should be
assessed for $10,000.
ACTIOTS: .IT WAS VOTED to reduce.the assessment from 010,500

3. IT WAS VOTED to adopt the following resolution:
'WHEREAS: The Village.Board of Cayuga Heighta,.acting as
Assessors of the said Village according to a resolution previously
adopted, have prepared an assessment roll for 1940 and filed it in.
duplicate with the Clerk of the'Village prior*to November let, 1939
and
WHEREAS: The Clerk'caused a notice to be published in the
official newspaper of the Village and posted in five conspicuous
places in the Village before November 8, 1939 a notice that the
1940 assessment roll was.,filed at.his residence, 102,Northway Road,
Cayuga Heights, New York,'where it might be seen until November 21,
1939 and
WHEREAS: on the said 21st day of November a drlevance Day
was held and the said Board met from 7:30 P.M. until 11 :30 P.M. on
the said day, one person appearing and changes made-as disclosed
in the minutes of the,said Board, now therefore be it
RESOLVED that the said assessment roll as now prepared and
verified with the assessors'"'oath be now completed,'verified, and
ordered filed with the..,Cl'e,rk, in the total amount of, x$2,778,395.
