BOARD OF TRUSTEES
MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga
Heights held September 18, 1978 at 7:30 p.m. in the Village Hall.

OTHERS PRESENT: John Gaines, Director of the Tompkins County Youth Bureau, Otto
Schoenfeld, Theodore Penalver, Michael King, George Conneman.
John Gaines talked about his recent appointment as Director of the Tompkins County
Youth Bureau and explained briefly the functions of the Bureau and how the Village
may participate in funding if it so desires.
Mr. Otto Schoenfeld appeared before the Board requesting permission to substitute
the installation of a swale across Michael King's property at 113 Warwick Place for
the 34" culvert pipe which had been Included In the original Cambridge Place subdi-
vision map in an effort to solve the water drainage problem in that area. The
Clerk was Instructed to get together a copy of Resolution No. 2057 - Cambridge
Place; a copy of the map entitled "Williamsburg Park Subdivision No. 4, dated
October 7, 1969, which is on file in the Village Office; and a copy of Mr. King's
deed.* Mr. Otto Schoenfeld has stated that he will make available to the Village
drawings showing the drainage areas. The Attorney Is instructed to study these
documents and will report his findings at the next meeting of the Board.
Motion made by Trustee Philbrick, seconded by Trustee Randolph:
VOTED to approve the minutes of a regular meeting held August 21, 1978 as previous-
ly furnished Trustees in mimeographed form. Unanimously passed.

O* Mr. Michael King objected to the Installation of a swale and requested that at
least a 30" pipe be Installed so that his property would be the same In appearance
as when he purchased it.

VOTED to approve the Abstract of Audited Vouchers dated September 18, 1978 in the
following amounts: General Fund - $20,581.54; Sewer Fund - $11,860.50; Capital
Fund - $41,840.00. Unanimously passed.
Mayor Marcham read a letter from Mr. Clement Rosetti requesting permission to go
beyond the 10:00 p.m. closing hour on New Year's Eve.

RESOLUTION 2871 - APPROVE ROSETTI'S NEW YEAR'S EVE PARTY
VOTED to authorize Mayor Marcham to write to Mr. Clement Rosettl granting him per-
mission to hold a party on New Year's Eve with the following restrictions; namely,
that the party cease no later than 2:00 a.m. and that he not advertise this party
In the press, radio, or television.

and it is on file in the Village Office.

Treasurer Wheeler reported
that at this time
there is an uncollected amount of
$11,000
in property taxes.
He reported also
that his quarterly report
will be on
the old
basis and will be
presented at the next meeting.
Engineer /Zoning Officer John Rogers gave his report and it is on file In the Village
Office.
In regard to the Belcher proposal offered by Fred Thomas Associates at the August
meeting, the Engineer reported that the road would be less than the 50 -ft. right -
of -way required; and as such, would be considered a private road and would not be
the Village's responsibility to maintain. He stated further that Insofar as the
possibility of hooking up Into sewer and water mains is concerned, he could foresee
no problem. The Attorney reported that from the standpoint of the Zoning Ordinance,
the proposed duplex or semi- detached structures do not fit within the confines of
the ordinance and, in fact, are contrary to it. Mr. Belcher will be required to
obtain an "Environmental Impact Statement" if he plans to develop this property.
Mayor Marcham was instructed to write to Mr. Fred Thomas informing him of the
Board's action on the proposal.
Mayor Marcham turned the meeting over to Deputy Mayor Randolph at 9:35 p.m.
Otto Schoenfeld was given permission to apply for a single building permit based
on the accessibility over his land to Burlelgh Drive.
Engineer Rogers recommended that a committee be set up to look Into the implementa-
tion by the Village of a sick leave policy.
Engineer Rogers stated that the Brockway truck had been advertised for sale in the
newspaper and that bids will be received in the Village Office on Wednesday,
September 27, 1978.
Engineer Rogers discussed a proposal for the purchase of a used ten -wheel truck
with a 3000 - gallon tank to be used at the Sewage Treatment Plant for the disposal
of sludge in a wet condition rather than a dry condition at a saving to the Village
of $125 to $150 a week in the use of chemicals.

Sha)ler Philbrick, the Village representative to the S.C.L.I.W.C., reported that
the Bolton Point Water Department, in cooperation with the Fire Department, will be
flushing and testing hydrants and will notify the Clerk as to the schedule to be
used for Cayuga Heights. Trustee Philbrick was Instructed to investigate the cost
of the flow testing and to ask the Water Department to let the Village know when
valves In the lines need replacing so that the Board can authorize necessary action.
Trustee Philbrick was also Instructed to inform Bolton Point that they must have
authorization from the Village before doing work on lateral lines.
Attorney Sovocool reported that he has not as yet received a reply to his second
letter to the New York State Public Service Commission protesting their ruling
concerning the method of charging by utility companies for street lighting on
streets with underground wiring.
Attorney Sovocooi reported having received two notices of claims made against the
Village of Cayuga Heights as follows: (1) CNA insurance Company for damages in-
curred by George E. Treyz, Inc., to a 1968 International van on Devon Road, when it
• collided with a tree limb, and (2) Leonard and Diana Dworsky, 8 Winthrop Drive, a
claim in the amount of $1,000 for damages sustained when a sewer line owned and
maintained by the Village became blocked causing sewage to back up and into their
premises. Police Chief McEwen will supply the Attorney with additional information
from police records to submit to the insurance carrier.

Engineer Rogers was instructed to remove the remainder of the tree on Devon Road
named in the notice of claim from the CNA Insurance Company.
Otto Schoenfeld was denied his request to use the Village's sales tax exemption
qualification in the purchase of materials for the construction of Cambridge Place
roadway and services. Attorney Sovocool, after investigation of the matter, re-
ported that the Village would be setting a precedent if it agreed to do this, and
further, that the Village would appear to be involved in a tax evasion scheme.
Chief McEwen read a letter from Joseph Walker, Division of the New York State
Division for Youth. In his letter, Mr. Walker states that the Village is eligible
for recreation reimbursement of $1600 and youth service reimbursement of $1400 for
youth programs operated by the Village. Since these moneys have to be matched by'
the Village and would entail a great deal of paperwork, Chief McEwen recommended
that the Village decline to make application for these funds for 1979 programs.
Consequently, the Village's state aid eligibility of these amounts becomes avail-
able for the Town of Ithaca or the County. The Board agreed with Chief McEwen's
recommendation, and he is to notify Mr. Gaines of the Board's decision. Chief
McEwen reported that the signs at the entrance to Sunset Park are in need of
replacing - one is missing and the other deteriorating. Chief McEwen will investi-
gate the cost of replacement. He also brought up his concern about the deteriora-
tion of the stone In masonry walls in Sunset Park and suggested that they needed
repairing before winter. Engineer Rogers was Instructed to look into this matter
and determine what needs to be done.

RESOLUTION 2874 - REFUND OVERPAYMENT OF TAXES
VOTED to approve refund to Mrs. Jean A. Smith, 104 Berkshire Road (rear property).
Error on tax bill for Cayuga Heights Sewer front feet - to delete 61 feet for front
footage. Refund due - $13.36. Unanimously passed.
