Minutes 5/15/1978THE VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held May 15, 1978 at 7:30 p.m. in the Village Hall. PRESENT: Mayor F.G. Marcham, Trustees David Allee, Ronald E. Anderson, Rene F. 1andolph, Stanley W. Warren; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen; Fire Chief Lowell T. George. ABSENT: Trustees Shaffer S. Philbrick, David Rimentel. OTHERS PRESENT: Mr. and Mrs. Harry Cornwall, Attorney James Buyoucos, Architect David Taube, Mr. and Mrs. Bernard Goodman, Linda Bors, Florence Bernard, Mrs. Devereux, Mrs. Heasley, Mr. Grant, Connie Lewis, and other Villagers. James Buyoucos, Attorney for the Cornwalls, spoke to the Board regarding the pro- posed use of a building located on the Cornwall property at 803 Hanshaw Road. The Cornwalls wish to construct a building to be used as living quarters on the site of the Carriage House. They have requested that the property, which Is zoned commercial, be divided into two parcels -- the Peggy Cornwall shop on one and the Carriage House on the other -- and wish to have it remain zoned commercial. The Board Instructed the Cornwalls to submit to them a final statement of exactly what they wish to do and the Board will then make a decision. Mayor Marcham referred to a letter he received from BErnard Goodman protesting a recent bill for repairs to a water lateral. After much discussion, the Clerk was • instructed to provide each Board member with photocopies of the correspondence from Mr. Goodman, a sketch map of the area involved, and the report made by the Water Commission regarding repair and inspection of the lateral. Mayor Marcham read portions of a letter he received from several Texas Lane residents regarding the litter problem In the wooded area between Texas Lane, Hanshaw Road, and the Village Green, specifically the 10 foot right -of -way which runs along their adjoining properties. The Village Attorney suggested, in order to learn the history of this right -of -way, that Mrs. Bors bring to the Village office the abstract of title search so he can determine who has ownership. The Mayor will keep Mrs. Bors informed as to the findings. Mrs. Edwina Devereux presented an argument In favor of Challenge Industries picking up glass In Cayuga Heights. The Board will consider this. Mayor Marcham acknowledged the presence of Mrs. Heasley and her attorney, Mr. Robert Grant, who appeared in connection with Mrs. Heasley's request to have her property on the east side of E. Upland Rd. rezoned from residential to multiple residential. Mayor Marcham stated the Board will fix a date for Public Hearing on this subject and will send notice to Mrs. Heasley as to when it will be held. Motion made by Trustee Randolph, seconded by Trustee Warren: VOTED to approve the minutes of the Organization Meeting held on April 3, 1978, with the following change from the mimeographed copies furnished the Trustees: Resolution 2829 - Add Delinquent Water Bills to 1978 -79 Tax Roll should be changed is to read as follows: Resolution 2829 - Add Delinquent Water Bills, Water Maintenance Bills and Accts. Receivable to 1978 -79 Tax Roll. - • Unanimously passed. MINUTES of Regular Board Meeting - i4AY 15, 1978 page 2 Motion made by Trustee Allee, seconded by Trustee Warren: VOTED to approve the Abstract of Audited Vouchers dated May 15, 1978 in the follow - Ing amounts: General Fund - $8,361.74; Sewer Fund - $17,085.37. Unanimously passed. Mayor Marcham read a letter from James Ray, Chairman of the Planning and Public Works Committee of Tompkins County, regarding the establishment of a County Economic Advisory Board and requesting the Village of Cayuga Heights to submit a nominee for consideration of appointment to this Board. The Board of Trustees tabled this for the present. Trustee Anderson reminded the Board that there is still lacking a person from the Village of Cayuga Heights to serve on the Environmental Management Council, since the retirement of Harlan Brumsted. He suggested that perhaps Trustee Pimentel might be willing to serve and will ask him upon his return from Europe. Chief Harlin McEwen has been designated to serve on the new Ithaca - Tompkins County Transporiatlon Commission during Its formation and Initial meetings and to represent the Village until such a time as he is able to recommend a permanent representative to serve on this Commission. Motion made by Trustee Warren, seconded by Trustee Anderson: RESOLUTION 2831 - ACCEPT FIRE DEPARTMENT APPOINTMENTS • VOTED to accept the following as Officers of the Fire Department for one official year as follows: Unanimously passed. Vorhis Motion made