PRESENT:
Regular Meeting of the Board of
Trustees of the Village of
Cayuga Heights held at 8
P.M. in the Village
School House on
Jan. 15, 1934.

1. The minutes of the last previous meeting were read and
the following changes were made:
(a) Item number 6 was corrected to read as follows:
It was duly moved and carried that this Board
of Trustees recommend to next year's Board of
Trustees that provision be made in next , year's
budget for the cost of an audit for that year.
(b) Item number 5 was corrected to read as follows:
An audit of the accounts of the Treasurer of
the Village from March 1, 1932 to October 31,
1933 was received; and a report of the accounts
of the Clerk of the Village acting as Collector
from March 1, 1932 to October 31, 1933 was re-
ceived; and both were ordered returned to Auditor
Trousdale to bring down to date after the con-
solidation of the two accounts. ( As provided
by item 7).
(c) Item number 9 was corrected to read as follows:
It was also duly moved and carried that interest at
the rate of 6 percent shall be charged on all de-
linduent charges except taxes, which will carry the'
legal rate, after January 15th, 1934.
2. The following letter of L.IJ. Simmons; Clerk of the Village
was read and the resignation was accepted.

Dear Professor Maynard:
Owing to the fact that it has become necessary
for me owing to personal reasons, to lighten some of the
load which I have been carrying, I hereby request that
the Trustees of the Village of Cayuga Heights accept
my resignation as Cleric of the Village, effective as of
January 15th, if possiUle.
I shall be very glad to do what I can to assist
whoever takes over the work as Clerk of the Village;
but I feel that I can no longer give the work the
necessary time required.

3. It was duly moved and carried that John IV. MacDonald Esq.,
be apoointed as Clerk of the Village at a salary of $50.00
to hold office for the remainder of the term of L.N. Simmons
Esq.
4. The Mayor reported that in accordance with item number 7
of the minutes of December 18, 1933, he relieved L.N. Simmons
of his duties as Collector on December 30, 19339 that he order-
ed all funds in the hands of the Clerk turned over to the
Treasurer and that he instructed ids. James B. Trousdale, the
auditor, to supervise tine transfer. It was duly moved and
carried that this transaction was approved.
5. An audit by Mr. James B. Trousdale from March 1, 1932
through January 9, 1934 was presented, showing that all moneys
collected by the Clerk acting as Collector are accouhted for;
that such funds have peen turned over to the Treasurer, that
the Treasurer's accounts for the same period are correct, and
that the two accounts have been consolidated.

6. It was duly moved and carried that the audit of the funds
of the Clerk acting as Collector and of the funds of the
Treasurer from March 11 1932 through January 9, 1934 be filed
with the Clerk as part of the minutes. uch audit is included
in these minutes at the end thereof)
7. It was also duly moved and carried that the Board re4uest
an audit of the accounts of the Clerk acting as Collector
for the time prior to March 1, 1932 to the time of the last
official audit.
8. It was duly moved and carried that Professor H.E. Baxter
be elected to serve out the unexpired term of Mr. E.H. wanzer
deceased, as Trustee of the Village.
9. Professor R.E. Baxter then entered the meetirL3 and was
oresen t thereafter.
10. It was duly moved and carried that the Clerk with the
auditor compute interest on all outstandirl3 indebtedness to
the Village to January 15, 1934. 1
11. Professor R.S. Stevens proposed the following resolution
and moved its adoption:
RESOLVED: That the Treasurer is directed to take
such proceedings as are necessary for the sale for
taxes on all properties on which taxes or --ther
charges prior to the oreernht fiscal year are due;
and the charges on those properties advertised for
sale shill irrl.ide the taxes and char.-as dua during
the oreson t fiscal yeer;all of which under the
orovisions of Sec. 126 -D of the Village Law as
added by L. 1930 Ch. 661, Sec. 4; L. 1932 Chap.
343; L. 1933 Chao. 174, Sec. G.
12. It was duly moved and carried to in3truot the Clerk to
take such proceedings as are necessary to gat the bond of
L.H. Simmons, Clerk acting as Collector, cancelled, and to
obtain whatever r:eCand is due the Tillage.
13. It was duly moved slid carried that the Village pay
2500.00 on the certificates of Indebtedness issued for the

Dear Mr. Idaynard;
I am viritinK to ask that y,)u a:; the orasiding
officer of Cayuga Heights please present to the proper
parties for considerstion the following situation
which I feel I am entitled to ask be improved.
Gs you may be aware the water from the east
end of White Park Road along the .northern boundary of
my property flows to the east to the junction of White
Park Road and Triphammer Road ani at present is divert
ed through a drain -pipe onto my property. It grad-
ually makes its way across my lot, crossing my drive
in two places and forming a considerable underwater
area which is not desirable. It would seem that this
water draining from the public highway should be in
some way taken to the storm sewer system and I hope
that the engineer in charge of this situation and
other pertinent parties will take the matter under
advisememt rind some action to bring about the de-
sired improvement.
I was advised by Mr. Crandall to call this
to the attention of the village authorities and am
doing so now when the situation may be obvious to
any casual observer.

It was duly moved and carried that this matter be
referred to next year's Board of Trustees.
15. The following bills paid on order of the Mayor were
approved:

16., The Mayor presented the folloving letter to the
Village Board:

17. Mr. A.D. Seymour proposed the following resolution and
moved its adoption:
IMEREAS, The Liayor. of the Village, Professor L.A.
Maynard has given to the Village his untiring
services during his term of office and has handled
the affairs of the Village with great efficiency .
and WHEREAS, he has on this date resigned due.to
his coming absence from this country, therefore
BE IT RESOLVED, that the Village Board convey to
` the Mayor its keen appreciation for his services

and accepts his resignation with great regret.'
16. The Treasurer presented a report which was tend and
ordered filed with the minutes. -(This report is.'attached
hereto following these minutes.)
19. It Was duly moiled and carried that the Tressarer make
a refund to Miss Mary Allen of.1131 South College.Avenue,
Tulsa,• Oklahoma, of $5.00 for taxes paid by her twice.'
