PRESENT: Mayor F.G. Marcham Trustees David Allee Ronald Anderson Shailer Philbrick David Pimentel Jean Robinson Stanley Warren Attorney Roger Sovocool Treasurer Gordon Wheeler Police Chief Harlin McEwen ABSENT: Engineer /Zoning Officer John Rogers. t OTHERS PRESENT: Fire Department member Francis Miller, Mr. Gary Lindenbaum, Mr, and Mrs. Robert Matyas, Dr. and Mrs. Richard Salerno, Mr. and Mrs. James Bennett, Bonnie MacDougall, Molly Shoemaker, Nancy Cramer, numerous other residents; Ithaca Journal representative, Pat Braus. Motion made by Trustee Philbrice, seconded by Trustee Anderson: VOTED to approve the minutes of a regular meeting held January 19, 1981 as previously , furnished Trustees in mimeographed form. Unanimously passed. x�rx Motion made by Trustee Pimentel, seconded by Trustee Warren: VOTED to approve the Abstract of Audited Vouchers dated February 16, 1981 in the following amounts: General Fund - $9,172.81; Sewer Fund - $14,993.49. Unanimously passed. Mayor Marcham read his report which described the major part of his activities during the past month as those having to do with discussions concerning the use of the Cayuga Heights School, not only with Villagers but also with Mr. Lindenbaum and Mr. Butler of the School Administration. This report is on file in the Village Office. There was long discussion between Village residents, Mr. Lindenbaum, and the Board concerning the use of the school building and, in particular, the news that the Ithaca School Board might bring into the school a group of school children ages 12 to 15 who have been judged to be unacceptable in other Ithaca schools. They would share the school space and the playground with the existing tenants. The.Villagers expressed strong opposition to such a policy, particularly in view of the fact that the present tenants would consist of two kindergarten groups and 35 young adults with physical and mental handicaps. Discussion then turned to possible use of part of the building as a social center for Villagers. Mr. Lindenbaum said he would recommend such a use when the Villagers could organize a program and present it to him. 2/16/81 R11 Motion made by Trustee Allee, seconded by Trustee Robinson: e RESOLUTION 3158 - INSTRUCT MAYOR TO APPOINT COMMITTEE TO WORK OUT PLAN FOR VILLAGERS' USE OF SCHOOL VOTED to instruct Mayor Marcham to appoint a committee to work out the details of a plan for Village of Cayuga Heights's use of the Cayuga Heights School building and to bring such a plan to the Village Board for endorsement. Unanimously passed. * x r Mayor Marcham referred to an application from the Montessori Elementary School. Motion made by Trustee Robinson, seconded by Trustee Pimentel: RESOLUTION 3159 - APPROVE APPLICATION FROM MONTESSORI FOR SPACE IN CAYUGA HEIGHTS SCHOOL VOTED to authorize use of the Cayuga Heights School building by Montessori Elementary School, according to the schedule and the terms set forth in the application to the Ithaca School District by the Montessori School. Unanimously passed. * r The Board considered a proposal that the Stanley H. Kaplan Company be allowed to use part of the school building for conducting training sessions for pre - professional exams. Motion made by Trustee Pimentel, seconded by Trustee Warren: RESOLUTION 3160 - APPROVE APPLICATION FROM STANLEY H. KAPLAN EDUCATIONAL CENTER FOR SPACE IN CAYUGA HEIGHTS SCHOOL VOTED to accept the Stanley H. Kaplan Educational Center's application for use of the Cayuga Heights School building with the understanding that a Village plan for use of the remaining school space in the building to be submitted to the School Board and that this plan, after approval by the Village Board, receive top priority for any further use of the remaining space within the school itself. No vote taken. Motion made by Trustee Allee, seconded by Trustee Philbrick: RESOLUTION 3161 - DEFER ACTION ON AFOREMENTIONED RESOLUTION 3160 VOTED to defer taking action on the Stanley H. Kaplan application until such time that the Mayor is able to arrange a meeting with Mr. Lindenbaum to discuss with him a Village plan for the use of the remaining space in the Cayuga Heights School. No vote taken. After some discussion, Resolution 3160 was adopted with five votes in favor, Trusbee Allee opposed. Mayor Marcham referred to a request from the Ithaca City School District for per- mission to use the Fire Hall as a polling place for the annual School Board election on May 5, 1981. 