Dear Dr, Williams: Now that you have the new map of the Village, it would seem advisable to check over the question of road titles to be sure they are all in proper shape before undertaking any extensive improve- ment work such as the proposed sanitary sewer system, Outside 1x1 the country, it may be all right for the public to have just a right of way, with adjoining owners holding the fee to the center of the road, but in an incorporated village where curbs, paving, sidewalks, water mains, sewers, etc, are constructed, the tillage should have full and unquestioned title to all roads. Some roads have been oonveyed to the Village, some were probably conveyed to or just accepted by the Town before the Village was formed, and some have never been conveyed or accepted at all. In some cases the owners go to the center of the road and elsewhere they do not. Also in some oases there have been minor changes in road alinement after the conveyances were made. In order to clear up such matters for once and all I would suggest oonstbration of the following items:— (1)— A blanket ,quit claim deed from Newman and Blood and their wives, the aayuga Park Association (if in exist- ence), and'the Cayuga Heights Land Corporation cover- ing all the roads in the Village Limits. A list of the roads would be set forth, apecif*ing the beginnixg and ending points and the width. (2)— A quit claim deed from the Lake View Cemetery Associ- ation covering any title they may have in Wyckoff Road, Kline Road, Cayuga Heights Road, eta. (j)— A quit claim deed from the Country Club and interior owners in Triphammer Road (west half), Country Club Road, Kelvin Place Ext., etc. (4)— An examination of the deeds of owners indicated on the map should show from whom deeds should be obtained to perfect road titles. Illustrations are the right to fill for Kelvin Place at the upper end of Bedell, rights of owners in the 20 ft, stretch of Overlook Road, etc. 1 (5)— On Cayuga Heights Road, a 15 ft, easement was created on each side by Newman, Blood and the Cer4 ery Associa- t ?119 (B) - Should the State abandon its rights in the Cayuga Heights Road macadam, etc., and complete control be taken over by the Village 7 Some of the above notes may be a little far fetched and may not need much discussion by the Village Board and its attorney. How- ever, if anything needs to be attended to, now is the time to do it, so that the Village will have a sound legal basis for full and com- plete control of roads, sidewalks, street planting, sewers, etc: The transition from a real estate development to an incorporated community always leaves a few little matters overlooked and that cause trouble Iter and now might be a good time to check things over. Very truly yours, I ation. Possibly there are other oases: This title should be in the Village as in some cases the side walks and street trees are-on this strip. (This, reminds me that some day you should make a study of the street tree situation and use one of the blank maps as acwall map record of such trees, as proper atten- tion to this matter makes a lot of difference in a residential community). Various other set- backs, road- side planting easements, etc, have been established in different deeds for community benefit: Should the title to such restrictions be in the Village or continue with Newman and Blood and their heirs ? This does not of course apply to view restrictions, etc., in favor of certain specific lots: (6)- Does the Village have proper title to the water mains and those portions of service connections that are in the street ? How about the gas mains 7 Do the Gas & Electric, telephone and street railway have proper. franchises ?'---- ® (7)- With respect to the old Cornell Heights Land Company streets close to the south line of the Village, have these ever been conveyed ? Dear Dr. Williams: One copy of the new linen prints of the Cayuga Heights Tillage map has been delivered to each of the following village officials: — Mayor— Dt�*- X &Uia.ms Clerk — Simmons - Road Supt. — Perkins Zoning Offioer— McPherson Trustees — Garrett, Wile on,Hagan,Wiegand, According to my talk with you I have ordered eight additional prints of the map and when ready will deliver them to you in a filing tube. Later on, when the sewer plan is completed I think that.you will probably want these fixed up as wall maps for use at various village meetings. I had in mind using these blank maps to show the following utilities:— 1— Curbing and Paving 2 —Water tines House Numbers, 3—Gas Lines Street Trees 4 —Storm Sewers 5- 8anitary Sewers 6— Sidewalks 7 —Elec. Lines and Street Lights 9—Telephone-Lines and Street Signs The existing utilities could be put on and.then revise the maps for additions once per year, We would need to look into the matter of proper rollers and other attachments to arrange these as a wall map set. The capacity of the set should be large enough to provide for additional maps, as you might wish to hang up the proposed sanitary sewer layout, a map of the City, a map of developments adjoin= ing the Village, etc. The matter of such map rollers and hangers might well be investigated this coming spring.
