Sovocool Police Chief Harlin R. McEwen Fire Chief Lowell T. George ABSENT: Engineer /Z.O. John B. Rogers OTHERS PRESENT: Professor William A. Wimsatt and Professor Herbert W. Briggs, Jan Zahler, WHCU representative. Mayor Marcham opened the meeting by making reference to correspondence received from Messrs. Wimsatt and Briggs relating to a piece of metal pipe running westerly from Highland Road to the point where the Wimsatt and Briggs houses are each attached thereto and whether this pipe is a water main or a water lateral and whether repairs necessary to this line should be paid for by the Village or by Messrs. Wimsatt and Briggs. Mr. Briggs presented their case and they were advised that as soon as the Board comes to a decision, Mayor Marcham will write to them. Moved by Trustee Phllbrick, seconded by Trustee Anderson: VOTED to approve the minutes of a regular meeting of the Board of Trustees held December 18, 1978 as previously furnished Trustees in mimeographed form. Unani- mously passed. I Moved by Trustee Philbrick, seconded by Trustee Pimentel: VOTED to approve the Abstract of Audited Vouchers dated January 15, 1979 in the following amounts: General Fund - $29,044.78; Sewer Fund - $21,773.16. Unanimously passed. Mayor Marcham gave his report and it is on file In the Village Office. Mayor Marcham reported that he, Trustees Allee and Anderson, and Engineers Rogers met with the Town Planning Board on Tuesday, January 9, and presented the Engineer's rough sketch of a plan for the Jonson development of the Texas Lane Area. He stated that they were able to persuade the Board to consider the plan and the Town Engineer was instructed to discuss it with Mr. Jonson. After meeting with Mayor Marcham, and Trustee Anderson, on January 11, Jonson and his assistant have agreed to "sit tight" until they have talked wto Engineer Rogers upon his return to Ithaca. After some discussion concerning sewer rent unit charges and sewer rent question- naires recently sent to owners of multiple dwellings which use the Village sewer. 36 ... , t system, the Board decided that the matter should be investigated further before ' changes can be made for the year 1979 -80. In the meantime, the Mayor is instructed to write to those who have not supplied the information, stating that the Village Board is authorized to make its own estimate of the sewer use in each building served by the Village sewer system. If they wish to protest, they may appear before the Village Board and offer evidence.to justify their protest. Motion made by Trustee Pimentel; seconded-by Trustee Anderson: RESOLUTION 2895 - APPOINT COMMITTEE TO STUDY SEWER RENT UNITS VOTED to appoint a committee to study the proper means of establishing sewer rent units in the Village and surrounding areas served by the Village of Cayuga Heights sewer system. Unanimously passed. Motion made by Trustee Allee, seconded by Trustee Randolph: RESOLUTION 2896 - INSPECTORS OF ELECTION VOTED to approve the Mayorfs appointment of Inspectors of Election as follows: Irene Homa as Chairman and Clara Daino as the other inspector of election. The alternates are Evelyn Curran and Theresa Ross. Unanimously passed. Motion made by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2897 - REGISTRATON AND ELECTION TIMES AND DATES VOTED that Registration Day shall be Saturday, March 3, 1979 between the hours of 12:00 noon and 9:00 p.m. in the Village Hall; Election Day shall be on Tuesday, March 20, 1979 from 12:00 noon to 9:00 p.m. in the Village Hall, 836 Hanshaw Road. Unanimously passed. pit* Motion made by Trustee Randolph, seconded by Trustee Allee: RESOLUTION 2898 - NOMINATING COMMITTEE VOTED to authorize Mayor Marcham to appoint a Nominating Committee for the forth- coming elections. Unanimously passed. Moved by Trustee Anderson, seconded by Trustee Pimentel: RESOLUTION 2899 — ANNUAL MEETING DATE -- . VOTED to hold :the Annual Residents Meeting on Tuesday, February-20, 1979 at 7;30 p.m. in the Village Hall to hear- the;annual reports of the various departments of the Village. Unanimously passed. Motion made by Trustee Pimentel, seconded by Trustee Warren: 37 RESOLUTION 2900 - DOG CONTROL CONTRACT VOTED to authorize Mayor Marcham to sign a new contract with the Town of Ithaca for dog control service for 1979. Unanimously passed. Motion made by Trustee Allee; seconded by Trustee Randolph: RESOLUTION 2901 - APPOINT PERSON TO LOCAL ADVISORY BOARD OF ASSESSMENT REVIEW. VOTED to authorize the Mayor to appoint a member on the Local Advisory Board of Assessment Review. Unanimously passed. Mayor Marcham read a letter from Mr. Lewis Morse in which