Police Chief Mc Ewen presented his report and it is on file in the Village Office.
Discussion ensued concerning Chief Mc Ewen's recommendation that a yield sign be placed on
that portion of Texas Lane leading to the turnaround.
Motion made by Trustee Philbrick, seconded by Trustee Pimentel:
RESOLUTION 3310 - PUBLIC HEARING TO CONSIDER INSTALLATION OF YIELD SIGN ON TEXAS LANE
VOTED to hold a Public Hearing at 7:15 p.m. on September 20, 1982 to consider the
installation of a yi6la sign on Texas Lane. Unanimously passed.

Chief Me Ewen reported that on January 26, 1982 he wrote to Mr. Ciaschi of the Community
Corners informing him of the new law requiring the designation and marking of handicapped
parking spaces in shopping centers, and a telephone reminder in May. To date, Mr.
Ciaschi has taken no action and Chief Me Ewen was instructed to write him at once advising
him that if he has not attended to this by September 1, 1982, an action will be commenced
in Village Court.
In connection with the Morusty zoning violation, the Attorney suggested that in inspection
of the premises be made by the Zoning Officer in an effort to determine the number of dwelling
units in use on the property. Once this has been established, Attorney Sovocool will contact
Attorney Mulvey in an attempt to resolve the problem once and for all.
Engineer Rogers gave his report and it is on file in the Village office.
Engineer Rogers reported that he will have figures available at the next meeting for the
total cost of paving Triphammer Road.
Engineer Rogers brought to the Board's attention the classified ad which appeared in the
Ithaca Journal concerning the leasing of the property at 910 Hanshaw Road (former Mobil. -
Station) by its owners, JFJ Enterprises. The Attorney stated he will review the terms
of the lease which was issued to them by the Village and contact Mr. Ringwood, their
attorney, in eeference to it.

Mayor Marcham read the proposed Local Law No. 2 of the Year 1982 as prepared by Police
Chief McEwen. The Police Chief recommended that since the publication of a Public
Hearing to amend the Traffic Ordinance requires specific wording by the State,
the Public Hearing should be rescheduled with proper notification for the October
meeting. He suggested also that since the entire Traffic law - in addition to the
amended portions - must be filed with the Secretary of State, it would be well to
consider additional changes to the Traffic Ordinance at that hearing. After some
discussion, the Public Hearing was declared closed.

held September 20, 1982 immediately following the Public Hearing.

Shailer Philbrick, David Pimentel, Jean Robinson; Attorney Roger Sovocool; Treasurer
Gordon Wheeler; Engineer /ZO John Rogers; Police Chief Harlin R. McEwen; Fire Chief
Francis Miller.

OTHERS PRESENT: Mr. & Mrs. Robert Kalter, Architect Anton Egner, Sharron Buck, Betty
Matyas, Fran McLeod.
Mr. Anton Egner, Architect, presented preliminary site plans on behalf of his clients
Mr. & Mrs. Robert Kalter, for a proposed building on East Upland Road. There was
discussion relative to questions concerning water and sewer drains, access points,
landscaping, etc.
Motion made by Trustee Bennett, scconded by Trustee Anderson: ,
RESOLUTION 3311 - PROVISIONAL APPROVAL TO KALTERS' FOR PRELIMINARY PLANS
TO CONSTRUCT ON EAST UPLAND ROAD
VOTED to offer provisional approval of the scheme provided by Mr. Egner and Mr. &
Mrs. Kalter, with the condition:.that when further developments have taken place for
final disposal of the building and landscaping, they will return to the Board for
final approval. Unanimously passed.
Motion made by Trustee Philbrick, seconded by Trustee.Allee:
VOTED to approve the minutes of a regular meeting of the Board of Trustees held August
16, 1982 as previously furnished Trustees in Xerox form. Unanimously passed.
Motion made by Trustee Pimentel, seconded by Trustee Bennett:
VOTED to approve the Abstract of Audited Vouchers dated 9/20/82 in the following
amounts: general Fund - $114,654.95; Sewer Fund - $12,621.67. Unanimously passed.
Treasurer Wheeler apprised the Board of the seriously budgetary problem which exists
in certain of the DPW accounts due to some unforseen costs in the recent paving of
Triphammer Road. The Treasurer advised that extreme caution be exercised in regard
to further spending in that department, especially in view of the upcoming
sidewalk and culverts projects which the Village must complete in order to qualify
for State Aid.
Mayor Marcham gave his report and it is on file in the Village Office.

Mayor Marcham read a letter from Mrs. Helen Searle, Cayuga Heights representative to
the Tompkins County Youth Board, in which she offers her resignation as representative to
Board effective October 1, 1982. She states that Mrs. Martha Allee is willing to fill out
her term which expires December 31, 1982, and offers the names of several women who might
be willing to accept the post.
Motion made by Trustee Allee, seconded by Trustee Anderson:
RESOLUTION 3312 - ACCEPT RESIGNATION OF HELEN SEARLE AND OFFER THANKS FOR
SERVICE AS VILLAGE REPRESENTATIVE TO T.C. YOUTH BOARD
VOTED to thank Mrs. Helen Searle for her services as Village representative to the
Tompkins County Youth Board and instruct the Mayor to ask Mrs. Martha Allee if she will
fill out the remainder of Mrs. Searle's term, and further, to ask the women named in
Mrs. Searle's letter if they would be willing to serve. Unanimously passed.
Mr. Francis McLeod, Treasurer of the Cayuga Heights.Community Center, distributed copies of
the Association's financial report and reviewed the items on it with the Board.
Motion made by Trustee Bennett, seconded by Trustee Pimentel:
RESOLUTION 3313 - INCREASE VILLAGE CONTRIBUTION TO COMMUNITY CENTER
VOTED to increase the Village contribution to the Cayuga Heights Community Association from
$2200 to $2500 for the current fiscal year to cover the Association's costs for rent,
insurance and the Village's share of publication costs of the newsletter. Unanimously passed
Fire Chief Miller presented that department's report and it is on file in the Village office.
Chief Miller reported that the Truck Committee which he appointed in October, 1981, is
currently preparing specifications for a rescue vehicle. He stated further that this
Committee has met with the Public Safety Committee who in turn has given permission to the
Truck Committee to obtain bids. The Fire Chief will look at the rescue vehicle
presently in use in Bath, NY.
Treasurer Wheeler presented the year -end financial report which he reviewed briefly with
the Board.

