Engineer Crandall reported on the following items
1. Guard rail on Hanshaw Road..has been repaired.
2. Catch basins on The Parkway have been providdd
with
gratings. "
3. Trees in the,5treets of the Village are being trimmed.
4. The August mowing of grass-and weeds on vacant
lots
is nearly completed.
5. Road resurfacing on the Hanshaw and Wyckoff State
highways now under way,by1the'State Highway Department.
'
This will necessitate the -paising:•.of., sewer
manholes
on these streets.

7. The Engineer reported that pursuant to authority heretofore
given him, he had requested bids for the necessary water pipe to
complete the new auxiliary Water supply system to be constructed
for the Village in conjunction with the City of Ithaca and that
he had received bids from R: D. Wood & Co. of Philadelphia, the
United States Pipe and Foundry Company of Philadelphia and the
McWayne Cast Iron Pipe Company of Birmingham, Alabama. The McWayne
Cast Iron Company was low bidder with a bid of 69J cents per foot
for 8 inch pipe and 461 cents per foot for 6 inch pipe.
This bid was approved and authority granted to the Engineer
to issue the necessary order in the name of the Village for the
necessary pipe to complete the proposed project and the Mayor was
authorized to pay the bill for said pipe not to exceed $4,500.
J' 8. The Engineer also reported that he had secured bids from
James Sullivan and Wilson M. Barger for the laying of the pipe
of the auxiliary water system and that the bid of W:. M. Barger
of $.45 per foot was low. Upon the recommendation of the Engineer
it was
RESOLVED: That the contract for the digging of trenches
and for the laying of pipe for the auxiliary water supply system
be awarded to Wilson M. Barger in accordance with the terms of
his bid and authority was granted the Mayor to sign and execute '
the contract therefor on behalf of the Village and the Clerk of
said Village was authorized to attest said contract and to attach
i thereto the corporate seal of the Village.
C1 9. Upon recommendation of the Engineer the Mayor was authorized
to require a bond of said Wilson M. Barger for the specific
performance of his contract in the sum of $2,250. and was authorized .
to pay the cost of said bond amounting to $22.50.-
V1 10. The Water Committee heretofore appointed was given full
power to work out the details of an agreement with Mr. Jared T.
Newman relating to the extension of water mains beyond the Village
limits and the connection by private parties to said water mains
providing for a joint division for the fee to be charged for such
connection where said parties connect to water lines or mains
provided and laid by Mr. Newman. Said committee was also authorized _
to accept on behalf of the Village a deed from Mr. Newman of the
existing lines of the Village and authority was given the Mayor to
sign and execute any contracts, agreements or other instruments
approved and recommended by said Water Committee, and the Clerk was
authorized to attest such contracts, agreements or other instruments
and to attach thereto the corporate seal of the Village.

11. The'Clerk was instructed to send out the following letter
and memorandum of agreement to the persons listed, residing or
owning property outside the limits.of the Village and to :take such
steps as may be necessary.for the collection of the funds subscribed
by such.memoranda of: agreements.
12. The Mayor was authorized.to execute on behalf.of the.Village
a contract with Seymour Mosher for the removal of.garbage from the
Village.for the year 1932 =33 for a sum not to exceed $2,000.

4.. Engineer Crandall reported ..that.in the repair -of the culvert
on Renwick Drive, unanticipated work had been found, necessary, making,..,
the total cost of the job $1,010.11, and the Treasurer was_'authorized
to transfer from the Contingency Fund the:sum of '$510.11.to'cover. the' - ~
cost of this above the appropriation of $500..for this work.
5. The Engineer reported that the.resurfacing of Hanshaw.Road
and Wyckoff Road.had necessitated additional work on the part.of

