VILLAGE OF CAYUGA HEIGHTS
MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga
Heights held September 19, 1977 in the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees David J. Allee, Ronald E. Anderson, Shailer
S. Philbrick, David Pimentei, Jean R. Robinson; Attorney Roger B. Sovocool;
Engineer John B. Rogers; Police Chief Harlin R. McEwen; Fire Chief Lowell T. George.
ABSENT: Trustee Rane F. Randolph and Treasurer Gordon B. Wheeler.
OTHERS PRESENT: Representative of the news media; Mr. and Mrs. Kinoshita, John
Christie, and Tom Davis.
After reading a letter from John Christie concerning water drainage problems in his
neighborhood caused by the heavy storm of Sunday night, Mayor Marcham asked the
visitors if they had any questions.
There was long d1scussion.among the visitors and Board members, and many questions
and answers were speculated. Mr. Tom Davis wanted it noted once again that he was
putting the Village on Notice that the problem exists and asked what action the
Board intends to take in the future.
Attorney Sovocool told all concerned that the clearing of private streams was the
responsibility of the individual home owner. Trustee Anderson suggested that most
of the problem concerned good housekeeping of the area of the streams.
• Mr. Tom Davis mentioned the law suits he has pending with the Village. Attorney
Sovocool advised the Board there -should be no comments on the part of the Village
in regard to this matter because they might be used in the suit.
Mr. Christie suggested a meeting with Mr. Rogers and other concerned citizens to
discuss what can be done so that residents do not have to live in fear everytlme it
rains. The Mayor said that the Board and its Officers would consider a course of
action.

Motion made by Trustee Pimontel, seconded by Trustee Anderson:
VOTED to approve the Abstract of Audited Vouchers dated 9/19/77 In the following
_mounts: General Fund - $17,517.35; Sewer Fund - $28,680.24; Trust and Agency
Account - $3,910.11; Federal Revenue Sharing Fund - $50.00. Unanimously passed.
• Mayor Marcham had no written report. He told the Board that he had a call from a
representative of the New York State Cable Television Commission on September B,
1977. There is a memo filed in the Office on this matter. Nothing was heard until
today when a Mr. Kevin Rorke telephoned and said he is the Manager in Residence at
the TV Cable Office. Mayor Marcham and Mr. Rorke have an appointment to meet at
2:30 p.m. on Friday (September 23, 1977) and suggests he ask Mr.,Macnei,l to.be
present. All agreed with the suggestion.

The Mayor spoke of the interviews held to fill the position of Village Clerk.

RESOLUTION 2754 - APPOINTMENT OF ANNE M. KROHTO - CLERK
VOTED to approve the appointment of Anne M. Krohto to the position of Deputy Clerk
beginning September 19, 1977 until October I, 1977, at an annual salary of $9200;
Anne M. Krohto to assume the title of Village Clerk and fill out the unexpired term
of Rose M. Tierney, the present Village Clerk, who has resigned as of October 1,1977.
Unanimously passed.

RESOLUTION 2755 - APPOINTMENT HEALTH INSURANCE ADMINISTRATOR
VOTED to appoint Anne M. Krohto as Health Insurance Administrator to begin on
October I, 1977 to replace Rose M. Tierney, who is retiring at that time.
Unanimously passed.
Moved by Trustee Robinson, seconded by Trustee Allee:
• RESOLUTION 2756 - SIGNATURES FOR BANKS AND BONDING
VOTED to notify the insurance company to change the bonding from Rose P1. Tierney
to Anne M. Krohto and to notify the banks of the official change of signature
effective October 1977, for the various accounts of the Village. Unanimously
passed.

VOTED to raise the salary of Jean L. Laverty from $6,360 to $7,360 beginning
September 19, 1977 on an annual basis. Unanimously passed.

Fire Chief Lowell T. George gave his report and it is on file in the Village Office.
He also read the report of the Fire Inspector and it is on file in the Village
Office.

RESOLUTION 2759 - FIRE DEPARTMENT PURCHASES
VOTED to approve the purchase by the Fire Department of the following items which
have been budgeted. 2 - 30- m(nute new pressure demand air pacs $300.00
2 - 500 -watt flood lights installed Engine 201 250.00
2 - Monitor radio pagers 690.00
Unanimously passed.
The Fire Chief reported the leaking condition of the roof on the oldest part of the
Fire Station, which is the part in which the apartment for the night driver is
located.
Motion made by Trustee Pimentel, seconded by Trustee Philbrick:
RESOLUTION 2760 - ROOF BID
VOTED to authorize the Engineer to draw up specifications and put out to bid for a
new roof, including insulatlop, on the old section of the Fire Station which houses
the apartment. Unanimously passed.

