Johnson, Beth Northrop, Mr. and Mrs. Francis Davis, Mr. Anil Nerode, numerous Village residents, representative from the Ithaca Journal. Mayor Marcham opened the Public Hearing by stating the intent of the hearing and that a notice had been duly published in the Ithaca Journal. The several people who spoke were in favor amending the Zoning Law to include the conducting of a Family Day Care Home and were opposed to State licensing as a requirement. After much discussion concerning licensing, fire safety requirements, and the like, the Public Hearing was declared closed at 8:30 p.m. MINUTES of a Regular Meeting of the Board of Trustees of the Village of Cayuga Heights held December 17, 1979 at 8:30 p.m. in the Village Hall. Motion made by Trustee Anderson, seconded by Trustee Pimentel: VOTED to approve the minutes of a Public Hearing and a regular meeting held November 19, 1979 as previously furnished Trustees in mimeographed form with the following corrections: 1) To include in Resolution 2294 - Designating Offices to be Filled and Terms of Office for March 1980 Elections, that of Village Justice for a term of four years, and 2) to alter Resolution 2996 - Accei]t Bid for Fire Truck of Sanford Apparatus Corp. as follows: "...because the other bids did not match the specifications as outlined by the Fire Council." Unanimously passed. ' Motion made by Trustee Pimentel, seconded by Trustee Warren: VOTED to approve the Abstract of Audited Vouchers dated December 17, 1979 in the following amounts: General Fund - $11,291.85; Sewer Fund - $13,254.46. Unanimously passed. 1,03 ' Motion made by Trustee Pimentel, seconded by Trustee Allee: RESOLUTION 3004 - AMEND ARTICLE IX, SECTIONS 8 AND 9 OF VILLAGE ORDINANCES VOTED to amend Article IX, Sections 8 and 9 to read as follows: Section 8 - Porches, Decks, and Carports. In determining the percentage of building coverage of a lot or the size of yards for the purpose of this ordinance, porches, decks, or carports open at the sides, but roofed, shall be included in the building coverage. Unroofed porches or decks, the surface of which is over two feet above the surface of the underlying ground as finally graded shall also be included in the said determina- tion. In cases where the proposed grade line of the ground is higher than the existing ground, the change of grade must be approved by the Zoning Officer at the time of issuance of the zoning permit. Section 9 - Fences and Walls - delete unroofed porches. Unanimously passed. Motion made by Trustee Philbrick, seconded by Trustee Allee: RESOLUTION 3005 - CROSS - CONNECTION CONTROL - LOCAL LAW NO. 1 of 1979 voted to adopt the following Local Law No. 1 of 1979 entitled "Model Local Ordinance for Cross- Connection Control" as presented by the S.C.L.I.W.C. and sent to the Village Clerk's Office on March 30, 1979. This Local Law is to take effect upon publication. (Copy attached in Minute Book). Unanimously passed. It was reported by Attorney Sovocool that the Village -owned strip of land at the end of Cambridge Place can indeed be sold at private sale and stated that it is not a requirement to advertise for its sale. He suggested that an appraisal of the property be made. Motion made by Trustee Warren,.seconded by Trustee Mee: RESOLUTION 3006 - MAYOR AUTHORIZED TO HIRE APPRAISER VOTED to authorize the Mayor to hire an appraiser to determine the value of -the piece of land owned by the Village at the end of Cambridge Place. Unanimously passed. * � r Mayor Marcham gave his report and it is on file in the Village Office. Mayor Marcham read a letter from Mr. Charles J. Collins, Tax Representative from New York State Electric and Gas Corp, regarding the additional 1% municipal gross receipts tax that Village residents are paying for their electric and gas usage. The Board decided to take no action on the matter. 12/17/79 104 TThj�e Mayor, upon receipt of additional memo and informational materials from the Bllreau of the Census, referred once again to the April 1, 1980 Census of Population and Housing. The Board again recommended that the Mayor, in his next letter to the Villagers, inform them that it is to the great advantage of the Village and to individual taxpayers that the figures as to population be as complete as possible. FireChief Lowell George gave his report and it is on file in the Village Office. Fire Chief George reported that the Fire Council requests approval to execute a contract for radio service since their inventory of radio equipment has increased considerably. Motion made by Trustee Philbrick, seconded by Trustee Anderson: RESOLUTION 3007 - RADIO SERVICE CONTRACT APPROVAL FOR.FIRE AND POLICE DEPARTMENTS VOTED to grant the requests of the Fire Chief and Police Chief to negotiate a con- tract for radio maintenance and repair with Finger Lakes Communications Co. to run from January 1, 1980 through May 31, 1980, with renewal on June 1, 1980 for the fiscal year 1980 -81; and also, to authorize the Mayor to sign the contracts. The cost to the Fire Department will be $132.00 per month for a total of $660.00 and the cost to the Police Department will be $18.00 per month for a total of $90.00. Unanimously passed. Police Chief Harlin Mc Ewen gave his report and it is on file in the Village Office. 12/17/79 � Us Enginee /Z.O. Rogers gave his report and it is on file in the Village Office. Engineer Rogers presented to the Board, plans submitted to him by Gowdy and Hunt, Engineers for the Village of Lansing sewer line project. He reported that it seemed evident to him at this time that the Village of Lansing still plans to use sections of the Village of Cayuga Heights sewage system to carry sewage to the treatment plant. Engineer Rogers was instructed to inform Gowdy and Hunt that the Village of Lansing will have to provide a liability bond so that the Village of Cayuga Heights will be protected if the need arises for them to go through privately owned property. The Engineer r@ferred to a report submitted to him by Gary Gleason, Sewer Plant operator, and was instructed to duplicate this report for mailing to Trustees. In answer to Mr. Gleason's request to have Board members tour the sewer plant, Mayor Marcham suggested early as a possible time to do this. Mayor Marcham announced the retirement of Kenneth Myers, one of the representatives on the S.C.L.I.W.C., and the Board recommended to Mayor Marcham that he ask if Professor Charles D. Gates would be willing to serve as one of the Village repre- sentatives. Motion made by Trustee Warren, seconded by Trustee Robinson: RESOLUTION 3009 - AMEND ARTICLE IX, SECTION 2, Th TO INCLUDE CONDUCTING A FAMILY DAY CARE HOME VOTED to amend Article IX, Section 2,Tb, to include in the list of customary home occupations, the conducting of a Family Day Care Home, in accordance with the Social Services Law of the State of Naw York.
