MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held on-Nov.16, 1937 at 8 :00 P.M. at the Schoolhouse, and- of the Public Hearing on the Fireworks Ordinance held from 7 :00 to 9 :00 P,M.'on the.same day. The minutes of the meeting of.Oct. 26th we're.read and approved with the following addition to item 14, page 207: "It was.moved and.carried.that the.Board accept the recommendation of Engineer Crandall, which was.to,the effect,.tha.t no money - should be spent at this -time to _reduce the sharp eorner existing at Cayuga Park Circle and Highland Road." - 2. The Mayor brought up the subject of the cars which were habitually parked all night on the -- streets of-the Village.- After a general discussion as to.the best method of handling the situation it Was moved and carried that Engineer Crandall be authorized -to take the necessary steps to have the persistent violators of the parking ordinance arrested. 0 5. Treasurer Guise read.a list of the.:unpaid taxes and IT -WAS VOTED , RESOLVED: Pursuant to ,the: Village Law::. of the -State of.New York, section 126a,.that -the . treasurer is'hereby required to return, warrant, and tax roll to .the Board! of Trustees at`their: next "meeting on December 13th, together with an account of the t axes: remaining',due, containing a description of °the lands upon, which such taxes were unpaid as the same were.placed upon the tax list together with- -the amount: of the tax so assessed and interest thereon, verified,by oath before'any. justice of the peace or judge of a court of record or notary- public'.or'.any.other' officer authorized to administer oaths "that the taxes mentioned.in any, such account remain unpaid and that after diligent efforts he has ..been. unable to:collect the .same. 7. Engineer Crandall reported.that he had.investigated the rumor that Prof. Johannsen had violated the zoning ordinance in regard to the ' number of families,-.living in.his house. The facts proved to be that most of the residents of the house belong to the Johannsen family, and inasmuch as cooking facilities were available for only two families it was concluded that no violation was thking place. Inasmuch as Prof. Johannsen in 1935 had made certain alterations-in his house without secur- ing a Village building permit, IT WAS VOTED that Engineer Crandall issue Prof. Johannsen a retroactive permit 'for the alterations done two years ago. B. Engineer Crandall recommended for consideration the publication of 1,000 copies of the Village Ordinances, and the Clerk was requested to obtain bids on the cost thereof and Present such bids at the next meeting, 9. Engineer Crandall recommended that steps be, taken toi:bring the•,,• Town.Board of 'Assessors together with the Village Board:'of Assessors for the purpose of securing uniformity in the, assessments. on each.property ' within the Villa.` 6e limits,, This proposal, met with favorable response 21 from the Board members and it was decided that the matter should be, discussed further at the March meeting.. 10. The Clerk stated that booklets .had been made up of the ordinances for each.member of.the:Board in, accordance with a'previous request, "and a copy was.handed_to each.member: present., X11. .The.Clerk reported that he•had'_written the.. ,State De'partmen't. of Education regarding instructions concerning_;the purchase of a:_new safe.and, -had regeived a reply.:•.,This was handed to Mayor Baxter who,, read a - portion of the communication:.indicating that.'the.State required an A -label safe to house- •certain - listed village'records. :After . discussion IT WAS. VOTED that this.matter be :brought - up, for.:final. decision at the time the new budget is considered, 'inasmuch, as a new safe would cost approximately ,$435. 12. .Trustee Dale reported that he had looked .further.into the matter of the cutting back of the shrubbery on Prof. Palmer's corner lot and was satisfied.that the. shrubbery was now trimmed back to the proper legal distance. The Trustees thanked Prof. Dale and Prof. Scofield, *the other member of the Committee, for their work'and the committee was ordered discharged. 