3. IT WAS VOTED to direct the payment of the bill of the Oity.of Ithaca
for sewer charges in the sum of $2551.42.•.
4. The Engineer reported with regard to an application to the Works
Progress Administration for a project of $30 '.000. for sidewalks con-
struotion, flood damage, etc. The Village to contribute the sum of
' $3;900. and the project to be of a duration of a year.,:He.also reported
with regard to repairs of flood damages. He reported that it was
necessary to discharge William Barnes as foreman of the Village and that
he put on Frank Haskins as foreman.
5... IT WAS VOTED to instruct the Clerk to report to Professor Matheson
that the Village can not be responsible for the damage done to the ee
CTM walls during the course of the recent flood because the Board of
Trustees does not.consider that sueh.repairing would be a litigimate use
of tax money to build such a creek on private property.
6. IT WAS VOTED to adopt the following resolutions
WHEREAS: At a regular meeting of the Board.._of Trustees of the Village
of Cayuga Heights held on September 25, 1931, a resolution authorizing
the borrowing from the Ithaca Savings Bank the sum of $15;000 or so
much thereof as might be needed to cover the expenses of certain im=

provements to Upland Road, one of the streets in said Village, was
duly adopted, and
WHEREAS:' pursuant to such resolution the sum of $15000. was
heretofore borrowed from the Ithaoa Savings Bank on a'Oertificate of
Indebtedness dated October 15, 1931, and
WHEREAS; Said Certificate of Indebtedness was drawn for the term of
one year, which term expired on October 15; 1932; and the said Oertificate
of Indebtedness was thereupon renewed by a resolution of the Board of
Trustees for a term of one year from October 15, 1932. The said resolution
was duly adopted at a meeting of the Board of Trustees of the Village of
Oayuga'Heights held_on October 17, 1932•
WHEREAS: the said Certificate of Indebtedness was thereupon renewed
by a resolution of the Board of Trustees at a meeting held-on December
100 1934 until"April 1, 1935• '
WHEREAS: The term of the said extension of the aforesaid Certifi -%
oats of Indebtedness has now expired.
WHEREAS: It now appears to be to the best interest of the said Village
of Cayuga Heights to renew the said Certificate in the full amount thereof
- until October 1, 1936; NOW THEREFORE, be it
RESOLVED that the Oertifioate of Indebtedness in the sum of $159000.
hereinbefore described be renewed so as to fall due on October 1; 1936;
and that the Mayor execute, for and on behalf of said Village and in its
name the necessary instrument of renewal or extension of said Certa.fioate
of Indebtedness and that the Village Clerk attest such instrument and
affix thereto the corporate seal of the Village.
7. IT WAScVOTED to adopt the following resolution:
- WHEREAS: At a regular meeting of the Board of Trustees of the
Village of Cayuga Heights held on September 29, 1930, a resolution

authorizing the issuance of bonds or other obligations of the Pillage
to the amount of $20i'000.for the purpose of meeting the Village's share
of the cost of constructing a sewer system in said Village_.was duly
adopted, and
WHEREAS : At the same meeting as aforesaid, a resolution authorizing
the borrowing from the Ithaca Savings Bank the sum of $25,000, or so much
thereof as might be needed for the construction of a sewer system in said
Village was duly adopted, and_
WHEREAS: Pursuant to such resolutions the sum of .25 -.000. was hereto-
fore borrowed from the Ithaca Savings Bank on a Certificate of Indebted-
ness dated October 4, 1930. -
WHEREAS: By resolution of the Board of Trustees of the Village of
Cayuga Heights duly adopted at a meeting held on October 26, 1931; the
aforesaid Certificate of Indebtedness was extended for a term of one
year from October 4, 1931; and by resolution of the Board of Trustees
of the Village of Cayuga Heights duly adopted at a meeting held on
October 7th, 1932, the aforesaid Certificate of Indebtedness was ex-�

tended for a term of:one year from October 4, 19329 and
WHEREAS: At a meeting of the Village Board held on December 10,
1934, the Certificate of Indebtedness was extended in the sum,of.
- $22,500 until April 1, 1935
WHEREAS: The term of said extensions of the.aforesaid Certificate
of Indebtedness has now expired.
WHEREAS: It now appears to the best interest of the said Village of
Cayuga Heights to renew the said Certificate,of Indebtedness until
- October 19 1936, and
WHEREAS on February 5,'1935, the sum of $2,500, was paid on this
Certificate of Indebtedness, and on June 21, 1935f the sum of $2,500.

