MINUTES of a PUBLIC HEARING held at 7:00 p.m. on September 20, 1976 in tho Village
Hall.
PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Shailer S. Phllbrick,
Rane F. Randolph, Jean R. Robinson; Engineer /Zoning Officer John B. Rogers; Police
Chief Harlin R. McEwen.
ABSENT: Trustees David J. Allee and David Pimontel; Treasurer Gordon B. Wheeler;
Fire Chief Lowell T. George.
OTHERS PRESENT: There were about 18 to 20 persont$, present, Including Mrs. Walter
Heasley and her Attorney Robert S. Grant; Mr. and Mrs. Rose-1-1-1; 1helr son; and
Attorney Robert I. Williamson.
Mayor Marcham opened the meeting by reading the duly advertised and posted Nullco
of Public Hearing. The Mayor explained the request from the Corners Community
Center, Inc., that the present restaurant operated by the P.osettl's be remodeled
and that a service bar for the serving of alcoholic beverages with meals be added.
The Mayor laid out the conditions that had been discussed between Mrs. Heasley and
the Village and other specific issues.
Mr. Williamson spoke on behalf of the Rosettl's and said they were willing to go
along with all the conditions. Mr. Grant then spoke on behalf of the Corners
Community Center, Inc., and agreed to accept the proposed regulations.
• Several people spoke In favor of the proposal, including David Barr and wife;
Dr. Mosher; Dick Agard; and a few others. Attorney Williamson said there was a
need in the Village for this type restaurant.
The Public Hearing closed at 7:25 p.m.

September 20, 1976 In the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Shailer S. Philbrick,
Rane F. Randolph, Jean R. Robinson; Attorney Roger B. Sovocool; Engineer /Zoning
Officer John B. Rogers; Police Chief Harlin R. McEwen; Fire Chief Lowell T. George.
ABSENT: Trustees David J. Allee and David Pimontel; Treasurer Gordon B. Wheeler.
OTHERS PRESENT: None.
Motion made by Trustee Robinson; seconded by Trustee Randolph:
VOTED to approve the minutes of a regular meeting held August 16, 1976 as previous-
ly furnished Trustees in mimeographed form by adding the name of Treasure Gordon B.
Wheeler to those present. Approve the minutes of a special meeting held August 17,
• 1976 as previously furnished Trustees in mimeographed form with an amendment to
Resolution 2597 as approved by a telephone survey of the Trustees. The amendment
to be as follows: Add: "in the event the Engineer is not satisfied with the
quality of Mr. Porter's work or material he intends to use, the award shall be to
the next low bidder provided he meets the same conditions as to satisfying the
Engineer."

Motion made by Trustee Philbrick, seconded by Trustee Anderson:
VOTED to approve the Abstract of Audited Vouchers dated September 20, 1976 In the
following amounts: General Fund - $19,060.67; Sewer Fund - $13,036.71; Capital
Fund - $49,620.00; Trust and Agency - $100.00.
There was a discussion concerning the reimbursement for flood damages and the
amount allowed. Since the amount Is out of line with actual cost, the Engineer is
instructed to negotiate further using the services of the Attorney as necessary.
After a discussion on payment of invoices for Teetor- Dobbins, it was decided that
the Engineer and Clerk be designated to collect data on all monies paid, Including
change orders, etc. The Attorney suggested this be done. The Board should meet,
study all data, and decide on a course of action. Since there has been some dis-
cussion on the design of the outfall pipe and the costs involved in the problems
which arose, perhaps because of error In design, it is best to evaluate the merits
of the whole project before directing attention to one particular aspect of the
engineering services.
Mayor Marcham gave his report and it is on file in the Village Office.
There was a discussion concerning the public hearing. The Trustees presented con-
ditions which they wished incorporati)d into a permit for the suggested operation
and remodeling of the restaurant.
Motion made by Trustee Anderson, seconded by Trustee Philbrick:
RESOLUTION 260ta - RESTAURANT PERMIT
VOTED to authorize the Attorney to prepare a permit to be granted to the Corners
Community Center, Inc., for operation under certain conditions of a restaurant where
alcoholic beverages shall be served as part of the restaurant operation. Trustees
Philbrick, Anderson, and Robinson voted for the resolution, but Trustee Randolph
opposed It.
Motion made by Trustee Anderson, seconded by Trustee Randolph:
RESOLUTION 2609 - ENGINEER - TUCKER SEWER PROBLE14
VOTED to authorize the Mayor to write to Mayor Smldt concerning the choice of
T. G. Miller as an engineer to survey the sewer problem relating to the Tucker
property. If he should object to Mr. Miller, then Mayor Marcham is to approach
Vernon 0. Shumaker of Vestal, New York, Unanimously passed.
Fire Chief Lowell T. George gave his report and It is on file in the Village Office.
• He spoke of the Annual Picnic favorably. Trustee Philbrick mentioned praise he
had received from residents concerning the professionalism of the Fire Department
and also the Police Department.

