VOTED to hold a Special Meeting on Friday, July 30, 1982 at 4 p.m. to consider bids
for the installation of a sidewalk on East Upland Road. Unanimously passed.

MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights
held August 16, 1982, in the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees Ronald Anderson, Shailerr Philbrick, David Pimentel;
Attorney Roger Sovoccol; Engineer /ZO John Rogers; Police Chief Harlin Mc Ewen; Fire Chief
Francis Miller.
ABSENT: Trustees David Allee, James Bennett, Jean Robinson; Treasurer Gordon Wheeler.
OTHERS PRESENT; Warren Buck.
Motion trade by Trustee Anderson, seconded by Trustee Pimentel:
VOTED to approve the minutes of a Public Hearing and a Regular Meeting held on July 19, 1982
as previously furnished Trustees in Xerox form. Unanimously passed.

Motion made by Turstee Pimentel, seconded by Trustee Philbrick:
VOTED to approve the Abstract of Audited Vouchers dated 8/16/82 in the following amounts:
General Fund - $55,539.36; Sewer Fund - $21,118.72 - with the provision that the Engineer
report at the next meeting the reason for the $13h.28 expenditure for two cases of wasp
spray. Unanimously passed. .

Mayor Marcham referred to a letter from Mr. W. H. Brutsaert, Village resident, in which
he requests a refund for overpayment of a second sewer unit as itemized on his tax bills
since 1978, on the basis that he has used the property as a one -unit residence since he
purchased it at that time and also, that the Village records be changed to reflect this.

Motion by Trustee Pimentel, seconded by Trustee Anderson:
RESOLUTION 3307 - APPROVE REFUND FOR OVERPAYMENT OF SEWER UNIT FOR CURRENT YEAR
ONLY AFTER EXAMINATION OF PROPERTY BY ZONING OFFICER
VOTED to request the Zoning Officer to examine the Brutsaert property at 220 Comstock
Road and if he feels that in fact there is no apartment in use, the Board is prepared
to refund the extra sewer charge for the period of the current year. Unanimously passed.

Mayor Marcham reported that the NYS Conference of Mayors is preparing to present the views
of state municipalities on needed new legislation and amendments to existing legislation,
so that it may promote the changes in the coming legislative year. Chief MCEwen
recommended that the Village submit a propsed change to the '.'Freedom of Information
Law Amended" Act which goes into effect on October 15, 1982, concerning fees which
municipalities are allowed to charge for photocopies. The Mayor was instructed to
respond to NYCOM's request.
Mayor Marcham reported that he and Trustees Anderson, Pimentel and Robinson met on
July 30 and August 2, 1982 to consider the bids for the installation of a sidewalk on
East Upland Road,.afid that a decision was made to accept the bid of D & J Paving
for installing a bituminous sidewalk at a cost of $13,220.
Motion made by Trustee Anderson, seconded by Trustee Pimentel:
RESOLUTION 3308 - CONFIRM APPROVAL TO ACCEPT BID FROM D & J PAVING FOR
INSTALLATION OF SIDEWALK ON EAST UPLAND ROAD
VOTED to confirm and approve the action taken at the July 30 and August 2, 1982 special ,
meetings to accept the bid from D & J Paving for the installation of a bituminous
sidewalk on East Upland Road at a cost of $13,220. Unanimously passed.
Mayor Marcham noted Chief McEwen's concern that the Cayuga Heights sign on the south
side of Route 13 in the Village, leading into Cayuga Heights Road, implies that it
leads into the whole Village and stated that the Chief wishes to persuade the State
to put in a new sign saying "Cayuga Heights Road" and to install an additional sign at
the intersection of Route 13 and North TRiphammer Road saying "Cayuga Heights" and
pointing to the Village.
Motion by Trustee Philbrick, seconded by Trustee Anderson:
RESOLUTION 3309 - AUTHORIZE CHIEF MC EWEN TO REQUEST THE NY DEPARTMENT OF
TRANSPORTATION TO INSTALL SIGNS ON ROUTE 13
VOTED to authorize the Police Chief to request the N.Y.Dept. of Transportation to
install signs on Route 13 indicating Cayuga Heights Road and also the Village of
CAyuga Heights. Unanimously passed.
It was brought before the Board that since the Community Center charges a fee for
outside use of their space in the Cayuga Heights School, they be required to submit
a statement of anticipated income and expenses so as to provide the Board with a better
view of the Village!.s obligation to the Center for monetary support. Mayor Marcham
was instructed to contact David Allee concerning this.
Fire Chief Miller presented his report and it is on file in the Village Office.
Mayor Marcham reiterated the sentiments expressed by Trustee Philbrick in his praise and
deep appreciation for the excellent care given him recently by the Rescue Squad.

Police Chief Mc Ewen presented his report and it is on file in the Village Office.
Discussion ensued concerning Chief Mc Ewen's recommendation that a yield sign be placed on
that portion of Texas Lane leading to the turnaround.
Motion made by Trustee Philbrick, seconded by Trustee Pimentel:
RESOLUTION 3310 - PUBLIC HEARING TO CONSIDER INSTALLATION OF YIELD SIGN ON TEXAS LANE
VOTED to hold a Public Hearing at 7:15 p.m. on September 20, 1982 to consider the
installation of a yi6la sign on Texas Lane. Unanimously passed.

Chief Me Ewen reported that on January 26, 1982 he wrote to Mr. Ciaschi of the Community
Corners informing him of the new law requiring the designation and marking of handicapped
parking spaces in shopping centers, and a telephone reminder in May. To date, Mr.
Ciaschi has taken no action and Chief Me Ewen was instructed to write him at once advising
him that if he has not attended to this by September 1, 1982, an action will be commenced
in Village Court.
In connection with the Morusty zoning violation, the Attorney suggested that in inspection
of the premises be made by the Zoning Officer in an effort to determine the number of dwelling
units in use on the property. Once this has been established, Attorney Sovocool will contact
Attorney Mulvey in an attempt to resolve the problem once and for all.
Engineer Rogers gave his report and it is on file in the Village office.
Engineer Rogers reported that he will have figures available at the next meeting for the
total cost of paving Triphammer Road.
Engineer Rogers brought to the Board's attention the classified ad which appeared in the
Ithaca Journal concerning the leasing of the property at 910 Hanshaw Road (former Mobil. -
Station) by its owners, JFJ Enterprises. The Attorney stated he will review the terms
of the lease which was issued to them by the Village and contact Mr. Ringwood, their
attorney, in eeference to it.
