Minutes 1/17/1977VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held January 17, 1977 at 7:30 p.m. In the Village Hall. PRESENT: Mayor F. G. Marcham; Trustees David J. Al lee, Rona id E. Anderson, ShaIIer S. Philbrlck, David Pimentel, Rane F. Randolph, Jean R. Robinson; Treasurer Gordon 2. Wheeler; Attorney Roger B. Sovocool; Engineer /Zoning Officer John B. Rogers; Ponce Chief Harlin R. McEwen; Fire Chief Lowell T. George. OTHERS PRESENT: None Mo•tlon made by Trustee Randolph, seconded by Trustee Philbrlck: VOTED to approve the minutes of a regular meeting of the Board of Trustees held December 20, 1977 as previously furnished Trustees in mimeographed form. Motion made by Trustee Randolph, seconded by Trustee Anderson: VOTED to approve the Abstract of Audited Vouchers dated January 17, 1977 in the following amounts: General Fund - $15,701.31; Sewer Fund - $19,501.49; Capital Fund - $11,371.91. Trustee Philbrlck asked the Engineer if an Inventory of small tools could be kept In -the Public Works Department. 40 Mayor Marcham gave his report and it is on file in the Village Office. The Trustees discussed questions relating to vacation policy for the Village Office. They had before -them the Mayor's report for January 17, 1977, which had offered recommendations on 'the matter. Trustee Phllbri_k said he disagreed with the Mayor's view that staff members should not take part of •their vacation in one or two day units. Such units he said made it possible -to 6xtena r::oY. -ond holidays and such units had been accepted as normal" units of leave in government and business for many years. The Mayor said.he•ob Jected to theses s"o:•'• units when they took in Mondays; because, in his view, Monday was the busiest day in five meek In the office. They created too heavy a load for one staff member to handle, The Village Clerk said that the work of the office was rarely urgent and when necessary could be put off for a day or two. She thought there should be no ban on occasional one to two day units. Trustee Randolph Bald that the !4ayor•, as Chief Executive Office, had responsibility for deciding when vacations should be taken. The 'rrustees agreed that one neces- sary step -to making a vacation program from year -to year was preparation of a sched- ule marking out per•lods when the workloads in the Village Office would be likely heavy. The Village Treasurer and the Village Clerk would be able to give the Infor- matlon necessary for this purpose. In their discussion, the Trustees recognized that emergencies might arise that made It appropriate to grant a short vacation during heavy work period and that other • emergencies might make it necessary to Interfere with an Intended vacation. It was -thought •lc be Important to dissolve any and all binding actions between the Village and a County Sewer District. The consensus was that if the Treatment Plant Is to be turned over to ano•Iher governing body it should not be a County Sewer District. Mayor Marcham is to work along these Iines. page MINUTES of Regular Meeting - January 17, 1977 page 2 After a discussion on the draft resolution of understanding between the Village and County In relation to septage disposal, It was decided that the Attorney should study the proposal and give his recommendations at the next meeting. Motion made by Trustee Pimentel, seconded by Trustee Philbrick: RESOLUTION 2667 - INSPECTORS OF ELECTION VOTED to approve the Mayor's appointment of inspectors of election as follows: Irene Home as Chairman and Shirley Gates as the other Inspector of election. Also, alternate inspectors of election are Mary Lou Morse and Clara Daino. Unanimously passed. * *at Motion made by Trustee Pimentel, seconded by Trustee Philbrick: RESOLUTION 2668 - REGISTRATION AND ELECTION TIMES AND DATES VOTED that the permanent registration shall be brought up to date before Registra- tion Day, which will be Saturday, February 26, 1977, between the hours of 12:00 noon and 9:00 p.m.; and Election Day shall be Tuesday, March 15, 1977, between the hours of 12:00 noon and 9:00 p.m. Both are to be held in the Village Hall, 836 Hanshaw Road. Unanimously passed. Moved by Trustee Randolph, seconded by Trustee Anderson: RESOLUTION 2669 - NOMINATING COMMITTEE VOTED to authorize Mayor Marcham to appoint a Nominating Committee for the forth- coming election. Unanimously passed. Moved by