Beal, in which she'requested that a street light be installed on Kelvin Place. It was moved and carried that Engineer Crandall endeavor to make an arrange- ment with the City whereby the expense of installing such a light would be •split between the Village and the City, inasmuch•as the installation of the light would be approximately on the city line and would benefit residents of both the Village and the City... 4 I I I 5. It was moved.and,carried that Mrs. Bealls request for 199' re-imbursement for the construction of a sidewalk in front of her house be denied, as it is contrary to Village. policy-! to pay for the reconstruction of such walks. The Clerk was. instructed.to notify. Mira. Beal of the above. actions and the reason for declining to p assume the expense for the sidewalk., 6. Mayor Baxter read a.letter from.Mr. William C. Geerl. In Which he suggested the widening of.the-road at the .in.ter6ection,.of Highland Road and Cayuga Park Drive to facilitate the turning of Oara-:, into Cayuga Park Drive. H6 further offered to.deed a''portion , of. 41, land to the Village in.-orde'r to permit the widening.". The -,matter was referred.to Engineer Crandall to investigate.and report, to the Board•at its next meeting. 7. Engineer Crandall reported on the completion of the sidewalks and the toolhouse, the building of guard rails and painting of stop signs, the construction of culverts, and other work done during the summer. , 9. Engineer Crandall reported on the reduction in fire insurance rates that had been secured from the fire underwriters, such reductica being secured principally because of the construction of the water . storage tank and the new arrangement with the City fo,r'.fire protection, The letter from Lawrence Daw, v Y Neti er rGana of the Manager Fire Insurance Rating Organization notifying 7ur. Crandall of the reduction in fire i to 202 insurance rates was ordered filed. It was estimated that the total saving to the residents of Cayuga Heights will be approximately $2,000. Trustee Peer expressed his appreciation to Engineer Crandall for his work in connection with obtaining a lower fire insurance rate. 10. Following Mr. Crandall's suggestion, it was moved and carried that the Mayor appoint a committee to investigate the issuance' of new bonds to refund the overdue - -sewer certificates and street certificates. 15ayor Baxter appointed Trustee Peer and Engineer Crandall on this committee.. 11. Engineer Crandall also reported on the request of the Chief of the Fire Department with regard to informing each resident of the Village of Cayuga Heights of his fire box number, in accordance with a map giving such numbers now on file with the Village Clerk. It was moved and carried that notices be sent out to all taxpayers in, the Village of Cayuga Heights informing them of their fire box numbers. It was agreed that the ?Mayor and Clerk should prepare the letter and have it sent out. 12. Mr. Crandall reported on the lack of visibility on the corner of Oak Hill Road and Triphammer Road, and suggested the appointment of a coianittee to confer with Prof. E. L. Palmer, who lives on this corner, with regard to securing the removal of shrubbery. Mayor Baxter appointed Trustees Scofield and Dale to act as a committee of two to co -gfer with Prof. Palmer and the committee was requested to report back to the Board at the next meeting. 13. The Clerk reported the receipt of the affidavit from the Ithaca Journal regarding the publishing of'the legal notice in connection with �l the loan of §x4600 obtained for improvements, The Clerk also reported that the safe had been o . . opened and read a'list of. documents found within. Inasmuch as the lock was broken in o th ' pening e safe, Mayor. 1 203 Baxter offered to look up the prices of filing cabinets with a view to keeping the village records in a filing ca''inet rather than in a safe. 14. The Clerk was authorized to purchase a copy of McKinney's Consolidated Village Law. 15. A resolution was passed authorizing.Mayor Baxter to sign a similar contract with Charles 'Mosher for garbage removal as that in effect for the past year ending October 1, 1937. 16. The matter of establishing a sinking fund for the protec- tion of the Village on account of its liability to injured firemen was discussed, and it was decided that for the time being an insurance policy should be taken out with the McKinney Agency to cover the liability of the Village for the coming year, at a cost of $101.25. The Clerk was requested to notify the Chief of the Ithaca Fire Department of,_this action. 17. Trustee Peer reported on the request of the.Chief.o£ the Ithaca Fire Department that the Village have an'ordinance. enacted which would provide for the - posting- of.notices on houses recently fumigated,•the purpose being to prevent injury or death to firemen entering a fumigated house without due warning. After discussion IT WAS RESOLVED THAT; No person shall use'eyanide of potassium or other poisonous gas injurious to human life for fumigating purposes within the Village of Cayuga Heights, except such person shall have first obtained the written consent so to do from the Chief of the Fire Department of the City of Ithaca, and shall also notify all occupants of the building and post a sign of suitable size in•a conspicuous place upon the building fumigated warning of the use of the gas, and shall remain near the building so fumigated until the premises have been rendered safe for occupancy. Violation of this ordinance shall con conduct. stitute disorderly The Clerk was instructed to take the necessary legal. steps to have the ordinance become effective. In 204 18. Trustee Kenerson made a report as Chairman of the Committee on Bus Transportation: He stated that after conferences,with the officers of the Bus Company he was told that they did not feel. justified in inaugurating bus service on the Heights unless an arrange - \Ca ment could be made with'the School Board to.transport the scii0ol 1l children. 3,r. Kenerson reported.that he had talked with several \' members.of the School Board regarding such a proposal,. but as yet the School Board had taken no action.. He stated that he would follow up', further his contacts with the School Board with regard to the matter. 