he states that since he did not receive a water bill for the previous quarter he should be sent a corrected water bill deleting the penalty charge of $4.41. The Mayor read a letter, also, from William Streett in which he states that since the water bill for the previous quarter had been sent to the previous owner, he requests that the penalty of $3.86 be removed from his bill. ' Mayor Marcham read a portion of a resolution adopted by the Tompkins County Board of Health at its regular meeting held January 9, 1979 concerning plans for a septic tank pumping disposal facility at the Cayuga Heights Sewage Treatment Plant. Trustee Allee and Attorney Sovocool stated that Frank Liguori, Commissioner for Planning, has all the Information and there Is nothing further for the Village to do. Fire Chief Lowell T. George gave his report and it is on file In the Village Office. Motion made by Trustee Pimentel, seconded by Trustee Warren: RESOLUTION 2903 - FIRE DEPARTMENT TO PURCHASE ANTENNA MAST VOTED to authorize the Fire Department to purchase an antenna mast to be attached to the existing antenna pole for radio antennae at the Fire Station at a cost not to exceed $200.00. Unanimously passed. 1 79 Motion made by Trustee Allee, seconded by Trustee Anderson: RESOLUTION'2902 - DENY PENALTY'REMOVAL FROM WATER USE BILLS VOTED to authorize Mayor Marcham to write to Mr. Morse and Mr. wtreett advising them that it is the Board's decision that their penalties in the amounts of $4.41 and $3.86, respectively, cannot be waived. Unanimously passed. 1 79 i Motion made by Trustee Randolph, seconded by Trustee Philbrick: RESOLUTION 2904 - 1978 TAX WARRANT VOTED that the Treasurer has returned his 1978 Tax Warrant and Account of Uncol- lected Taxes filed with the Clerk as required by Real Property Tax Law. The Trustees have certified the list of unpaid taxes as presented by the Certificate of the Treasurer and filed the same with the Clerk showing a balance of $3,256.70 without penalties. The Trustees returned the account of unpaid taxes to the Treasurer for collection as required by Real Property Tax Law in the amount of $3,256.70. Unanimously passed. Motion made by Trustee Randolph, seconded by Trustee Philbrick: RESOLUTION 2905 - TAX SALE VOTED that the unpaid taxes on the properties on LIST OF OVERDUE TAXES AS OF JANUARY I, 1979,,be advertised for sale in issues of the official newspaper on February 10, 17, and 24, 1979 to recover unpaid taxes in the amount of $3,256.70 as listed. The Tax Sale to be held at 10:00 a.m.,'March 3, 1979, In the Village Hall. Unanimously passed. Chief McEwen gave his report and it is on file in the Village Office. Attorney Sovocool reported that he had received a copy of a draft of the proposed amended, supplemental, restated; and consolidated agreement of municipal coopera- tion for the Bolton Point transmission and supply systems, the principal effect of which is to bring the Village of Lansing in as a fully participating member of the Commission. As one of the Village representatives in the Intermunicipal Water Commission, Sheller Philbrick reported having attended a meeting on December 4, 1978 at which the language was worked out. Trustee Philbrick stated the changes in the document are satisfactory to him. The proposed draft is to be approved by the Village Attorney and reviewed by the Village Board prior to authorization of the Mayor's signature. In the absence of the Engineer, the Mayor presented the Engineer's Report which is on file in the Village Office. In view of the continuing problems with the outfall pipe at the sewer plant, Attorney Sovocool suggested that a'report from the engineers, Teetor - Dobbins, might be in order stating that the pipe has been examined and, In their opinion, It complies with engineering standards and will not cause problems In the future. The Mayor is instructed to discuss this with Engineer Rogers. 1/19/79 t 1 39 The Board reafflrmed'•the following list of Village holidays;ithey'are the same i holidays taken by the City refuse crew: New Year's Day Washington's Birthday' Memorial - Day i July 4th Labor Day Columbus Day-- Veteran's Day Thanksgiving Day Christmas The Board decided to table discussion regarding vacation policy until the return of the Engineer. Motion made by Trustee Randolph, seconded by Trustee Pimentel: RESOLUTION 2906 - 'REFUNDS FOR OVERPAYMENT'OF WATER AND SEWER BILLS VOTED to' approve a refund of $91.14 to the Town of Ithaca for duplicate payment-of sewer rental 'biII and also t6 refund the amount of $70.58�to Mr. George Oldfleld " for overpayment of water bill due to incorrect meter reading.
