Public Hearing on the Budget
Professor A. Be Recknagel appeared to urge that the
Village Board seriously consider the repairing of
sidewalks in the corporate limits of the Village. No '
one other than Professor Reoknagel appearing for the
consideration of the budget, g , the public hearing was declared `

1. The minutes of the meeting on April 5, 1936
were read and duly approved.
2. The following bills paid on the authority of the

3. The following bills.were ordered paid:

4. The Clerk brought to,the.attention of the Village Board
the fact that some of Mrs. Beale!s.property on Kelvin Place
' was sold to Roy E. Halverson. Readjustment of the assessment
was postponed until the preparation of the neat assessment roll.
5. The Clerk brought to the attention of the Village Board
a letter from David S. Galton, Esq., dated March 31, 1936
relating to the correct ownership of 126 Westbourne Lane,
126 Westbourne Lane Realty Corporation, and not Beta Sigma
Rho to whom it is-now assessed.
IT WAS VOTED pursuant to section 109 -a of the Village

Law to' correct the assessment of lots 1 and 2 now assessed
to Beta Sigma Rho so as to read 11126 Westbourne Lane Realty
Corporation ".
6. IT WAS VOTED to correct the minutes of the meeting
on November 19, 1935 so.as to delete from the Highway account,
' item 2, therein set forth as a.charge to the New York State

H.
Electric and Gas Corporation to October 31, 1938 $82.00, and to
show that this charge should properly be to the Light account.
7. The Board then considered the budget of the Village for
the bnsuing year.
IT WAS RESOLVED that the budget.recommended by the.Board,
acting as a committee of the whole at the meeting held on March 2,
1936,be adopted and the rate of tax assessment established for the
year at six mills ($.006).
8. The budget for the year March 1, 1936 to March 1, 1937
as previously adopted is attached hereunto these minutes.
9. IT WAS .VOTED that the Village bond Cedric H. Guise as '
Treasurer and Collector of the Village of Cayuga Heights in
the amount of $15,000, and that a bond in the National Surety
Company be approved.
10. The auditor,'T. B. Truesdale,.heretofore appointed by
the Village Board, presented an audit of the books of .Cedric H.
Guise, Treasurer and Collector of the Village.

11. The Engineer read a letter to him from Mr. Whiton
Powell, Secretary - Treasurer of Beta chapter of Kappa Delta Rho of
Cornell, Inc., dated April 17, 1936, as follows:

Gentlemen:
This is to acknowledge your offer, transmitted in Mr.
Crandall's letter of March 17, 1936. We are glad to accept
your offer to transfer the Oak Hill Road property at a net
price to the village of $100.
We have arranged with Mr. Adams of Newman and Newman to
prepare the deeds and to bring up to date the abstract of
title. Mr. Adams requests that the village turn-over to
him the deed and abstract of title now in.its possession
to facilitate preparation of the papers. It will be greatly
appreciated if the Village Board will instruct the appropriate
village officer to get these documents to Newman and Newman.
Although there seems to us no reason why the action
' requested above should require it, upon request we will
place in the hands of Newman and Newman our certified check,
drawn to the order of the village for $100; to be held as
evidence of our good faith pending completion of the trans-
action and the signature of the deeds.
I trust that it may be possible to complete the matter
in the near future..

March 17, 1936, as follows:

Dear Professor Powell!
The matter of the proposed deed of the Oak Hill Road triangle

from the Village of Cayuga Heights to the Kappa Delta Rho
fraternity was referred to me at the last meeting of the
Village Board.
As you will see from attached copy of letter to Mr. J. T.
Newman under date of March 16, there is a restriction in the
deed of this triangle to the Village. to reply to my letter
of March 16, Mr. Newman telephoned me that he was perfectly
willing to cancel this restriction in case of a transfer
to the fraternity.
The Village Board has agreed to transfer the property at
a net price of $100. This means that you would have to take
care of the expense of the deed and any title search that you
cared to secure. As this parcel will be a part of a larger
tract on which a house will probably be erected and
mortgaged, it would seem that you should have an abstract
of title. The triangle is a part of the White Park section
developed by Mr. Newman, and he probably has a general
printed abstract of title covering the matter up to a
comparatively recent date.
If you care to go ahead with this matter, i would
recommend that you employ the law firm of Newman and Newman
to prepare two deeds and the abstract of title. One deed
would be from the Village to the fraternity, requiring
execution by the Village mayor and attestation by the Village
Clerk. The other deed would be from Jared T. Newman and wife
to the fraternity, cancelling the restriction.
The Village election is being held today, and Professor
H. E. Baxter will be elected as Mayor. He is already familiar
with this matter, having served as a member of the Board of
'trustees. The Village Clerk for the coming year has not yet
been appointed.
If there are any further questions in connection with the
proposed transfer, please let me know.

The following resolution was adopted:
WHEREAS at the meeting of the Village Board
held on January 6, 1936 (minutes, item 8) the Board
considered the.desire of the Kappa Delta Rho '
fraternity to purchase a small piece of land at the
corner of the Parkway and Oak Hill Road, and

WHEREAS
the Village has been offered the
sum of-8100
from-the
said fraternity, the
fraternity to
pay for
the preparation and
recording of
the deed
and the preparation of
the abstract
of title
involved, and
WHEREAS the Village Hoard hereby accepts
the said offer of the said Kappa Delta Rho
fraternity,
NOW THEREFORE be it resolved that the Mayor
and Clerk of the Village be authorized and
directed to execute a deed to Beta chapter of
Kappa Delta Rho of Cornell, Inc. for the
triangular piece of land, the description to
be ascertained from Liber of Deeds at
page
IT WAS VOTED that any release or restrictions on the use
of this property should be obtained by the fraternity
directly from Jared T. Newman or other proper parties.
12. IT WAS VOTED to change item 5 of the minutes of
' April 5, 1936 to read as follows:
IT WAS VOTED that the regular meeting date of the Village
be set as the first Thursday.of.the month at 7:30 P. M.
13. John W. MacDonald was appointed Clerk of the Village.
14. The Treasurer presented the Village financial
statement which was read and ordered filed.
15. The Engineer reported with regard to his activities:
a) There were two leaky valves in the water system at
Cayuga Heights Road and Wyckoff Road, and Cayuga Heights Road
and Devon Road. The Water Department of the City of Ithaca
put in a manhole, and repaired at the cost of $60 each.
This charge was taken care of by-the city, and there will.be
Ino charge against the Village.
b) No sewer leaks could be discovered, and no further

trouble is anticipated, but a further investigation will be
made during the summer and fall.
o) Patching on the streets has been begun. Resurfacing will
be done during June, the contractor to put in his bill in July.
