Minutes 6/21/1982VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held June 21, 1982 at 7:30 p.m. in the Village Hall. so PRESENT: Mayor F.G. Marcham, Trustees Ronald Anderson, James Bennett, Jean Robinson; Attorney Roger Sovocool; Treasurer Gordon Wheeler; Engineer /ZO John Rogers; Police Chief Harlin McEvren. ABSENT: Trustees David Allee, David Pinemtel, Shailer Philbrick; Fire Chief Francis Miller. OTHERS PRESENT: Warren Buck, Betty Matyas, Mr. & Mrs. Robert Kalter, Mr. & Mrs. Ron Schmitt. Trustee Anderson informed the Board that Trustee Philbrick had been admitted to Strong Memorial Hospital on June 18, and after having undergone heart surgery, he was doing as well as could be expected. Mayor Marcham was asked to write to him offering a few:words of encouragement. Motion made by Trustee Anderson, seconded by Trustee Bennett: VOTED to approve the minutes of a regular meeting held May 17, 1982 as previously furnished Trustees in Xerox form. Unanimously passed. *e+v Motion made by Trustee Anderson, seconded by Trustee Robinson: VOTED to approve the Abstract of Audited Vouchers dated June 21, 1982 in the following amounts: General Fund - $15,495.49; Sewer Fund - $14,895.53. Unanimously passed. Motion made by Trustee Robinson, seconded by Trustee Anderson: VOTED to confirm verbal approval for Audited Vouchers dated 5/28/82 in the following amounts: General Fund - %2798.27; Sewer Fund - $12,715.53. Unanimously passed. Betty Matyas, President of the Cayuga Heights Community Association, spoke about the problems encountered by individuals unfamiliar with the community in locating the Developmental Disabil- ities Services and the Center suggested that a post sign be placed at the entrance to The Park- way indicating their locations. She suggested also the occupants of the school as well as up- coming events. Mrs. Matyas was instructed to draw up a design for both signs for approval by the Zoning Officer. It will then be presented to the school District for their approval. Mayor Marcham gave his report and it is on file in the Village Office. Mayor Marcham referred to correspondence from the Tompkins County Youth Bureau regarding a sum- mer job program for young people in which all municipalities will be eligible to participate. Discussion ensued concerning types of employment, adequate supervision, eligibility, amount of funding, etc. Motion made by Trustee Bennett, seconded by Trustee Anderson: RESOLUTION 3293 - CONSIDER YOUTH BUREAU SUMMER JOB PROGRAM VOTED to authorize the Engineer in consultation with Bob Tyrrell, to determine what use they might be able to make of the.Youth Bureau Summer Job Program and report their conclusion to the Mayor who, in turn, will communicate with the Youth Bureau. Unanimously passed. 90 Minutes of Regular Meeting - 6/21/82 page 2 Mayor Marcham brought to the Board's attention, a letter from Mr. Lindenbaum in which he states that the Village has not paid rent for use of the Cayuga Heights School for the past year and also that the Village has yet to sign a lease. Attorney Sovocool reported that the signed lease is ready to be submitted to the School District for their approval. Motion made by Trustee Bennett, seconded by Trustee Robinson: RESOLUTION 3294 - SUBMIT LEASE TO SCHOOL DISTRICT FOR APPROVAL VOTED to authorize the Mayor to sign and submit the lease between the Ithaca City School District and the Village of Cayuga Heights to the School District for approval:,'and fur- ther to pay the bill in the amount of $1200 to cover the rent at the Cayuga Heights School for the period July 1, 1981 through June 30, 1982. Unanimously passed. Mayor Marchem was instructed to write to Mr. Linenbaum in response to the latter's recent letter advising of a rent increase, stating that the Village accepts the terms of the new rental agreement in the amount of $110.00 per month. This letter, together with the signed rental agreement and the lease, will be hand- delivered to the School District in a day or two. Mayor Marcham referred to a recent notice from the Tompkins County Department of Planning regarding a workshop on using the 1980 census, the main objective of which is to use cen- sus information for .planning, programming and other application. Motion made by Trustee Robinson, seconded by Trustee Bennett: RESOLUTION 3295 - CLERK AUTHORIZED TO ATTEND WORKSHOP ON USING THE 1980 CENSUS VOTED to authorize the Clerk to attend the Workshop On Using the 1980 Census, to be held on Tuesday, June 29, 1982 at the Cooperative Extension Center. Unanimously passed. Mr. Marcham read a letter from Jane Kalter, of Wordpro, requesting a two -year lease upon the expiration of the present one on August 31, 1982. She requests also. that the existing monthly rental of $375 remain fixed in return for The Wordpro undertaking several "per- m nent capital improvements" to the premises. Motion made by Trustee Anderson, seconded by Trustee Robinson: RESOLUTION 3296 - AUTHORIZE ATTORNEY TO DRAW UP LEASE WITH THE WORKPRO FOR TWO YEARS WITH POSSIBLE SUB -LEASE AND RENT TO REMAIN FIXED VOTED to authorize the Attorney to draw up a lease with TheWordpro for an extension of two years providing for a possible sub -lease with Village approval and that the rent shall remain at the