MINUTES of a PUBLIC HEARING held August 18, 1980 at 7:15 p.m. in the Village Hall to
consider a change in the Law on Real Property Tax Exemption for theElderly regarding
the increase in the maximum income limit from $8,000 to $9,200.

Mayor Marchem opened the Public Hearing by stating the intent of the hearing and
that a notice had been duly published in the Ithaca Journal. Since there were no
public comments on the subject, the hearing was declared closed at 7:25 p.m.
MINUTES of a Regular Meeting of the Board of Trustees of the Village of Cayuga
Heights held August 18, 1980 at 7:25 p.m, in the Village Hall.

Motion made by Trustee Anderson, seconded by Trustee Robinson:
VOTED to approve the minutes of a regular meeting held July 21, 1980 as previously
furnished Trustees in mimeographed form, with a correction to Resolution 3088 to
read "leather cases at a cost of $12.50 each ". Unanimously passed.
Motion made by Trustee Robinson, seconded by Trustee Pimentel.
VOTED to approve the Abstract of Audited Vouchers dated August 18, 1980 in the
following amounts. General Fund - $26,520.13; Sewer Fund - $11,153.38. Unanimously
passed.
Randy Chase appeared before the Board in connection with a denial by the Zoning
Officer of a request from Lagrand Chase for a building permit for not No. 4 on
Pleasant Grove Lane. The denial was based on what appears to be the existence of
an illegally constructed driveway to Pleasant Grove Road on Lot No. 2. A portion
of Mr. Chaser's letter to the Board concerning the status of this driveway was
changed by Randy Chase at the Board's request to read in effect that the opening to
Pleasant Grove Road on Lot No. 2 will never be used as an entrance and that it will
be restored to lawn and shrubbery. On this assumption, the Zoning .fficer is
authorized to issue a building permit for Lot No. 4 to Lagrand Chase.
Mayor Marcham gave his report and it is on file in the Village Office.
Mr. Gary Samuels of Intersystems, Inc., manufacturer of microcomputers, spoke briefly
about his company's wish to expand its facilities and expressed an interest in
renting space in Cayuga Heights School.
In regard to zoning issues which arise in connection with the rental of space in
Cayuga Heights School, Attorney Sovocool will prepare a legal memo for circulation
to Board members outlining several cases which have dealt with the question; what
are the rights of the School Board regarding the rental of its property in the
Village?
In response to strong protests by several residents relative to the leasing in the
Cayuga Heights School to Ithaca Intersystems for a light industry operation, the
Board will explore the possibility of persuading the School Board to allow Villagers
to use some parts of the school building for informal meetings, recreation, and
similar events.
The Mayor will consult with Mr. Backer to discover what the attitude of the School
Board and Administration is toward leasing the Cayuga Heights School.

A request from Mrs. Nellie Hamilton of the Ithaca Stamp Club for permission to
use the Village Hall for its regular meetings was denied based on the uncertain
schedule of meetings of the Village Court and of meetings of the Village Board.
Mayor Marcham is instructed to so advise Mrs. Hamiltion of the Board's decision.
The report of the Fire Chief is on filein the Village Office.

RESOLUTION 3096 - APPROVE PURCHASE OF STEP PLATES AND RAILINGS FOR
NEW FIRE TRUCK
VOTED to approve the purchase of two step plates and railings to be installed on
the new fire truck at a cost not to exceed $250. Unanimously passed.
Treasurer Wheeler reviewed the Year -End Report with the Board and made a correction
to Page 13A, Sewer Fund Checking Acct. Balance, to read $3,079.86.