13. Engineer Crandall made a- detailed.report with regard to the overdue certificates. He stated that a conference had been arranged between Attorney Tracey Stagg representing the Village and Attorney •Allan Treman representing the Ithaca Savings Bank, at which meeting Attorney Stagg satisfied .attorney Treman that his (Stagg's) ph.n for extending the due date on the overdue certificates was legal. As a result of this the bank agreed to an extension and -Also to a, reduction in interest rates from 5/ to 4 %. The following letter.was; received by Attorney Stagg from G. L. Cook of the .Ithaca Savings Bank. 214 ff November 15, 1937 Mr. C. Tracey Stagg, Attorney Village of Cayuga Heights Ithaca, New York Gentlemen: You have recently indicated to us that you are contemplating issuing bonds to refinance the Paving Bonds held by our Bank. In view of the fact that you could probably obtain a loner interest rate by such re- finance, the Finance Committee have resolved that they will accept 4% on the Bonds as full payment of the interest installments, starting with the installment due July 1, 1938, and until further action by the Finance Committee. Vice President 1 1 215 14.Following is a copy of the action taken by the Ithaca Savings Bank in regard to the Village Indebtedness: WHEREAS, After considering the contents of the letter of November 12, 1937, from Allan H. Treman, with regard to various indebtednesses of the.Vill'age of Cayuga Heights IT IS HEREBY RESOLVED that after January 1, 1938, until further action by the Finance Committee, the Ithaca Savings Bank will accept 4% interest as full payment of the interest installments due on the Paving Bonds of the Village-of Cayuga Heights, now held by the Ithaca Savings Bank,and that a�letter be written to the Village of Cayuga Heights to this effect. IT IS FURTHER RESOLVED, That upon proper resolution by the Village Board, and proper extension agreements be drafted which have been approved by our Attorney, that the Sewer Certificate dated October 4, 1930 be extended from April 1, 1935 to October 4, 1935, from October 4, 1935 to October 4, 1936, from October 4, 1936 to October 4, 1937, and from October 4, 1937 to October 4, 1938; that the last extension be also modified to reduce the interest rate on this Certificate from 5% to 4 %. BE IT FURTHER RESOLVED, That upon proper resolution by the Village Board, and proper extension agreements be drafted which have been approved by our Attorney, that the Village Certificate dated October 15, 1931, be extended from April 1, 1935 to October 15, 1937, and a further extension from October 15, 1937 to October 15, 1942, with interest modified from 5% to 4 %. 15. As the extension of time on the sewer certificate was made under a provision of the law which provides for renewal from year to year, the following resolution was adopted: WHEREAS, at a regular meeting of the Board of Trustees of the of Cayuga Heights held on September 29, 1930, a resolgiCion duly adopted authorizing the borrowing from the Ithaca Savings of the sum of $25,000, or so much thereof as might be needed the construction of a sewer system in the Village of Cayuga ; and WHEREAS, pursuant to said resolution the sum of $25,000 was borrowed from said Savings Bank on a certificate of in- dated October 49 1930; and 216 �I AREAS, the aforesaid certificate of indebtedness was drawn a term of one year, which term expired on October 4, 1931; and WHEREAS, said certificate has been renewed and extended from to time, the last extension being to April 1, 1935, in the nt of $22,500; and WHEREAS, it now appears that it is to die best interests of the illage of Cayuga Heights to renew said certificate in the sum of 20,000 from April 1, 1935, to October 4, 1935; NOW THEREFORE, BE RESOLVED, that the certificate of indebtedness in the sum of 5,000 hereinbefore described be renewed and extended from April 1935, to October 4, 1935, in the principal sum of $20,000 and at the Mayor execute for and on behalf of said Village, and in is name, the necessary instrument of renewal or extension of said to of indebtedness in the sum of $20,000, and that the illage Clerk attest such instrument and affix thereto the corpora of the Village. 16. IT WAS RESOLVED: WHEREAS, at a regular meeting of the Board of Trustees of the illage of Cayuga Heights held on September 29, 1930, a resolution s duly adopted authorizing the borrowing from the Ithaca Savings nk of the sum of $25,000, or so much thereof as might be needed r the construction of a sewer system in the Village of Cayuga ights; and WHEREAS, pursuant to said resolution the sum of $25,000was borrowed from said Savings Bank on a certificate of dated October 4, 1930; and N,. 