Minutes- 10/9/19391 1 r J e� r •MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held on October 9, 1939 at 7 :30 P.M. at the 'Schoolhouse: PRESENT: H. R. H. H. C. Ca E. P. J. H. H. rl Baxter.- Mayor Sibley, Trustee Shirey, Trustee Scofield, Trustee Guise, Treasurer Crandall, Engineer 1. The minutes of the meeting of June 5th were read and approved with the following corrections: Page 49, item 5 - omit "adjacent-to his property -on" and substitute "At the-inter- section of Devon Road and "; item 8 should read as follows: "The Engineer reported that he had-,investigated the request of Col. Nicholls for the cutting-down: of •the', two elm trees on Overlook Road and recommended their removal. The Board agreed with this proposed action." Item 119 page 50, second paragraph, addition of the word "considerable" before "area ". 2. The following bills paid on order of the Mayor and Acting Mayor were approved: GENERAL C. H. The Mayor reported that he had received a,letter•from Prof. J. H. Tanner in which he stated that his share in the Tanner property had been sold to Mrs. Tanner. 5. The Mayor read a letter•from Mrs. Libby in which-she-resigned as Registrar of Vital Statistics: IT WAS VOTED that--the--matter--of selecting-her-successor and an Assistant Registrar °be °referred••to the•Mayor with�,power. 6. Mayor Baxter - reported that-he was becoming•concerned over ' the large number•of street lights•which are constantly being broken through ,juvenile vandalism. Several of the trustees testified�as . to the extent of this ,damage but due-to the difficulties of correct- ing the situation no action was taken: 7. Treasurer Guise made his report for the period from March lst to September 30th, showing a balance on hand on October let of $7086.55. 8. Engineer Crandall reviewed the work done in the.Village since the last meeting which included the usual cleaning and repairing, mowing of weeds, construction of culvert headwalls, completion of the new sidewalk on Hanshaw Road, and the.grading for the sidewalk on Triphammer Road. He brought up for discussion the matter of building a short strip of concrete on.Triphammer Road in front of P. W. Brainard's house; but it was the consensus of ' opinion that the construction of concrete sidewalk on Triphammer 56 Road should- be'-deferred until after•-the •next ° -meeting.-of° the ... residents of the-Village. The walk with the gravel top till be completed- -this­ fall: 9. Engineer Crandall reported••that considerable savings had been made•.on the appropriation• --for•sidewalk construction•,: and as a result: he-, -recommended- that-•the ­Village-•pay -•off at this time-the-remaining 01�900•on- the -Sewer Certificate which-fell due Oct. 4; •1939: • After••d•iscuss•ion- IT WAS -VOTED to•pay -off''the.remaining; indebtedness• amounting to- #1,900-plus -interest-;- -on--the-,Sewer--Certificate-;- such payment- •to °be made'from -the-unexpended••balances•in - the budget: 10. Treasurer Guise reported- on• hi•s• •correspondence • with the authorities in Albany in regard to the.-necessity-for the•Village- to take out Workmen-'s Compensation -•Insurance•for-Charles Mosher, garbage collector•.. The question,-seemed--to hinge on whether•or not he was an employee -of the Village -or- an•independent•contractor•: Treasurer•Guise had not received any demand in writing that.the Village carry such insurance. Trustee Shirey reported that-he had looked up the law on the subject and.that it was his opinlon:that,Mr.,Mosher.was not an employee, but a contractor, and that as far as he, could determine the Village was not obligated to carry insurance on him. .Trustee. Shirey held that the Village.was not.the contractor and:Mosher the sub- contractor, but that the Village was -the owner , and+ -Mosher the contractor, and therefore the Village is!not'obllgated-to,.carry the insurance: Trustee-Shirey-agreed to follow:•the!matter uprand endeavor to get a ruling.in writing from the authorities:. 11. IT WAS ;VOTED that•the garbage;contract•bei,r6newed, with Charles Mosher for the•term of'one yeast in the,amount of. #1,800 57 under the same conditions as the contract that has been previously In--e ff set-., i 7;,7 12. The-Board-voted-to constitute themselves a Board of Health and as such they elected Dr. H. H. Crum to be Health Officer of the Village for a term of four years for the period Sept: 16, 1939 to Sept. 16, 1943• 13. The residents o.',the Village who- have!not —yet connected with, the•,sewer; system were stated by ,Engineer Crandall to be Prof: Durham, Mr: Chamberlain, Mr. McKinnO,;. :Mrs. O'Connell, and Prof. Petry•, Clerk Trousdale read• a°letter-from ° Mrs : O'Connell in which she asked • to -be excused from—complying—with the rule for connection-of sewers: Her reasons;- however; did not -seem particularly valid; and such excuse was denied-and--the Clerk was requested- to- notify- her- with a• suitable, letter A general discussion• followed• as• to the-procedure-to-be taken to force the delinquents to-connect with the Village sewer system, and it was decided that it would be necessary to have a Village ordinance in-order--to-bring-this about: IT WAS VOTED that Trustee Shirey and Engineer Crandall be appointed on a committee to draft'a suitable ordinance requiring all residents of the Village to connect.with the sanitary sewer system. 14. A special meeting was called for October 23rd.at 7:00 P.M. to make up the assessment roll. 15. IT WAS VOTED*to have Grievance Day on•November.218t fbom 7:30 P.M. to 11 :30 P.M., with'the regular business meeting at 7:30 P.M. on the same day. ' 16.