RESOLUTION 2762 - RENEW BAN
VOTED to renew Bond Anticipation Note No. 16 dated 9/15/77, in the amount of
$449,000 at interest of 6.25% and to pay $17,000 on the principal; the renewed
B.A.N. to be No. 19 for the sum of $432,0 -0 for one year at 5.75% interest in
connection with the construction of additions to and reconstruction of the Waste-
water Treatment Facility pursuant to Section 5 of Bond Resolution No. 1876, dated
9/20/71. Unanimously passed.

Engineer John B. Rogers gave his report and It is on flie in the Village Office.
The Mayor was instructed to write a le•`ter of congratulations to Waiter Hayes upon
his retirement and express the Village's gratitude for his years of service. He
has been with the Village the best Dart of 31 years.
There was a long discussion concerning policy on water line Installation and
maintenance.

RESOLUTION 2763 - POLICY ON WATER LINES

INSTALLATION AND MAINTENANCE
VOTED that in continuation of the policy of the City of Ithaca when it provided
water service In the Village, it shall be the policy of the VIIIage that instal-
lation and maintenance of water laterals be the responsibility of the individual
property owner from the Village water main to the property owner's residence,
subject to Village Ordinances and rules and regulations of the Southern Cayuga Lake
Intermunicipal Water Commission.
Unanimously passed.
Trustee Philbrick, the Village representative on the Water Commission, requested
the Engineer to evaluate the priorities listed on the report for maintenance of
water mains In 1978 by Bob Terrell, Operator of the Water Plant. He explained that
the budget for next year was In process and figures were needed by November Ist.
Engineer Rogers said he would have suggestions of priority work to be accomplished
In the Village for the coming year by the regular meeting of the Board in October.
After a discussion on the removal of the fence at 825 Hanshaw Road, it was decided
the Engineer bring back suggestions of how to mark the area for traffic safety if
the fence is removed.
'• There was a discussion on the upe of decorative gravel around the Village Hall.
The Mayor was instructed to write a letter to residents concerning policy on trash
pickup and what constitutes a container; how leaves can be part of the water
draingge problem; and that good housekeeping should be maintained.

• In the absence of Deputy Mayor Randolph, Mayor Marcham asked Trustee Anderson to
act as Deputy Mayor for the rest of the meeting and turned the meeting over to him
at 10:15 p.m.
Attorney Roger B. Sovocool said he had nothing to report but said he would start
negotiations with Mr. Seymour of Flavin's Jewelry Store for a new contract.
There will be a Special Executive Session meeting of the Board of Trustees at
7:30 p.m. Monday, October 3, 1977 to discuss the entire surface water problem.
Mr. Fabronni of the Town of Ithaca is to be invited to be present as well as the
Police and Fire Chiefs. The meeting is to be held at the Fire Station.
The Engineer is to have a map of culverts and other pertinent information concerning
water runoff problems. These need to be available at the meeting on October 3, 1977.
Police Chief Harlin R. McEwen gave his report and it is on file in the Village Office.
He asked that the attached teletype be entered Into the minutes of this meeting to
show that the flooding conditions last evening were not confined to the Village.
Copy will be inserted in Minute Book. The information on this teletype reported
that: Roads in the northern part of Tompkins County are presently receiving heavy
rain - the following roads in the County are closed due to flooding at this time.
(8:45 p.m., 9/17/77). State Route 89 at Taughannock Falls State Park; State Route
34B near Cayuga County Line; Salmon Creek Road, Locke Road, Judd Falls Road. Water
is washing over State Route 13 in places - road is still passable - advise no
unnecessary travel at this time in the northern part of the County.
After a discussion of the name of the road which connects Tyler Road to Cayuga
Heights Road, it was unanimously decided the name should continue as Fleck Road
subject to the approval of the Villagc of Lansing. Attorney Sovocool is instructed
to find out who legally owns the road, especially that part which lies within
the boundary of the Village of Cayuga Heights.

RESOLUTION 2764 - APPROVE ATTENDANCE TO POLICE CHIEF'F SCHOOL
VOTED to approve the attendance of Harlin R. Mc Ewen to the Police Executive Workshop
for Contemporary Legal Problems sponsored by the New York State Association of
Chiefs of Police held in Syracuse on November Ist and 2nd of this year. The
tuition is $50 and the check may be sent in with the registration. Unanimously
passed.
The Clerk gave her report and it is filed in the Village Office.