RESOLUTION 2610 - TRANSFERS
VOTED to approve the transfers as attached. (Mimeographed copy will be Inserted
In Minute Book). Unanimously passed.
Motion made by Trus +ee Anderson, seconded by Trustee Phllbrick:
RESOLUTION 2611 - APPROVE TREASURER'S REPORT
VOTED to approve the Treasurer's three -month report as previously sent Trustees
In mimeographed form and filed in Clerk's Office. Unanimously passed.
Mayor Marcham turned the meeting over to Deputy Mayor Randolph at 9:00 p.m.
Engineer John B. Rogers gave his report and It Is on file In the Village Office.
Mr. Rogers explained that the original construction of the Fire Station was not
• built according to specifications; therefore, there Is more of a problem than Just
a repair of the roof. After a discussion it was decided that the Engineer should
consult with architect Fred Thomas and return to the Board with his recommenda-
tion before more work is done.
No direct action was taken on the request of Dr. Patrick for removal of the willow
tree on Village property near the intersection of Pleasant Grove Road and Hanshaw
Road. The Board raised the questions could it be trimmed and would the Police
Chief check into the traffic visibility at the corner. The Forester is asked to
shed more light on the reason for the survival of some trees and not others which
were planted in cooperation with property owners. Forester Pimentel is asked for
recommendations for further tree planting.
Engineer Rogers spoke of tho request of Walter Hayes,who has worked for the
Village since 1947, to remain on the Job even though he will become 70 years old
in November. The New York State Retiremont System has a mandatory retirement
age of 70 years. The Board decided to refer this matter to Treasurer Wheeler for
advice whether to seek retention of his services past the age of 70 years.
The Engineer told of a meeting with the Public Works Committee. The Idea Is to
establish priorities in connection with certain projects such as street mainten-
ance, ditching, etc.
Trustee Phllbrick asked the Engineer if he was going to answer the letter of
Mr. McHugh, of 101 W. Uplend Road. Mr. Rogers replied that he would. The Board
requested a copy of the letter which Mr. Rogers writes to Mr. McHugh.

After much discussion concerning the Illegal signs at the Corners Community
Center and the Cornwall premises, Attorney Sovocool stated the only recourse for
the Zoning Officer is to refuse the signs because they do not meet the Ordinance.
The applicants still have recourse to the Zoning Board of Appeals.
Attorney Sovocool had nothing to report.
Chief of Police Harlin R. McEwen gave his report and it is on file In the Village
Office. He spoke of a problem with parking on Jessup. Road and that he would moot
with Members of the Cornell Safety Division to work out a solution.
The Clerk gave a report and It Is on file in the Village Office.
RESOLUTION 2612 - SEWER PERMIT FEES
VOTED to set $15.00 as the fee to be charged for a sewer permit issued for any
property outside the Village of Cayuga Heights. Unanimously passed.
Meeting adjourned at 10:30 p.m.