by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2832 - AUTHORIZE CLERK ON TEMPORARY BASIS TO COLLECT EXTENDED WATER SERVICE FEE OF $15.00 VOTED to authorize the Clerk, as a temporary measure until the "Rules and Regulations of Southern Cayuga Lake Intermunlcipai Water Commission Governing the Use and Supply of Water" has been approved by the Board, to collect a fee of $15.00 for extended water service from property owners whose property benefits from that service. • Mayor Marcham voting Yes Trustee Allee voting Yes Trustee Anderson voting Yes Trustee Randolph voting Yes Trustee Warren voting Yes MINUTES of Regular Board Meeting - May 15, 1978 page 3 The matter of the deteriorating fence on the Village property at 825 Hanshaw Road was discussed and the Village.Engineer was Instructed to replace those sections which have rotted and also to have -the entire fence painted. Moved by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2833 - APPROVE TRANSFERS VOTED to approve the attached list of transfers of funds. Unanimously passed. Moved by Trustee Anderson, seconded by Trustee Allee: RESOLUTION 2834 - REVENUE ANTICIPATION NOTE VOTED -to authorize the Treasurer to.-Issue a Revenue Anticipation Note In the amount of $51,000 with Interest at the rate of 5.75% per annum, for three years at the Tompkins County Trust Company, in anticipation of the collection of revenues being specifically benetit charges imposed on property owners in the Village of Cayuga Heights from a water distribution system known as the Cayuga Lake Intermunicipal Project. Mayor Marcham voting Yes Trustee Allee voting Yes • Trustee Anderson voting Yes Trustee Randolph voting Yes Trustee Warren voting Yes Moved by Trustee Warren, seconded by Trustee Anderson: RESOLUTION 2835 - SALARY CHANGE FOR FIRE SUPERINTENDENT VOTED to authorize changes in the Budget concerning the salary of the Fire Superin- tendent from $3500 to $3225 and to add to his travel allowance for a total allow- ance of $$875 per year. Moved by Trustee Randolph, seconded by Trustee Anderson: 40 RESOLUTION 2836 - FIRE DEPT.PURCHASE VOTED to authorize permission to the Fire Dept. to order two portable radlos at $700 3ach and two monitor pagers at $350 each for a total expenditure of $2100. Motion made by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2837 - SEWAGE TREATMENT PLANT PURCHASE VOTED to authorize the Sewage Treatment Plant to purchase a 500 - gallon fiberglass tank and associated equipment at a cost not to exceed $1,000. Mayor Marcham voting Yes Trustee Allee voting Yes Trustee Anderson voting Yes Trustee Randolph voting Yes Trustee Warren voting Yes Engineer Rogers Is instructed to.contact Ray Loehr concerning the possibility of negotiating with Cornell University over sludge disposal. • After some discussion regarding the appearance of the Village Green area, Mayor Marcham was instructed to write to Dr. Rubenstein, owner of the Village Green, to make clear to him that he is responsible for maintalnIng. the fence to the north of the property and also the paved area and to ask him when he will attend to these matters. Moved by Trustee Warren, seconded by Trustee Randolph: RESOLUTION 2838 - HIRE KENNETH TRUAX ON FULL -TIME BASIS VOTED to approve the hiring of Kenneth Truax on a full -time basis, as laborer, at an annual salary of $6500 beginning May 4, 1978. Mayor Marcham voting Yes Trustee Anderson voting Yes Trustee Allee voting Yes Trustee Randolph voting Yes Trustee Warren voting Yes Attorney Sovocool reported on two matters involving the Village In litigation. In the case of Bishops vs. Village of Cayuga Heights, after talking with the attorneys for Bishops, Attorney Sovocool stated that arrangements for a meeting should be made to Include Engineer Rogers to determine the facts in the case. In the Tom Davis claim, Attorney Sovocool stated that he will meet with the attorney for the Insurance company during the summer and will report on the case at a future time. r, �J MINUTES OF REGULAR BOARD MEETING - May 15, 1978 page 5 Police Chief Harlin McEwen gave his report and it is on file in the Village Office. Chief McEwen reported that the trial street light on the corner of E. Upland and Triphammer Road has been Installed. He invited Board members to look at the light and offer comments. Moved by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2839 - REFUND OVERPAYMENT OF WATER BILLS VOTED to refund overpayment of water bills to N.W. Ashcroft, 1001 Highland Road, Acct. No. 283 - 019932 In the amount of $12.62; and J. Richard Agard, 404 Upland Road, Acct. No. 268 - 014922 in the amount of $76.00.