the Village in raising manholes, fixing street intersections, etc.,
which would cost $625.00 and the Treasurer was authorized to
transfer the sum of $625.00 from the Contingency Fund to the
Highway Fund'in order to cover.this additional cdst. /
6. Engineer Crandall reported that the water.mains for the v/
new auxiliary water supply had all bee,riaid and the trenches
back - filled; that the new main had been sterilized and flushed'
and that the road to the standpipe had been graded and a.concrete
foundation for the standpipe in, and the plates.for building the
tank were being hauled to the job. /
7. The Clerk was requested to send a letter of appreciation ✓
to Prof. E. M. Chamot and to Mr. J* Bishop for the services.they
have rendered in connection with the auxiliary water supply.
WHEREAS : Pursuant to such resolutions the sum of
$25,000., was heretofore borrowed from the Ithaca Savings
Bank on a Certificate of Indebtedness dated October 4,
1930t.-and-the-sum of- $13;500. was borrowed-from-the-.said..
Ithaca Savings Bank on another Certificate of Indebtedness
dated October 41 1930, and
WHEREAS Both the aforenamed Certificates of
Indebtedness were drawn for the term of one year,.which
term expired on October 4, 1931, and
8: The Treasurer was authorized to.pay the sum of $7,500. on
such one or more of the Certificates.of Indebtedness of the
Village as he and the Clerk might determine advisable.
�9. The. Clerk reported that three of the Certificates of
Indebtedness of the Village held by the Ithaca Savings Bank had
expired and that renewals thereof should be secured. Upon motion
duly made and seconded, the following preamble and resolution was
duly adopted
WHEREAS : At a regular meeting of the Bbard,of
Trustees of the Village of Cayuga Heights held on
September 29, 1930, a resolution authorizing the
issuance of bonds or other obligations of the Village
to the amount of $20,000. for the purpose of meeting
the Villagers share of the cost of constructing a
sewer system in said Village was duly adopted, and
WHEREAS : At the same meeting as aforesaid, a
resolution authorizing the borrowing from the Ithaca
v }Savings Bank the sum of $25,000. or so much thereof.as
-� might be needed for the construction of a sewer system
in said Village was duly adopted, and
WHEREAS : Pursuant to such resolutions the sum of
$25,000., was heretofore borrowed from the Ithaca Savings
Bank on a Certificate of Indebtedness dated October 4,
1930t.-and-the-sum of- $13;500. was borrowed-from-the-.said..
Ithaca Savings Bank on another Certificate of Indebtedness
dated October 41 1930, and
WHEREAS Both the aforenamed Certificates of
Indebtedness were drawn for the term of one year,.which
term expired on October 4, 1931, and
WHEREAS : By resolution of the Board of Trustees
of the Village of Cayuga Heights duly adopte& at•a
meeting held on.October 26, 1931,'both of said,..
Certificates were extended for the term of'one year
from October 4, 1931' and
• WHEREAS : The term of said extension.of the.
aforenamed Certificates of Indebtedness has now
expired, and
WHEREAS': It now appears that it1s.to' the best
interests of'said Village of Cayuga Heights to renew
said Certificates for a part of their original amount
for a term of one year, NOW THEREFORE, be it
RESOLVED a That the Certificate of Indebtedness
in the sum of 125,000. hereinbefore described, be
renewed for a period of one year from the date of
October 4, 193.2, and that the Certificete for $13,500.
hereinbefore described, be renewed for the sum of
$6,000. for the period of one year from the date of
October 4, 193'2, and that the Mayor execute for and
on behalf of said Village, and in its name,the
,necessary instrument of renewal or extension of said
Certificate of Indebtedness, and that the Village
Clerk attest such instrument and affix thereto the
corporate seal of the Village.
Upon motion duly made and seconded the following
preamble and resolution was also duly adopted
WHEREAS : At a regular meeting of.the Board of
Trustees of the Village of Cayuga Heights held on
( « September 28th, 1931, a resolution authorizing the
borrowing from the Ithaca Savings Bank the sum of
$15,000. or so much thereof as might be needed to
cover the expenses of certain improvements to Upland
Road, one of the streets in said Village, was duly
adopted, and