RESOLUTION 3314 - APPROVE TRANSFERS
VOTED to approve the transfers of funds as follows: (Copy inserted in Minute Book.)

The Treasurer referred to a letter from Mrs. Karen Elder of 115 Cayuga Park Circle who
received from the Treasurer on 9/1/82 a reminder letter stating that the Village Tax on
her property remained unpaid. Mrs. Elder explained in her letter that her check,
together with the tax bill, was placed under the Village Office door on June 30th (after
office hours) by Bill Scott who was delivering his own check. Since Mr. Scott's payment
was credited and Mrs. Elder's was not, the Treasurer recommended that penalty charges be
waived since the check, which had not been cashed, was obviously lost.
Motion made by Trustee Allee, seconded by Trustee Pimentel:
RESOLUTION 3315 - WAIVE PENALTY CHARGE FOR UNPAID VILLAGE TAX FOR ELDER PROPERTY

VOTED TO WAIVE the penalty charge for unpaid Village tax on the Elder property at 115
Cayuga Park Circle due to Mrs. Elder's affirmation that her check in payment of the
tax together with the tax bill had been placed under the door of the Village Office
on June 30th, by Mr. William Scott with his own check which had been received and
credited. Unanimously passed.
In connection with the complaint by Mrs. Warren Buck of the Convenient Food Mart that
the sign ordinance in unfair in that it allows the Mobil Station to erect a 20 square
sign but limits the Convenient Food Mart to a 10 square foot sign because it is one of
several businesses which occupy a single building, Mayor Marcham stated he will appoint
a committee to review the 'sign ordinance.
Engineer Rogers gave his report and it is on file in the Village Office.
The Engineer distributed copies of the work schedule in connection with the installation
of the culverts on North Triphammer Road. Discussion followed concerning types of
culverts, costs, duration of traffic diversion, and start of construction.
Motion made by Trustee Philbrick, seconded by Trustee Anderson:
RESOLUTION 3316 — AUTHORIZE ENGINEER TO PREPARE SPECIFICATIONS AND SEEK
BIDS FOR CONSTRUCTION AND MATERIALS FOR CULVERTS
VOTED to authorize the Engineer to prepare specifications and seek bids for materials
and construction of culverts on North Triphammer Road and further, to inquire of the
County Highway Department what conditions have to be met to qualify for beginning of
construction. Unanimously passed.

Engineer Rogers reported that the Mobil Station has requested permission to provide
a car vacuuming service. Questions arose concerning road setback distance, traffic
flow, and noise.
Motion by Trustee Pimentel, seconded by Trustee Robinson:
RESOLUTION 3317 — MOBIL STATION REQUEST FOR VACUUMING SERVICE DENIED
VOTED to deny the Mobil Station's request for permission to provide a car vacuuming
service to its customers on the basis that it coi)ld create problems in connection
with parking, traffic flow,-and noise. Unanimously passed.
In view of the Engineer's thwarted attempt to inspect the Morusty property at 2212
North Triphammer Road for possible zoning violations, the Attorney stated he will
contact Richard N.ulvey in the hopes of arranging for a joint inspection of that
property and in the event that this connot be arranged, the Attorney will secure a
warrant to enter and inspect the premises.
Mayor Marcham left the meeting at 10:40 p.m., turning it over to Deputy Mayor Anderson.

VOTED to hold a Publis Hearing at 7:15 P.m. on October 18, 1982 to consider the enactment
of a Local Law No. 2 of the Year 1982 amending and superseding Locat Law No. 1 of the Year
1981. Unanimously passed.
After some discussion concerning the lighting problem in the Village Hall, the Board
granted permission to the Police Chief and Engineer to seek bids in connection with the
cost of installing a new service.
Motion made by Trustee Robinson, seconded by Trustee Philbrick:
RESOLUTION 3319 - APPROVE ATTENDANCE AT TRAINING SCHOOL
VOTED to approve the attendance of the Clerk at the 27th Annual Training School for
Fiscal Officers and Municipal Clerks, September 28 - October 1, 1982 to be held at
Grossinger's Hotel, Grossinger, NY. Unanimously passed.

and superseding Local Law No. 1 of the Year 1981 entitled "Traffic Control ".

Mayor Marcham opened the Public Hearing citing the proposed changes in the Traffic Control
Ordinance as follows: the addition of (e) under Section 5, d. (2) Texas Lane Cul -De -Sac
from the Southeast at its intersection with Texas Lane; Section 7, b. (2) the elimination
of paragraph (g) No parking zone on the South side of East Upland Road and (h) No parking
zone on the East side of the Parkway and a new sub - section (x) No parking zone on the South
side of Country Club Road within the right of way line from the. intersection of Triphammer
Road West for 225 feet. No discussion followed and the Public Hearing was declared closed.
