Minutes 6/20/1983� L a J 6/20/83 VILLAGE OF CAYUGA HEIGHTS - -- BOARD OF TRUSTEES MINUTES of an informal meeting of the Board of Trustees of the Village of CAyuga Heights held June 20, 1983 at 7:30 p.m. in the Village Hall. PRESENT: Mayor F.G.Marcham; Trustees Ronald Anderson, David Allee; Attorney Roger Sovocool; Treasurer Gordon Wheeler; Engineer /ZO John Rogers; Police Chief Harlin Mc Ewen; Fire Chief Francis Miller. ABSENT: Trustees James Bennett; Shailer Philbrick, David Pimentel, Jean Robinson. OTHERS PRESENT: None. Mayor Marcham stated that although formal action could not be taken at this meeting due to the absence of four Trustees, those present might wish to discuss Minutes of the previous meeting and the Abstract of Audited Vouchers dated June 20, 1983 with the expectation that formal action would be taken on these matters when the Board meets next month. The Abstract of Audited Vouchers dated 6/20/83 in the following amounts: General Fund - $33,023.26; Sewer Fund $14,910.20 was perused and discussed by members. Treasurer Wheeler asked that a bill from Finger Lakes Communication for $128.51 -Fire Department Equipment Maintenance - be added to this list. Trustee Allee, reporting on the activities of the Community Center, read a letter written by Betty Matyas on behalf of the CAyuga Heights Community Center to Mayor Shaw complaining about the noise at Stewart Park during the recent Ithaca Festival. The Mayor was instructed to write to Mayor Shaw saying that the Village reinforces the complaint and hopes that at future festivals Mayor Shaw will be able to limit the noise within reasonable boundaries. Trustee Allee asked if his role as liaison between the Village and the Community Center could be assumed by another member of the Board in view of the fact that he has taken on added responsibilities for the coming year. He suggested that Trustee Bennett might possibly, assume the role. Mayor Marcham read his report and it is on file in the Village Office. Mayor Marcham announced the appointment of Mrs. Mary Grainger of 721 Hanshaw Road as representative to the Tompkins County Youth Board to fill the vacancy left by Mrs. Helen Searle. In reference to Mr. Myron Stanton6 request for a refund for a second Bolton Unit which he has been paying since 1974 when he applied for a zoning permit to construct an apartment on his property but never did, the Attorney will study the matter and report at the next meeting. The Mayor was instructed to write to Gust Freeman, Chairman of the Human Services Committee in reference to a Village nominee for appointment to the Tompkins County Economic Opportunity Corporation Board of Directors. The Board was satisfied to have Mr. Freeman complete appointments from the list of names already in his files. The Mayor reported that he had met with Gene Dymek and Jack Rogers on May 240 1983 in reference to the new Uniform Fire Prevention and Building Code which will replace the present State Building Construction Code and the State Fire Prevention Code on January 1, 1984. It was agreed that the Village would assume responsibility for enforcement of the Code rather than turn it over to the County. 1 I� 6/20/83 contii �n Qy In response to Molly Shoemaker's letter encouraging the Village to participate again this summer in the Youth Bureau's Summer Youth Jobs Program stating that the Community Center is in need of two girls to work in the library, the Mayor is instructed to write to Mrs. Shoemaker informing her that the Village Board has agreed to participate in the program. Mayor Marcham read a letter which accompanied a plumbing bill from Stuart Lewis of 105 Winthrop Drive in which he requests reimbursement for what he callen "unnecessary expenses incurred" when he recently hired a plumber to investigate a stoppage in his sewer lateral which had later been determined to be in the Village main. The Mayor is instructed to write to Mr. Lewis telling him that the Board declines to accept his bill on the basis that his plumber should have examined the situation in the main first before proceeding to work on the lateral. It was suggested that the Engineer prepare a statement for publication in the next Newsletter concerning the procedure to be followed by Village residents when a backup occurs in their sewer lateral. Fire Chief Miller presented his report and it is on file in the Village office. Treasurer Wheeler presented the final list of transfers for the 1982 -83 fiscal year. Treasurer Wheeler stated that the seminar on Insurance Management for Municipal Officials which he had been authorized to attend has been cancelled. In connection with the Town of Ithaca payment for the Eire Protection Contract for 1983, Treasurer Wheeler reported that due to an error in the assessment data provided by the Town which is used to compute the 1983 charges, the Town had been overcharged and when Town Supervisor, Noel Desch, realized the error several months later, the Billage budget estimates for the current fiscal year had already been completed. The Town submitted payment of $33,272 - $5,728 less than the figure used in the budget. The Treasurer suggested reviewing the terms of the contract in the near future. Attorney Sovocool reported on the following: In the matter of Gates vs Village of Cayuga Heights, the Supreme Court decided that the Zoning Board of Appeal's interpretation of the Village ordinance excluding public roads from building coverage computations is reasonable and permissable and further, that the Zoning Board of Appeals did not exceed its authority in holding that petitioners failed to establish any basis for a variance. In the matter of the petition of the JFJ Enterprises vs Village of Cayuga Heights, the Attorney reported the case was scheduled for court hearing on June 21 and he will report at the July meeting. Police Chief Mc Ewen presented his report and it is on file in the Village Office. Engineer /ZO John Rogers gave his report and it is on file in the Village Office. Engineer Rogers reported that the North Triphammer Road Culvert Project is completed and recommended that Hey's Enterprises, upon receipt of statement of release of liens, be paid the balance due plus $1960 for additional work that needed to be done as a result of a mix -up in delivery of pipe by Republic Steel Corp. Both Trustees present approved - approval from one other Trustee will be obtained before payment is made to Hey's Enterprises. The Engineer referred tto a letter from Attorney Walsh who is representing a buyer for the Bradfield Property on Sheldon Road. Mr. Walsh asks if the Village would be willing to release a right-of-way which would permit the Village to 6/20/83 n_`LV 6/20/83 continued construct and maintain a so- called "blow off pipe" running from the Sheldon Road line southerly to a brook which exists approximately 100 yards south of Sheldon Road. He stated he had been informed by Don Terrell of Bolton Point that their maps do not indicate that such a blow off pipe was ever constructed and it is doubtful that there would be any reason to construct it in the future. Mayor Marcham was instructed to write to Mr. Tyrrell to ask if there would be cause for concern!.to the Commission if the Village were to grant a release of the right_of -way in question, and further, if they are willing to go along with Mr. Shaw's request, to write a letter to this effect for Village files. There was discussion concerning improvement and maintenance df the Texas Lane walkway. No action was taken. PRESENT: Mayor F.G. Marcham; Trustees Ronald Anderson, James Bennett, Shailer Philbrick, David Pimentel, Jean Robinson; Attorney Roger Sovocool; Treasurer Gordon Wheeler; Engineer /ZO John Rogers; Police Chief Harlin Me Ewen. ABSENT: Trustee David Allee, Fire Chief Francil Miller. OTHERS PRESENT: Warren Buck, John Millier, Mr.. & Mrs. Goodman, Mr. & Mrs. Hanselman, Mr. & Mrs. Kalter, Thomas Niederkorn,. John Majeroni, Marilyn Trotter, Mr. & Mrs. Currey. The Goodmans and Hanselmans of White Park Road appeared before the Board to complain that the asphalt sidewalk patching which was recently done in front -of their properties is unsatisfactory in that the asphalt is breaking away and it is also unsightly in its "checkerboard" appearance. Mr. Hanselman suggested that consideration be given to removing the sidewalk completely on the south side of the road since there is already a sidewalk on the north side. The Board will consider the problem. Mr. Thomas Niederkorn of Planning /Environmental Research Consultants presented to the Board background information and supporting documentation in connection with his request, on behalf of Cornell University, for an amendment to the Village Ordinance which would permit occupancy of a parcel at 168 Pleasant Grove Road, owned by Cornell University and zoned residential, by the Kappa Alpha Theta Sorority. After long .`.discussion concerning such issues as traffic and safety problems, parking facilities, numbers of occupants - both living on the premises and visiting,- accessibility for fire equipment, etc., the Board advised Mr. Niederkorn that a list of concerns would be made and submitted to him in the near future. Motion made by Trustee Anderson, seconded by Trustee Pimentel: VOTED to approve the minutes of a regular meeting held May 16, 1983 and an informal meeting held June 20, 1983 as previously furnished Trustees in Xerox form.