After long discussion concerning the proposed method of calculating sewer rents
based on water consumption, it was the decision of the Board to make attempts to
improve upon the current system and to abandon the concept of the "family unit" as
defined in the Ordinances and to apply figures associated with living units as are
presently being used in the water district. The Clerk is instructed to ascertain
whether or not the Water Commission has figures for living units for properties,
both inside and outside the Village, connected to the sewer system and, if so, to
make a comparison between total numbers of units which the Water Commission states
are in existence and the number of units for which the Village is now charging.
The Report of the Police Chief is on file in the Village Office.
Trustee Anderson, in the absence of Police Chief McEwen, referred to a letter from
David Corson, President, Pleasant Grove Lane Residents' Association, in which he
requests that the Village install the single, standard Pleasant Grove Lane sign and
not the standard Pleasant Grove Road cross sign.
Motion made by, Trustee Anderson, seconded by Trustee Philbrick:
RESOLUTION 3099 - GRANT PERMISSION TO INSTALL SINGLE SIGN AT
PLEASANT GROVE LANE
VOTED to grant the request of the Pleasant Grove Lane Residents' Association to
have installed a single, standard sign at the entrance to Pleasant Grove Lane and
not the standard Pleasant Grove Road cross. sign. Unanimously passed.
In connection with a request from Marc Cramer of Cayuga Heights Road that a
directional sign be installed-on Cayuga Heights Road to indicate the turn onto
Renshaw Road /Community Corners, in an effort to eliminate the nuisance of drivers
turning around in his driveway after they realize they have missed the turn onto
Hanshaw Road, Police Chief McEwen is instructed to explore possibilities and cost
of such a sign.
Police Chief McEwen asks permission to use the $1550 in the 1980 -81 Budget allocated
for school crossing guards, toward part -time officers' salaries to work off compen-
satory time accumulated by Police Officers.
Motion made by Trustee Anderson, seconded by Trustee Philbrick:
RESOLUTION 3100 - SCHOOL CROSSING GUARD MONEY USED TO WORK OFF
COMPENSATORY TIME OWED POLICE OFFICERS
VOTED to authorize the Police Chief to inquire into the possibility of using school
crossing guard money as a means of dealing with the problem of compensatory time
that is already owed the Police Officers. Unanimously passed.

Motion made by Trustee Robinson, seconded by Trustee Anderson:
RESOLUTION 3100 - INCOME ELIGIBILITY SET AT $9200 FOR HOMEOWNERS AGED 65
AND UP AS PROVIDED BY AMENDMENT OF SECTION 467 - REAL
PROPERTY TAX LAW
VOTED that where the owner or owners of a piece of property in the Village of Cayuga
Heights is or are 65 years of age or over, has or have owned the property for 24
consecutive months, the property being situated in the residential area of the
Village, and where such person or persons has or have an income of $9200 per annum
or less, such person or persons shall be exempt from paying 50% of the real pro-
perty tax of the Village as it relates to the aforementioned property, as provided
by amendment of Section 467 of the Real Property Tax Law. Unanimously passed.
Attorney Sovocool had no report.
In connection with the Program for Safer Roads and Streets, the Board decided that
the $31,212 awarded by the State plus the additional $10,414, Village contribution,
should be used first to replace the culvert under North Triphammer Road at Winthrop
Drive, second, to build a new sidewalk along Pleasant Grove Road, and third, to
allocate any remaining funds to the installation of new sidewalks around the
Corners and Village Hall area.
The agreement which was drawn up following Resolution 3073 was not accepted by Mr.
and Mrs. Michael King, who substituted for it an agreement of their own under which
the Village would be responsible for maintaining the swale which was intended to
solve the water drainage problem on their property. The Board decided to go no
further in this matter.
Motion made by Trustee Philbrick, seconded by Trustee Anderson:
RESOLUTION 3102 - AUTHORIZE PURCHASE OF SIDEWALK FORMS
VOTED to authorize the Engineer to purchase 100 feet of sidewalk forms and related
materials at a cost not to exceed $900. Unanimously passed.

Mayor Marcham is instructed to write to Mr. D.W. Singley to advise him that all
actions taken in the past by the Engineer and the work force in an attempt to
help him solve his water drainage problem did not constitute an acceptance by the
Village of responsibility but were rather an attempt to help a Villager faced
with difficulties regarding the drainage of his property.

RESOLUTION 3103 - APPROVE ATTENDANCE AT TRAINING SCHOOL
1 VOTED to approve the attendance of the Treasurer and Clerk at the 25th Annual
Training School for Fiscal Officers and Municipal Clerks, September 30 - October 3
1980 to be held at Grossinger's Hotel, Grossinger, N.Y., co- sponsored by New
York Conference of Mayors and Office of State Comptroller. Unanimously passed.

RESOLUTION 3104 — APPROVE PURCHASE OF ENVELOPES
VOTED to approve the purchase by the Police Department of 500 regular envelopes at
a cost of $83.00 and 500, 6 -3/4" envelopes at a cost of $82.00, since, due to an
oversight, the envelopes purchased last month omitted the printing "Police Depart-
ment" and these will be used in the Clerk's Office. Unanimously passed.
