Young clerk of the Village for the coming year. Voted to continue A.G. Huributt in the office of street commissioner during the odging year. Voted to hire Seymour Mosher to collect garbage and ashes in the village on a time basis, the same as that under which the work was let during the preceding year. Voted that the village proceed at once with the gravelling of Upland Road between Highland Road and Cayuga Heights Road, with the understanding that the cost be kept reasonably near the tentative estimate presented by the Street Commissioner. Voted to establish a separate Pund,to be desio- Aa•ted the Water Fund, against which checks may be drawn to cover the cost of the three items,,namely, repairs to water mains,. cost.of, new hydrants and maintenance of hydrants, Voted to accept the proposed budget for 1925 -26 as proposed in the regular meeting of the Board of Trustees on March 5, 1925, with the minor change of grouping the three items bearing upon the water supply under a single fund as explained above. Received from Mrs. A.D. White check for $4.50 covering cost of labor in cleaning out culvert on her property near Renwick Drive. During the meeting the President communicated Fire Chief hielly�s,underst''ifth' of the responsibility of the village in case the Ithaca, Fire Department answers calls within the village limits, as fo�]ows': -'That formerly there was a gentleman's agreement in iegard'e' the payment of' fifty dollars by the village for each `response to fire alarms, but that some time in the past the village of Cayuga Heights had contributed five hundred dollars (500) towards the equipment and maintenance of one of the fire stations: Since that time the Chief feels that it is unnecessary to,make any demands for paymment in,reaponse to fire alarms, unless, of course, there should be so many of them that the response would become a burden. The Chief, however, stated that in case the city needed fire fighting equipment within the oityls boundaries a village call would have to be given second consideration. He also expressed the desire that the residents would not call out the fire department in case of grass fires but that each owner should be personally responsible.for the result of setting fires to grass and brush, Voted to adjourn. Sept. 30, 1925 ... 24.00 . so In answer to a petition signed by most of the property owners on the west side of the Cayuga Heights Road and north of Renwick Drive to the village line asking that the location of the sidewalk to be constructed along the west side of said road be definitely established it was voted to authorize the president to reply in the following manner+ That the informal opinion of ,the Board of Trustees favored the retention of a roadway eleven 11) feet on either side of the center; the sidewalk to be five (5).feet in width; and the building of a retaining -wall along the west side of sidewalk at least thirty -six (36) inches above the level of the sidewalk. Further, that no grass plots or plantings should be placed between the retaining -wall and the road. And, that it be a matter of record that the Board of Trustees do not guarantee that the State will not want to use the full fifty (50) foot width to which, by law, it is entitled. This expression of opinion being given in lieu of a definite sidewalk policy which is now pending: Voted to authorize the street commissioner to move shale excavated from Prof. C.K. Burdick's property on Cayuga Heights Road for road eonstruotioi{ on the east side of Renwick Drive immediately east of the Cayuga Heights Road. Voted to adjourn. Antecedent to construction, 61d plans and a statement of the proposed use, together with a request for a building Permit shall be filed with the Zoning Officer. It shall be the duty of the Zoning Officer to issue a Building Permit within ten days'after a request for the same shall nave been filed with him by any owner or lessee, if the building and proposed use thereof conform to all of the require- ments herein set forth. (b) Each applicant for a Building Permit shall pay for the same the sum of one dollar to the Village. Sao. 11. PENALTY FOR VIOLATION. For any and every violation of the provisions of this Ordinance, besides the equitable remedy provided for in the New York State Village Law, the owner, agent, contractor or other person interested as lessee, tenant, or otherwise in any building or premises where such violation has been com- mitted or shall exist, and who refuses to abate such violation within five days after written notice has been served on him, either by mail or by personal service, by the Zoning Officer, shall for each and every violation,•and for each and every day that such violation continues, be subject to a fine of not more than one hundred dollars, as shall be assessed by the Board of Appeals, and in addition shall pay all costs and expenses incurred by the Village in determining such violation. t� Sec. A. VALIDITY. The invalidity of any section or provision of this Ordinance Shall not invalidate any other section or provision thereof. .Voted to appoint the following Zoing Board of Appeals: Messrs. R. 17. Curtis. V.R. Gage; Charles Newman, O.L.Mc Caskill, and George Young, Jr. Voted to appoint FQr. A/H. ]Ac Pherson as Zoning Officer for a period of three years beginning Jan. 1, 1926.