2/16/81 10 I Motion made by Trustee Pimentel, seconded by Trustee Robinson: RESOLUTION 3162 - GRANT PERMISSION TO ITHACA CITY SCHOOL DISTRICT TO USE FIRE HALL FOR POLLING PLACE VOTED to grant permission to the Ithaca City School District to use the Fire Hall as a polling place for the annual School Board election on May 5, 1981, and to instruct the Mayor to advise them that discretion be exercised in connection with the use of the telephone in the Fire Hell, since calls are paid for on a message unit basis. Unanimously passed. Lagrand Chase's request for permission to develop Lot No. 11 on Pleasant Grove lane was denied on the basis that the dimensions of the lot as shown on his drawing were not clear and the Board decided that the Engineer, upon his return, will review the plan and make a recommendation. Board members received copies of a letter from Charles E. Treman, Jr., in which he states his concerns about the flooding of his property at 876 Highland Road when Remington Creek overflowed its banks.during a recent rainstorm. The Board discussed at some length the engineering aspects of the problem. Mayor Marcham is instructed to write to Mr. Treman to inform him of the Board's action and to advise him that he will be kept informed of the progress made in the study. Motion made by Trustee Philbrick, seconded by Trustee Pimentel: RESOLUTION 3163 - INSTITUTE ENGINEERING STUDY OF FLOODING PROBLEM IN I THE AREA OF THE TREMAN HOUSE VOTED to institute an engineering study of the flooding problem in the neighborhood of the Charles Treman, Jr, house at 876 Highland Road. Unanimously passed. Mayor Marcham referred to a letter from Mr. Paul Komar, General Manager of NYSEG concerning a proposed tariff that would cover Village street lighting service. Motion made by Trustee Philbrick, seconded by Trustee Robinson: RESOLUTION 3164 - PROPOSED TARIFF RATE BY NYSEG FOR STREET LILTING SERVICE VOTED that the issues raised in Ms. Komar's letter regarding proposed tariff rate for street lighting service be referred to the Police Chief, Treasurer, and Public Safety Committee for study and report back to the Board. Unanimously passed. * a c Motion made by Trustee Philbrick, seconded by Trustee Warren: RESOLUTION 3.165 - PUBLIC HEARING - FEDERAL REVENUE SHARING FUNDS VOTED to hold a Public Hearing at 4:00 p.m. on March 9, 1981 in the Village Hall to consider the use of Federal Revenue Sharing funds, as required by law. Unanimously passed. Report of the Fire Department was presented and is on file in the Village Office. The Board accepted the Treasurer's eight months' report and it is on file in the Village Office. 1 1 11 Motion made by Trustee Pimentel, seconded by Trustee Anderson: RESOLUTION 3166 - ACCEPT TRANSFERS VOTED to accept transfers as follows: Unanimously passed. Motion made by Trustee Anderson, seconded by Trustee Philbrick: RESOLUTION 3167 - BOARD MOVED TO EXECUTIVE SESSION VOTED to go into Executive Session at 10:20 p.m. to discuss a personnel matter. The Board reconvened at 10:25 P.M. Motion made by Trustee Anderson, seconded by Trustee Philbrick: RESOLUTION 3168 - AUTHORIZE CREATION OF SECOND POLICE SERGEANT POSITION VOTED to authorize the creation of a second position of Police Sergeant in the Village of Cayuga Heights Police Department effective April 3, 1981. Unanimously passed. Motion made by Trustee Anderson, seconded by Trustee Robinson: RESOLUTION3169 - APPOINT DAVID WALL TO SECOND POLICE SERGEANT POSITION VOTED to appoint to the second Police Sergeant position, David Wall, who is presently on a Civil Service eligibility list, effective April 3, 1981 at an annual salary of $15,325, and also to authorize the Mayor to sign the appropriate papers. Motion made by Trustee Pimentel, seconded by Trustee Allee: RESOLUTION 3170 - AUTHORIZE ENGINEER TO PREPARE SPECIFICATIONS AND TO ADVERTISE FOR NEW PICKUP TRUCK VOTED to authorize the Engineer to prepare specifications and to advertise for bids for a new pickup truck, which will be available for consideration by the Board at the March meeting. OTHERS'PRESENT: Numerous Village residents; representative from the Ithaca Journal Motion was made and seconded from the floor that the Mayor and Clerk serve as Chair- man and Secretary of the meeting.