WHEREAS : Pursuant to such resolution the sum
of $15,000. was heretofore borrowed from the Ithaca
Savings Bank on a Certificate of Indebtedness dated
October 15th, 1931, and
WHEREAS : Said Certificate of Indebtedness was.
drawn for the term of one year,.which.term expired on
jOctober 15th, 1935, and
WHEREAS : It now appears ihat.it is;to the best
,�'"/ interests of.said.Village of .Cayuga,Heights'to: renew,
said Certificate in the full, amount thereof for,•.the

3. The bill of Elizabeth M. Faber,.34J hrs. stenographic
s2rvices, $.50 an hour, totalling $17.25,was approved and ordered
paid.
4. The Treasurer was authorized to transfer the sum of $107.05
from the Contingency Fund to the Highway Fund in order to cover the '
additional cost of the work necessitated by the resurfacing of
Hanshaw Road and Wyckoff Road.
5. The Clerk presented an additional bill from P. W. Wood & Son
for the bond secured for the Clerk and this was referred-to the
Clerk with power.
6. A deed was presented conveying-: about one -half acre of land
on which the new standpipe being constructed by the City of Ithaca
is located , to the City of.Ithaca. This deed was approved and
the Mayor authorized to execute the same on behalf of the Village
and to attach thereto the Village Corporate Seal and deliver said
deed to the proper representative of the City of Ithaca..
7. The Engineer made a short report on the completion of the
work on the State highways running through the Village.
8. Upon motion duly made and seconded the following resolution
was adopted
RESOLVED : That the Mayor express to Mr. Dahmen by
letter or otherwise, the appreciation of the Trustees
of the Village for the interest and co- operation shown
by him in repairing the State roads located within the
limits of the Village.
9. The following agreement as negotiated by the special
committee appointed for that purpose, in relation to'the '
extension of water mains beyond the limits of the Village
was accepted and approved

"THIS AGREEMENT Made the 20th day of October, 1932, between
Jared T. Newman and Charles H. Blood of the Village of Cayuga
Heights, County of Tompkins and State of New York,.parties of the
first part., and the Village of Cayuga Heights, a municipal
corporation of the State of New York, party of .the second part,
WITNESSETH
WHEREAS, The parties of the first part have by quit -claim
deed of even date herewith, conveyed to the party of the second
part all their rights, title and interest, subject to certain
reservations as therein set forth, in.the water system within,the
corporate limits of the Village of Cayuga Heights, and have
further made.substantial contributions in.money to the cost of
water'system improvements now in progress of construction.in and
adjoining said Village,.NOW.IN.CONSIDERATION THEREOF, the party
of the second part agrees
(1) To rescind and nullify such actions and resolutions of
the Board of Trustees of said Village heretofore taken or adoptedy .
as relate to the use of the water system of said Village in connec-
tion with extensions thereof by the parties of the first part or
either of them.
' (2) To allow and permit the passage of water through the
water mains in said Village for the purpose of serving any or all
water main extensions or hydrants that have been constructed and
placed, or hereafter may be constructed or placed,.on lands now
owned by said parties of the first part or either of them, or the
Cayuga Heights Land Corporation and located to the west and /or
north of said Village,,and including the Klinewoods section, so-
called, owned by Jared T. Newman, as such lands are set forth and
described on an outline map attached hereto and made a part of
this agreement, and also including any lands that may within the
next fifteen years be acquired by Charles H. Blood, Jared T.
Newman or the Cayuga Heights Land Corporation to the west of
Cayuga Heights Road, and not more than one -half mile north of the
north line of the Town of Ithaca, said privilege to be for the
taking and using of water in the same manner as that enjoyed by the
residents of the Village of Cayuga Heights but subject to such
regulations and rates as may be imposed by the City of Ithaca.
(3) To grant and extend the privilege of the benefits to
be derived by the passage of water through the mains of the .
Village of Cayuga Heights to-all property.owners who have in the
past purchased lands outside of the corporate limits of said .
Village from said parties of the first part or.either of them, or
the Cayuga Heights Land Corporation and who have shared in .the
assessed cost.of the present water system improvement, and.also
to all property owners who may in the future purchase lands from
either of said parties within the previously described area,:said
privilege to.be for the'taking and using of water in the same
manner as that enjoyed by the residents of the-Village of Cayuga
Heights but subject to such regulations and rateA as may be
imposed by the City. of Ithaca.