Trustee Randolph, seconded by Trustee Robinson: RESOLUTION 2670 - ANNUAL MEETING DATE VOTED to hold the Annual Residents Meeting on February 22, 1977 at 7:30 p.m. in the Village Hall to hear the annual reports of the various departments of the Village. Unanimously passed.. Fire Chief Lowell T. George gave his report and to' is on file in the Village Office. He also stressed the need for a pump for the fuel oil consumed by the Fire Dept. Moved by Trustee Anderson, seconded by Trustee Randolph: RESOLUTION 2671 - FIRE DEPT. PURCHASE VOTED to authorize the purchase by the Fire Department of a second hand fuel tank of 250 gallon capacity and a hand - operated pump at a cost not to exceed $100. PURCHASE VOTED to authorize the purchase by the Fire Department of First Aid supplies at a cost of $359.00. Unanimously passed. * * x Treasurer Wheeler's six months report had previously been mailed to Trustees in mimeographed form. Moved by Trustee Anderson, seconded by Trustee Pimentel: RESOLUTION 2673 - ACCEPT SIX MONTHS REPORT OF TREASURER VOTED to approve and accept the Treasurer's six months report and place it on file- In the Village Office. Unanimously passed. �r ** Moved by Trustee Pimentel, seconded by Trustee Robinson: RESOLUTION 2674 - 1976 TAX WARRANT VOTED that the Treasurer has returned his 1976 Tax Warrant and Account of Uncollec- ted Taxes filed with the Clark as required by Real Property Tax Law. The Trustees have certified the list of unpaid taxes as presented by the Certificate of the Treasurer and filed the same with the Clerk showing a balance of $1,636.89 without penalties. The Trustees returned the account of unpaid taxes to the Treasurer for collection as required by Real Property Tax Law in the amount of $1,636.89. Unanimously passed. Motion made by Trustee Robinson, seconded by Trustee Randolph: RESOLUTION 2615 - TAX SALE VOTED that the unpaid taxes on properties on LIST OF OVERDUE TAXES AS OF JANUARY I, 1977, be advertised •for sale in issues of the official newspaper on January 22, 29, and February 5, 1977, to recover, unpaid -faxes in the amount of $1,636.89 as listed. The Tax Sale to be held at 10:00 a.m., February 12, 1977, in the Village Hall. Unanimously passed. Mayor Marcham turned the meeting over to Deputy Mayor Rane F. Randolph at 9:20 P.M. Engineer Rogers gave his report and it is on file In the Village Office. The Board discussed the report but took no action. • Chairman of the Public Works Committee, David J. Al le, gave a report on a meeting between the Public Works CorranIttee and -the Vlilage work force. Attorney Roger S. Suvocool repo ted on -tile proposed contract with NYSEbG for street lighting. MINUTES of Regular Meeting - January 17, 1977 page 4 0 Moved by Trustee Allee, seconded by Trustee Anderson: RESOLUTION 2676 - NYSE&G STREET LIGHTING CONTRACT VOTED to authorize the Mayor to execute the contract between the Village of Cayuga Heights and the New York State Electric d Gas Corporation for a period of one year beginning February I, 1977 for street lighting. Unanimously passed. Attorney Sovocool explained the new Sunshine Law. It was suggested that when we hold our Annual Residents Meeting we have the Journal reporter state that the regular meetings of the Board of Trustees will be held the third Monday of every month. There was agrooment that when a special meeting Is held before a notice can be in the Journal 72 hours prior to such moeting, we can confirm 1hoan actlons at the next regular meeting. Special meetings are held In circumstances that do not allow the Clerk to give 72 hours notice of the meeting to the Ithaca Journal; then any actions taken at the meeting shall be confirmed at the next regular meeting. Police Chief Harlin R. McEwen gave his report and it is on file in the Village Office. Moved by Trustee Robinson, seconded by Trustee Allee: is RESOLUTION 2677 - RENEW CONTRACT WITH S.P.C.A. VOTED to authorize the Mayor to execute a renewal contract with the S.P.C.A. for one year beginning January I, 1977. Unanimously passed. Motion made by Trustee Philbrick, seconded by Trustee Anderson: . RESOLUTION 2678 - PUBLIC HEARING - LOCAL LAW #1 of 1977 VOTED to hold a Public Hearing at 7:15 p.m. on February 21, 1977 In the Village Hall to consider changing the present Dog Ordinance into Local Law No. I of the year 1977 to update the rates. Unanimously passed. as Motion made by Trustee Philbrick, seconded by Trustee Allee: RESOLUTION 2679 - PROCEDURES FOR WATER HOOK -UPS VOTED to adopt the following procedures for water hook -ups In the Village of Cayuga Heights subject to minor modifications under Number 6, of "Procedures for Village Clerk." n LJ �J MINUTES of Regular Meeting - January 17, 1977 VILLAGE OF CAYUGA HEIGHTS ISSUANCE OF WATER PERMITS PROCEDURES FOR VILLAGE CLERK Establish that applicant has Zoning Permit. page 5 2. Give applicant a copy of Village of Cayuga Heights procedures for water appli- cation. 