MINUTES of a special meeting of the Board of Trustees of the Village
of Cayuga Heights held on April 28, 1939 at 7:30 P.M. at the
Schoolhouse, and of the Public Hearing on the.Budget held from 7:30
to 8:30 P.M. on the same day'.
PRESENT: H. E. Baxter, Mayor
R. P. Sibley, Trustee.
C. J. Kenerson, Trustee
H. H. Scofield; Trustee

1. The minutes of the'meeting of April 3rd were read and:
approved.
2. The following bills paid on,. authority of the Mayor.were
approved:.
HIGHWAYS.
..Frank Haskins - 17 hr. @ 1.10 18,.70.

3. The following additional bill.was.approved for payment:

.4. Mayor.Baxter reported that he had written Col. Nicholls
a letter calling his attention to the existence of a rubbish pile on
his property in violation,of the Village ordinance, and.read the
reply he had received. from Col. Nicholls, who stated that the matter
was being remedied. He also read.a letter from Mrs. Libby, express-
ing her.appreciation for the Boards action in.getting:the,place,
cleaned up.
5. The Mayor also read -a letter from Col. Nicholls calling
the attention of the Village Trustees to the,damage' being done',to ,
the new sidewalk on Overlook Road by the roots. of two. elm trees on
that street, and.asking that the Trustees consider..the removal:of.
the trees. .
IT.WAS VOTED that .Engineer Crandall be authorize,,d:to.;irnvestigate
the matter and to cause the removal of the trees if justified.

6. Mayor Baxter read a letter written by Prof. F. B. Howe,
'
President of the School Board, to Trustee Kenerson concerning bus
transportation... The letter stated that the,Ithaca Railway had
announced.its willingneas`to contract: with the School,Board.for
the,transportation.of the children next year :at.a price.of_$2,800 .'
with the understanding that'no public trips :would be :made with: the.
.school buses. If'.public trips. were to be. made, Ithaca Railway
would charge #200 more for,thia service.. ':,Prof :Howe mentioned
that:the School. Board- had..decided:to , askithe Villa6e.Board to,-pay.
this differential of`4200 in order :to continue the bus ;service
as it exista..at present., After considerable discussion,, it was
decided that.before the:Village Board, voted on: :the.question:of.
subsidizing the bus service;it should be discovered to:what extent.
the buses are being used by the Village residents
IT VIAS VOTED that Trustee Kenerson be requested to investigate
the matter.before.the next meeting.
7. Treasurer Guise made his financial report which was
ordered filed with the records.
8. Treasurer Guise also'.reported receiving a call from a
representative,of the State Insurance Fund, who ",.wished it brought
to the attention of the'Board that it was necessary'to have on
file certificates of workmen's compensation insurance from all
of the Village contractors., Treasurer Guise stated that Moran &
Gleason and B. C. Perkins were insured and that certificates
could be obtained from them, but. that - Charles Mosher�,igarbage`
collector,'was, carrying .no insurance on'his`workneni.' In oase_..of-a.n
injury to any.person on his payroll Mr,. Mosher-would.be liable,`;,::

but if unable to'pay the amount of.the claim the Village would be

liable. It'was decided that Mr. Mosher should be asked to carry
this insurance, since the cost would undoubtedly be small considering
'
the size of his payroll.. Mayor Baxter•offered to find out from
Mosher the amount,of his payroll ,.number.of' employees, and.`report to
Treasurer. Guise,,.who in turn:would,obtain.a price on the cost of such
insurance from a.local, agency:
9. Engineer Crandall reported that >the streets had been"clesned
of cinders.'and sarid- that' were . put, .on` in :the - :winter months,-- that. some
patching has been done, and: brush and refuse carried .away £rom the
streets: The Engineer, recommended- that .work .b6 done - •within= the 'next
month on the Hanshaw.'Road sidewalk, ;and
IT WAS VOTED,that Engineer,. Crandall, be authorized'to:hade B. .C.
Perkins.finish the sidewalk at 200 >per square foot, the amount to be
taken out of the sidewalk fund as provided: �in the budget
10. Engineer .Crandall also state.d`the. necessity :of:hav pg the
street trees sprayed soon. He had.received,two.propo'sals one 'from
Arboriats, Inc.,and one from Mr. Hafely. Both would be willing'to
do the work'for 0200, although.4250 was included in the,budget so
that a better job might be done.. Arborists did the work last year
and proved satisfactory.. They have made an effort to train their .
personnel, and are recommended also:by.,certain of - the:Village- residents.
Mr. Hafely has been doing some landscape `work around the Village, but
is without recommendation:
IT WAS VOTED that Engineer Crandall.be authorized:to'make a,
contract -with,Arborists to spray all the.:trees in the'Village,within
30 feet from the center of the streets, within the limits of the•
0250 set up in the budget`for_ this purpose.
11. Mayor Baxter reported that, no persons appeared 'a'-'CItbe.
Public Hearing on the Budget, held from 7:30 to••8.30, and
12. IT WAS VOTED, RESOLVED that, the budget. as incorporated'

in the Minutes on pages 37 and 38.be' adopted.
13. IT WAS VOTED.that the tax rate be set at 6 mills'
for.the year 1939 -40.
14. IT.WAS.VOTED that-'the Board .go into`a committee of

the whole, to� make;nominations for :Village' Trustee .to fill Ahe . .
vacancy caused by the resignation of-Sherman Peer.;
15'. 'The `Board re- convened; and IT WAS VOTED that, Henry ;
J. Shirey be appointed.Village,,Trustee to. take ` office. at` once .for
the remainder of the.official`,y,ear.
16.: Trustee Sibley.was. appointed Acting Mayor by.May' or
Baxter for'the year. 1939-40.
17. IT WAS .VOTED that the Mayor.be authorized to- notify
the official bank of the'foilowing names. to: be.honored•on; checks
for the year 1939 -40:. H. E.,.Baxter; Mayor or R. :P.,Sibley,
Acting Mayor; J. B. Trousdale,. Clerk;.and C. H .Guise, Treasurer.
18. IT WAS VOTED that the Clerk be authorized to�.send a
final notice to those residents of the Village who have not yet
connected to the sanitary sewer system, specifying.July lst'as
the final date this must be done.
19. IT WAS VOTED that regular meetings of.the Village.
Board for 1939 -40 be held on the first Monday of the month:'
20. IT WAS VOTED that the next meeting of the Trustees be.
held on Monday, June 5th, at 7:30 P.M.