19. Mayor Baxter reported -that he had received several complaints from residents of the Village because of.the use of fire crackers and other explosives during the week of July, 4th. -After discussion Trustee Peer was appointed to draft an ordinance prohibiting the use of such, fireworks within the Village limits. 20. The following.additional.bili.was appr.oved.for,payment: - Onion Free School - District No. 6 school tax 1.82 4. Mayor Baxter..reported.that a.contract had.been signed with Charles Mosher for the collection of.garbage.in the Village.for the, year ending Sept.. 30, 1938 at the same rate -as last year, namely $1800. 5.• Mayor .Baxter read the proposed letter to- be..sent.out.to all residents of the Village with regard to the fire..box..numbers and the correct procedure for calling the,Fire Department., This letter was approved and ordered sent out to all property owners in the Village. - 20' 06 6. After discussion with.regard to.a. new Village safe, it was decided to communicate with the State Department.to determine whether or not they had any rulings as to the.type of-safes required.for..villages. 7. The Mayor requested the Clerk to prepare.copies.of the ordinances so that each Board. member might.; have..a.set..for..- his, own. use. S. Mayor Baxter read.a.letter from Zoning..Officer Crandall with regard to the Johannsen.property on.the Parkway. Prof..Johannsen has altered his house - without. proper building::permits. and it is rumored that it has been converted into a four- family- house,.which:.is.in violation of the zoning ordinance. Mr..Crandall..had_ received several.oral.but.no written complaints. It was moved and carried..that.Mr. Crand &ll should ascertain the .facts in regard .to.the above.matter.and. report to the Board at the next meeting. 9. Mr. Crandall, reporting. for .the. committee on the, refunding of overdue certificates - of ..indebtedness_.reported...that Attorney.Tracy Stagg had been requested .to look..up the - .matter. Mr. Stagg was.present and discussed the legal—situation in.some detail . and:made -a preliminary report in writing.to the Mayor.. The-.Committee was.instructed by the Board 'to continue its efforts to refinance the Village indebtedness. 10. Treasurer Guise.made a :brief..financial report regarding the financial condition of -the Village. 11. The bill of $101.25 from.the.McKinney Agency was ordered charged to "Fire Service" instead.of "Contingency". 12. Upon motion -duly made it was voted to -pay off $250 on the $4600 Improvements Certificate of- Indebtedness at thi.s.time,..in order to conform with the -law which states that. -.at least 5% of .the.amount.of a certificate of indebtedness must be budgeted f or:.redemption:.the.first.year. It was decided that the $250 should be charged'to the. "Contingency Fund "., 13. Engineer Crandall reported.on..:the..proposed light on Kelvin Place, stating that he had taken the matter up with the City officials H 1 t 207 with the result that he thought the City would install a light at their own expense, and he recommended therefore that the matter be tabled until the City had taken action. 14. Engineer Crandall reported regarding Mr.-Gear's-request for eliminating .the . sharp corner. . existing ..at.Cayuga. Park. Circle. and Highland.Road. The engineer... estimated .that:the.expense.would be about $100._and..due..to .the .small.amount. of .traffic at this point he doubted whether the expense would be justified, although.it was agreed .that:.it. was a•good..impr.ovement and perhaps should be done. later if.traffic became - heavy. The Clerk was requested to- notify Mr. Geer of.the- .decision of. the .Board. - :15. Engineer. Crandall: reported ..that.a.recent:periodical inspec- tion of parked cars at.5:00 A.M. revealed,seven.on. the streets in violation -of the Parking and- .Traffic Ordinance. Most -.of the.cars were on Wyckoff Avenue and apparently belonged. to. students. .Mr. Crandall was requested to...turn.over•the names_of.the. owners. of. the cars to Mayor Baxter who: <agreed to take the.matter up.before the proper University,.. Committee,, 16. The Clerk reported that notices of the Public Hearing. on: the Fumigation Ordinance:.had been posted in four conspicuous.places in the Village in accordance with the.law. . 17. Trustee Dale reported for the.committee appointed.to see Prof. E. L. Palmer.in regard to the.removal of shrubbery at the corner of.Oak Hill Road and,Triphammer Road.:;Trustee.Dale mid that the matter had been.discussed.with Prof.. Palmer who had.stated his willingness to.conform._with the ..Village.Ordinance,-but as. he. had not yet done ,so the, committee_.was requested.to follow, up the matter further. 18..Trustee.Kenerson stated.that.he. had nothing further to report in connection with the Bus Transportatioii matter. C \ll 19. A letter from Trustee Peer was read with regard to the proposed Fireworks Ordinanoe and after discussion it was "RESOLVED: That on or after Dec. 1, 1937 no person shall sell or expose for sale, or discharge or cause to be discharged within the Village of Cayuga Heights any fireworks, fire crackers, cap pistols, blank cartridge pistols, torpedoes, canes, or other appliances commonly used to celebrate.4th of July. Violation of this ordinance.shall.be deemed.disorderly conduct." The Clerk was instructed to take the necessary legal steps to make this ordinance.effective.. 20. Inasmuch as there were.no appearances at.the Public. Hearing on the Fumigation.Ordinance, it.was moved and carried that the following ordinance be adopted: . "RESOLVED: That .on -or after Nov. 10,. 1937 no person shall use cyanide•of potassium or other.poisonous gas injurious - -to human life for fumigating purposes.within the Village:of Cayuga Heights, except that such person shall have.first obtained the written consent_ so to do from the Chief of the Fire Department of the.City of Ithaca, and shall.also notify all occupants of the.building and post a sign -of suitable size in a conspicuous place upon the building.fumigated, warning of the use of the gas, and such person shall remain near the building so fumigated until the premises have been rendered safe for occupancy. Violation of this ordinance shall constitute disorderly•conduat.11 21. The Trustees sitting as assessors for the Village considered and adopted a new assessment roll for the taxable property in the Village for the coming year. 22. The next meeting of the Board was..set for Nov. 16th at 8 o'clock. Grievance Day was set for Nov. 16th between the hours of 6;00 and 10 :00 P.M. 23. Adjourned at 12 :30 A.M. Clerk