5. Give applicant copies of Water Application for Service Form. 4. Collect $80 fee for processing application and plumbing inspection. 5. When application is in order and fees paid, Village Clerk will sign all four copies of application form and keep one copy for Village files. 6. A list of current Village Zonign Permits will be sent each month to SCLIWC Office, 1402 East Shore Drive, Ithaca NY 14850. 7. Special applications for subdivision water supply construction prior to home construction shall be referred to Village Engineer. 8. The Clerk will receive from SCLIWC, when Job is complete, a water application for service form completely filled out by SCLIPIC for the Village files. VILLAGE OF CAYUGA HEIGHTS APPLICATION FOR WATER PERMIT PROCEDURES FOR APPLICANT I. Applicant must have a valid building or Zoning Permit issued by the Village of Cayuga Heights for the project that Is to use water. 2. A Water PermilF must be obtained before plumbing work starts. 3. A Water Application for Service form shall be filled out in quadruplicate. Forms are available at the Village Office. 4. Applicant pays $80 fee to Village Clerk and submits all four Water Applica- tion for Service forms to the Village Clerk for the Clerk's signature. The $80 fee covers the cost of plumbing Inspection, SCLIWC inspections, curb cock, permit issuance, installation of water meter, and meter card. a) Applicant will leave one completed and signed form with the Clerk. b) Applicant will submit one completed and signed form to the Plumbing Inspec- tor. c) Applicant grill submit two completed and signed forms to SCLIWC Office at 1402 East Shore Drive. 5. When signed Water Application form is filed with Plumbing Inspector, applicant will receive from the Plumbing Inspector a Plumbing Permit (red) for Interior • MINUTES of Regular Meeting - January 17, 1977 page 6 plumbing, which is to be posted on the Job site. The applicant will schedule with the Plumbing Inspector times for inspections to be made by the inspector. 6. When two copies of signed Water Application form are submitted to SCLIWC, applicant will also sign the SCLIWC Log Book for (outside plumbing and house connection) permit and sign for a temporary meter. The House Connection Permit (yellow) is to be posted on the Job site. 7. Applicant, his agent, or contractor may proceed with plumbing work inside and outside up to the curb cock, including the installation of the temporary water meter. 8. The applicant will have curb cock connected to the water main, including the tapping of the main by SCLIWC when his Interior, exterior, and meter instal- lations are approved by inspectors. 9. Applicant may back fill (cover) exterior plumbing after, but not before, it is approved and the House Connection Permit (yellow) is signed by the SCLIWC inspector. 10. Applicant will have his permanent water meter installed, when the job is com- pleted, by SCLIWC personnel. 11. Special Applications for sub - division water supply construction are to be referred to the Village Engineer. 12. The Applicant or his agent wlII use only materials that meet the specifica- tions as spelled out in the Village of Cayuga Heights Plumbing Code or in the AWWA Standard, whichever is more restrictive, or as may be spelled out by the Commission in the future. Moved by Trustee Anderson, seconded by Trustee Phllbrick: RESOLUTION 2680 - REFUND SEWER RENT VOTED to refund $945.00 to Lakeview Meadows Apartments, Graham Road, for an over- charge of 18 units at a cost of $52.50 per unit and to reduce from 128 units to 110 units assessed to them as sewer rent units. Unanimously passed. t MMI Motion made by Trustee Anderson, seconded by Trustee Allee: RESOLUTION 2681 - DEDICATE SPRUCE LANE VOTED to authorize the Attorney to accept the deed for Spruce Lane and to place it on the records.