was paid on this Oertificate of Indebtedness leaving a balance due of
0172500, NOW THEREFORE, be it
RESOLVED . That the Certificate of Indebtedness in the sum of
$25;000. hereinbefore described be renewed'for a period so as to
fall due on October 1, 1936, in the sum of $17'9500, and that the Mayor
execute for and on behalf of said Village of Cayuga Heights and in its
name the neoessary instrument of renewal or extension of said Certifi-
oate of Indebtedness, and that the Village`Clerk attest such instrument
and affix thereto the corporate seal of the Village.
8, IT WAS VOTED to correct the minutes of the meeting of September 10,
1934, so as to add an.item 10-4 as follows.
IT WAS VOTED to approve the making of a contract with Charles
Mbsher for the removal and disposal of garbage from the Village be-
ginning on October 1, 1934, and extending to OctoAx 1,1935, for the
sum of 01600., the said contract being in the following words.
"This agreement dated October 1; 1934, between the Village of
Oayuga.Heights a municipal corporation of the State of New Yorki
party of'the first part, and Oharles Mosher of "the Town of
Ithaca, party of the second part, witnessetA:
I.
For the consideration hereinafter expressed, the said party of the
second part assumes and agrees with the party of the first part as
follows.
1. To collect at least once during each and every week until.Octo-
ber 1, 1935 all garbage, ashes, and all other rubbish from all!,
properties located within the incorporated limits of ;the said
Village, when said garbage ashes and rubbish has been set out at
a convenient• point, accessible to the truck of the party.of the
second part.
2. To remove and haul away from within the incorporated limits of
the said Village all garbage, ashes, and rubbish, so collected and
to dispose of such garbage, ashes and rubbish at a point outBide
the incorporated limits of the said Villagd.
3. To assume all responsibility for the disposal,of.,the said gar-
bage, ashes and other rubbish, after it is so collected, to take
ownership and title to the said garbage,, ashes, and other rubbish '
after collection, and to dispose of it in any manner the party of
the second part sees fit, without restriction by the said party of

the first part, except that the party of the second part agrees to
respect the legal rights of all other persons, and to obey the law of
the State of New York is so disposing of the garbage.
4. To hire and pay all employees necessary for such collection's
removal and disposition, to supply all automobile trucks, and other
materials, to control the method, means or procedure of accomplishing
the work.
5. To save harmless the said Village from all.suits, claims, and
manner of them, in law, in equity, and under any and all statutes
of the State of New York; with regard to the said collection; removal
and disposition of garbage ashes and rubbish, and to assume 611 risks
with respect to aootdents Involving trucks materials or workmen.
6. To follow exactly the schedule of collection now in force in the
said Village, any changes in the schedule to be made after an'oppor9
tunity of reasonable notice to the residents of the Village subject to
the approval of the Village Engineer of the said Village.
II.
For and in consideration of the promises made hereinbefore by the party
of the second part and as a consideration for them, the party of the
first part agrees to pay to the said Charles Mosher the aum of One
Thousand Eight Hundred Dollars, payable in twelve monthly installments
of One Hundred Fifty Dollars each."
and IT WAS VOTED to direct the Mayor to sign the said contract on behalf
of the Village of Cayuga Heights, New York.
g. IT WAS VOTED to approve the making-of a contract with Charles Mosher
for the removal and disposal of garbage from the Village of Cayuga Heights
from October 1, 1935 to October 19 1936 for the.sum of $1900., the said
contract being in the following words: �-
"This agreement dated October 1, 1935, between the Village of Cayuga
Heights, a municipal corporation of the State of New York, party of the.
first part, and Charles Mosher, of the Toga of Ithaca, party,of the second

For the consideration hereinafter expressed, the said party of the second .
part assumes and agrees with the party of the first part as follows:
1. T, collect at least once during each and every week until October 1,
193 all garbage, ashes and all other rubbish from all properties located
within the incorporated limits of the said Village, when said garbage
ashes and rubbish has been set out at a convenient point, accessible to
the truck of the party of the second part;
2. To remove and haul away from within the incorporated limits of the
said Village all garbage, ashes, and rubbish, so collected, and to dis•
pose of "such garbage, ashes, and rubbish, so collected, aitdatpoint out-:
side the incorporated limits of the said Village.
3. To assume all responsibility for the disposal of the said garbagei
ashes and other rubbish, after it is'so dolleoted, to take ownership
and title to the said garbagei ashes, and other rubbish after collec-
tion, and to dispose of it in any manner the party of.the second part
sees fit; without restriction by the said party of the first part, ex-
cept that the party of the second part agrees to respect the legal rights

of all other persons, and to obey the law of the State'of New York in so
disposing of the garbage.
4. To hire and pay all employees necessary for such collection, removal
and disposition, to supply all automobile trucks, and other materials, to

5. To save harmless the said Village from all suits, claims, and manner
of them -in law,'in equity and under any and all statutes of the State of
New Yori, with regard to tie said colleotion removal and disposition of
garbage,,ashes and rubbish, and to assume ali riaXe with respect to
accidents involving trucks, materials or wdrkgten,:.
6. To follow exactly the dohedule of collection now in force in the said
Village any changes in the schedule to be made after an opportunity of
reasonahe notice to the residents of the Village subject to the approval
of the Village Engineer of the said Village.
II.
For and in consideration of the promises made hereinbefore by the
party of the second part, and as a consideration for them, the party of the
first part agrees to pay to the said Charles Mosher the sum of Nighteen
`red Dollars; payable in twelve monthly installments of 0150.00- each."
and IT WAS VOTED to direct the Mayor to sign the said contract on behalf
of the Village of Cayuga Heights.
10. The term of the Health Officer of the Village expiring on September
26 19351 IT WAS VOTED to elect DH. H. CrUm. Health Officelof the
Vii1age for the statutory term.,(
11. IT WAS VOTED to approve the following bill submitted for payment:
