REPORT OF THE ZONING OFFICER

During the past month there were two zoning permits issued; one for con-
structing an apartment change in use for an estimated cost of $3,000 and
one for a replacement sign for Mister Donut. A request for a zoning permit
to construct a separate studio addition at 512 Cayuga Heights Rd. was denied
because the proposed structure did not meet the zoning requirements on height
of building. The owner has requested a hearing before the Zoning Board of
Appeals for a variance - March 23, 1983 has been set for the hearing. The
Zoning Officer will not be present. One road opening permit was issued to
NYSEG for gas line repair.
After their February 16, 1983 meeting, the ZBA granted a variance to Edith
Wanderstock to exceed 12% of land coverage and have a carport closer to the
road right of way than 25 feet. The Board also denied a request for a vari-
ance from Reeder Gates of 2233 N. Triphammer Rd. to cover more than 12% of
the land area. On February 23, the Board met to hear a request from Kenneth
Morusty for a retroactive use variance to allow three apartments in his house
on N. Triphammer Road. The Board will meet with Attorney Sovocool before
making their decision.
The laundry at the.Corners Community Center has been notified that their new
sign is not in compliance with the sign ordinance. Upon investigating the
new sign it was found that the old signs also did not comply. The operators
of the lauundry and the property owner were so notified.
The Food Market at the Corners Community Center has been notified that their
change in sign wording requires a sign permit.
The informal proposal to develop a single lot on Highgate Road into three
building lots was dropped as the property was sold to a party who intends to
build a single house on the entire piece of land. There are a number of
properties in the residential district that could be subdivided into more
than two lots. The Zoning Ordinance is not clear as to the control the Vil-
lage has over such-development in the Residential District. It is suggested
that the Zoning Ordinance be changed to require that the division of land
into more than two lots must come before the Board of.Trustees as the Village
Planning Board.
The Zoning officer has not proceeded on enforcement of Section 17, Signs, of
the Zoning ordinance as he has been told by the Village Attorney that there
are legal problems. If the Board wishes to have the interpretation that signs
inside windows that can be read only from the outside are outdoor advertising,
steps should be taken to change the ordinance or obtain the Attorney's opinion
as to what is necessary.
Mr. Robert Kalter is scheduled to appear before the Board on March 21, 1983 to
present a new use plan, storm water drainage plan, and parking plan for his
proposed development on E. Upland Rd. Two major concerns of the Village are:

(1) If the capacity of the storm drain pipe is exceeded because of a block-
age in the pipe or because of an extremely large runoff, the overflowing water
..must.-not be diverted to neighboring land and must leave the Kalter property
at the same location as it does now. This should be indicated on the plot
plan with contour lines.
(2) The second major concern is that adequate parking be provided "to accomo-
date the•cars of employees and the number of cars anticipated to be attracted
by the facility of the structure at any time."