7 WHEREAS, the aforesaid certificate of indebtedness was drawn I or a term of one year, which term expired on October 4, 1931; and IY1HEREAS, said certificate has been renewed and extended from ime to time, the last extension being to October 4, 1935, in the of $20,000; and WHEREAS, it now appears that it is to the best interests of Village of Cayuga Heights to renew said certificate in the sum $17,500 from October 4, 1935, to October 4, 1936; NOW THEREFORE, IT RESOLVED,.that the certificate of indebtedness in the sum of ,000 hereinbefore described be renewed and extended from October , 1935, to October 4, 1936, in the principal sum of $17,500 and that the Mayor execute for and on behalf of said Village, and in 'its name, the necessary instrument of renewal or extension of said ertificate of indebtedness in the sum of $17,500 and that the illage Clerk attest such instrument and affix thereto the corpora eal of the Village. 17:. IT WAS RESOLVED: WHEREAS, at a regular meeting of the Board of Trustees of the of Cayuga Heights held on September 29, 1930, a resolution duly adopted authorizing the borrowing from the Ithaca Savings ank of the sum of $25,000, or so much thereof as might be needed or the construction of a sewer system in the Village of Cayuga ; and WHEREAS, pursuant to said resolution the sum -of $25,000 was heretofore borrowed from said Savings Bank on a certificate of in- btedness dated October 4, 1930; and 217• 0 218 WHEREAS, the aforesaid certificate of indebtedness was drawn a term of one year, which term expired on October 4, 1931;and WHEREAS, said certificate has been renewed and extended from to time, the last extension being to October 4, 1936, in the of $17,500; and WHEREAS, it now appears that it is to thq best interests of Village of Cayuga Heights to renew said certificate in the sum $13,000 from October 4, 1936, to October 4, 1937; NOW THEREFORE, IT RESOLVED, that the certificate of indebtedness in the sum of ,000 hereinbefore described be renewed and extended from October 1936, to October 4, 1937, in the principal sum of $13,000, and iat the Mayor execute for and on behalf of said Village, and in is name, the necessary instrument of renewal or extension of said of indebtedness in the sum of $13,000, and that the illage Clerk attest such instrument and affix thereto the corpora of the Village. 18. IT WAS RESOLVED: WHEREAS, at a regular meeting of the Board of Trustees of the Village of Cayuga Heights held on September 29, 1930, a resolution was duly adopted authorizing the borrowing from the Ithaca Savings Bank of the sum of $25,000, or so much thereof as might be needed for the const %ruction of a sewer system in the Village of Cayuga Heights; and WHEREAS, pursuant to said resolution the sum of $25,000 was theretofore borrowed from said Savings Bank on'a certificate of lindebtedness dated October 4, 1939; and t 1 r 1 WHEREAS, the aforesaid certificate of indebtedness was drawn for a term of one year, which term expired on October 4, 1931; and WHEREAS,'said certificate has been renewed and extended from time to time, the last extension being to October 4, 1937, in the of $13,000; and WHEREAS, it now appears that it is to the best interests of the Village of Cayuga Heights to renew said certificate in the sum f $6,400 from October 4, 1937, to October 4, 1938, with interest t the rate of four percentum per annum; NOW THEREFORE, BE IT RESOLVED, that the certificate of indebtedness in the sum of 25,000 hereinbefore described be renewed and extended from October , 1937, to October 4, 1938, in the principal sum of $6,400, with at the rate of four percentum per annum and that the Mayor to for and on_ behalf of said Village, and in its name, the sary instrument of renewal or extension of said certificate of ebtedness in the sum of $6,400 with interest at four -percentum annum and that the Village Clerk attest such instrument and ix thereto the corporate seal of the Village. 