IT IS MUTUALLY UNDERSTOOD AND AGREED That certain specific
agreements relating to the extension of water mains beyond the
corporate limits of the Village of Cayuga Heights made and
entered into by and between the parties of the first part hereto
and the said Village of Cayuga Heights under date of February 5,
1925 and under date of February 25, 1931, a.re'hereby cancelled,
and from the date of this agreement shall have no further force
or effect.
IT IS FURTHER AGREED as an additional consideration for
the releases and grants hereinbefore set forth, that in the
event of a future extension of the corporate limits of said
Village of Cayuga Heights to the north and /or west, the parties
of the first part or their heirs will for the sum of One ($1.00)
Dollar, to them paid, grant, release and convey to said Village
of Cayuga Heights, all their respective interests in water mains
and appurtenances that they have installed or may hereafter install
within the boundaries of such extension of the Village limits.
This agreement is made always subject, however, to the life use
reserved to Charles H. Blood in those water mains laid by him in
the event that the said Village of Cayuga Heights shall later
become a part of the City of Ithaca and such1conveyance to be
subject to an agreement as to the right of outside extensions
in the same manner as the present Village mains are.made subject
thereto by this present agreement. e
IT IS FURTHER AGREED That in the event other property owners
owning lands outside the corporate limits of the Village of
Cayuga Heights and who are not listed on the present assessment
of cost of water system improvements, or who do not purchase or
acquire any of the land now owned by the parties of the first
part or either of them, or the Cayuga Heights Land Corporation,
shall apply for the privilege of connecting to or extending water
pipes from mains laid by the parties of the first part, or either
of them, and such privilege is granted by the Village of.Cayuga
Heights and the City of Ithaca, then such owners shall be assessed
a proper and equitable charge by said Village for such privilege,
and one -half of all moneys to collected shall be paid to that one
of the parties of the first part or his heirs, who financed and
installed the water main or mains from which the connection or
extension is-to be made, it being understood that in the case of
the mains laid by Jared T. Newman, the total of such payments
shall not exceed the sum of One Thousand ($1,000.00) Dollars, and
shall be paid to him for the purpose of reimbursement in such
manner as he shall deem equitable to those parties who have
purchased lands from him and who have also contributed to the cost
of the present water supply improvements, it being-understood,
however, that the Village of Cayuga Heights'shall be in noway
responsible for this distribution.
IT IS FURTHER AGREED That the parties of the first part.or
that one of them who laid the water main or mains shall have the '
right to demand and collect a separate and additional charge in
an amount that they may deem equitable from said outside parties

who may desire to connect with such mains outside of the corporate
limits of said Village, the first charge above mentioned being
for the privilege of using the general water system, and the
additional charge being for a portion of the cost of laying the
water main at the property in question.
IT IS MUTUALLY UNDERSTOOD AND AGREED That the said Village
of Cayuga Heights shall in no event be liable for failure to
furnish a suitable water supply.to the parties of the first part,
their successors or assigns, or any other person or persons
residing outside the corporate limits of said Village who may
now or hereafter enjoy the privilege of the water supply herein
provided for, and it is further agreed that the party of the
second part shall at no time be put to any extra or additional
maintenance expense on its water mains or water system for the
benefit of the users of water outside the corporate limits of
said. Village.
IN WITNESS WHEREOF The parties of the first part.have
hereunto set their hands and seals and the party of the second
part has caused this instrument to be executed by its duly
authorized officers.