monthly rate of $375 in return for The Wordpro undertaking several permanent and specified capital improvements to the premises. Unanimously passed: _ x�t* Warren Buck presented the Fire Chief's report in the latterr's absence. Treasurer Wheeler had no report for the month. Police Chief McEwen presented his report and it is on file in the Village Office. Minutes of Regular Meeting - 6/21/82 page 3 V� Motion made by Trustee Bennett, seconded by Trustee Anderson: RESOLUTION 3297 - AUTHORIZE SALE OF USED POLICE CAR VOTED to authorize the sale of the used 1980 Chevrolet Malibu police car for a minimum price of $3200. Unanimously passed. Attorney Sovocool reviewed with the Board a draft of a proposed Local Law prohibiting open beverage containers in public places in the Village. Motion made by Trustee Robinson, seconded by Trustee Bennett: RESOLUTION 3298 - HOLD PUBLIC HEARING TO CONSIDER PROHIBITION OF OPEN ALCOHOLIC BEVERAGE CONTAINERS IN PUBLIC PLACES VOTED to hold a Public Hearing at 7:15 p.m., July 19, 1982 to consider the adoption of a Local Law to prohibit open alcoholic beverage containers in public places in the Village of Cayuga Heights. Unanimously passed. *a* Attorney Sovocool reported on the status of the zoning violation concerning the Morusty prop- erty at 2112 N. Triphammer Road, stating that he had received two affidavits indication that there has been a long -term usage of three units in the main building and 1 unit in the back building. He stated further that it is his understanding that Mr. Morusty intends to divide the property into two separate parcels. The board agreed, however, that any attempt by Mr. Morusty to resolve his zoning problem-would not absolve him of his obligation for back charges due. Mr. Morusty has been charged for three sewer units annually. Engineer /ZO John Rogers gave his report and it is on file in the Village Office. In connection with the $290 bill submitted by Pickard & Anderson for unauthorized work associated with the sludge disposal permit, the Board agreed it should not be paid. Motion made by Trustee Robinson, seconded by Trustee Anderson: RESOLUTION 3298 - AUTHORIZE CLERK TO SEND COPY OF RESOLUTION RE PAYMENT OF BILLS TO PICKARD & ANDERSON VOTED to authorize Clerk to send Pickard & Anderson a copy of the resolution which was adopted by the Board at a previous meeting regarding the payment of their bills and further, to inform them that the bill now presented to the Village in the amount of $290 represents actions under= taken after the Board of Trustees had agreed with them that their work for the Village was finished. Unanimously passed. Motion made by Trustee Anderson, seconded by Trustee Bennett: RESOLUTION 3299 - ACCEPT BID FROM ARSENAULT'S TRACTOR SALER, INC. FOR TRACTOR -MOWER VOTED to accept the bid from Arsenault's Tractor Sales, Inc. for a John Deere tractor -mower at a cost of $12,934.40 with trade df the used tractor - mower. Unanimously passed. C0 Minutes of Regular Meeting - 6/21/82 page 4 The following bids were rejected: Bruce's Equipment - $14,295.00 (Zetor); $15,487.13 (Kubota); B &L Equipment Inc. - $14,872.00 S.C. Hansen Inc. - $16,701.00 S.K. & M. Implement Corp. - $18,483.00.' Engineer Rogers is instructed to forward a copy of MacDowell's survey of the east line of the Village to Town of Ithaca. Engineer Rogers stated he will have information concerning Village Hall rewiring at the July meeting as well as information concerning whether or not the State will allow the use of asphalt vs. concrete for the sidewalk on E. Upland Road. He stated further that he will have specifi- cations drafted for the laying of the sidewalk and removal of trees at that same meeting. Motion made by Trsstee Bennett, seconded by Trustee Anderson: RESOLUTION 3300 - AUTHORIZE ENGINEER TO ARRANGE FOR REPAIR TO EXTERIOR OF VILLAGE HALL VOTED to authorize the Engineer to arrange for work that he deems necessary on the wood trim on the exterior of.the Village Hall at a cost not to exdeed $1000. Unanimously passed. Motion made by Trustee Robinson, seconded by Trustee Anderson: RESOLUTION 3301 - AUTHORIZE REFUND TO WILLIAM EDELMAN FOR OVERPAYMENT OF WATER BILL DUE TO BILLING ERROR VOTED to authorize a refund of $33.58 to William Edelman of 1 Pleasant Grove Lane for the overpayment of his water bill due to a billing error by Bolton Point. Unanimously passed. Meeting adjourned at 10 p.m. VILLAGE OF CAYUGA HEIGHTS Anne Krohto Clerk MINUTES of a PUBLIC HEARING duly published and posted, held July 19 1982, 1982, at 7:15 p.m., in the Village Hall to consider the adoption of a Local Law entitleG "Open Alcoholic Beverage Container Prohibition" PRESENT: Mayor F.G. Marcham; Trustees David Allee, Ronald Anderson, James Bennett, David Pimentel, Jean Robinson; Attorney Roger Sovocool; Treasurer Gordon Wheeler; Engineer /Z.O. Rogers. ABSENT: Trustee Shailer Philbrick; Police Chief Harlin Mc Ewen; Fire Cheif Francis Miller. OTHERS PRESENT: Sgt. Larry Cooper; Warren Buck; Ivar Jenson. Mayor Marcham opened the Public Hearing by reading the proposed Local Law. The Attorney stated that it met the requirements of the law and that the only possible area of conflict would be the Cornell playing fields on Triphammer Road which might 6/21/82 and 7/19/82