19. The following resolution was taken regarding the Street Improvements Certificate: WHEREAS, at a regular meeting of the Board of Trustees of the Village of Cayuga-Heights held'on September 28, 1931, a re- solution was duly adopted authorizing the borrowing from the Ithaca Savings Bank of the sum of $15,000, or so much thereof as might be needed, to cover the,expense of certain improvements on Upland Road, one of the streets in said Village; and 21 I 220 - -- IIWHEREAS, pursuant to such resolution the sum of $15,000 was heretofore borrowed from the Ithaca Savings Bank on a certificate ' of indebtedness dated October 15, 1931; and WHEREAS, said certificate of indebtedness was drawn for the jerm of one year, which term expired on October 15, 1932; and WHEREAS, said certificate has-been renewed and extended in the full amount of $15,000 from time to time until April 1, 1935; :,. WHEREAS, it now appears that it is to the best interests of said Village of Cayuga Heights to renew and extend said certifi in the full amount thereof to October 15, 1942, with interest at the rate of five percentum per annum to October 15, 1937, and interest at the rate of four percentum per annum from October 15,' 1937, to October 15, 1942, interest payable semi - annually on April 15th and October 15th, NOW THEREFORE, BE IT RESOVED, that the certificate of indebtedness in the sum of $15,000 hereinbefore described be renewed for the period from April 1, 1935, to October 15, 1942, in the sum of $15,000 with interest at the rate of five percentum per annum to October 15, 1937, and interest at the rate of four percentum per annum from October 15, 1937, to October 15, 1942, payable semi - annually on 15th and October 15th; and that the Mayor execute for and on behalf of the said Village, and in its name the necessary in Istrument of renewal or extension of said certificate�of indebted- ness and that the Village Clerk attest such instrument and affix thereto the corporate seal of the Village. 1 _J . ,. 22f 20. MINUTES of a special meeting of the Board of Trustees of,the, Village of.Cayuga Heights held at the Schoolhouse at 6 :00 P.M: on Nov. 16, 1937. _ ' 1., On this-date. the Board of Trustees sat.for four.hours,` from 6 :00 to 10 :00 P.M..as a Board.-of Assessors to hear grievances and complaints with -regard.to the assessment'roll.as prepared by them for the year 1938, and as filed with the Village Clerk on Nov. 8, 1937. .2.. Complaint was received from the following: Mrs. Harriet M. Libby, 206 Overlook Road, 'regarding assess- ment on her property consisting of three residences on.lot'# 302, Bounded N- DeVane, Sanderson and Hanshaw Road: . E Overlook Road & Kline Road and Kennard W- Wanzer, Crandall, Smart;:Pratt, Kennard. Th+laimant appeared in person to object to the amount of •.- assessment.on her property, stating that she had been _recently.. offered only'05,000 for the 103. Hanshaw Road property that most_of . ' her land did not have suitable frontage; that'the topography.,of the . i 222:, 4 . N lot was not good, and that no utilities had been constructed on Hanshaw Road. 024,500. She stated that she-thought the assessment should be ACTION: After discussion IT -WAS VOTED that the assessment remain as previously established; value of land $5,000, total assessment $28,000. 3. IT WAS- VOTED.,to adopt the following.resolution: .- . WHEREAS The. Village Board.of.Cayuga Heights, aeting:as Assessors of the said Village according to a resolution,previously adopted, have prepared an asseesment.roll for 1938-and-filed it.in duplicate with the Clerk of the. Vi- llage- prior .to Nov. 1, 1937 -and = WHEREAS the Clerk caused a.notice.to`,be` published in the official newspaper of the Village,and posted in five con spicuous`places.in the Village before November 8,.1937 a notice that the 1938 assessment roll was filed at his residence, 102 Northway Road, Cayuga Heights; Nevi York, where it might be -seen until November 16,- 1937.and WHEREAS on the said 16th day of November a grievance day was held and the said Board met from 6 :00 P.M. until 10:00 P.M. on the said day, one person appearing and no change being made as disclosed in the.minutes of the said Board Meeting, -now therefore -be it RESOLVED that:the said assessment roll as now prepared and verified with the assessor's oath.be now completed,.verified, and ordered filed with the Clerk, in the total amount of $2,817,730 of which $101,350 is exempt from taxation. 4.
