Minutes 7/19/1976MINUTES of a regular meeting of the Board of Trustoos of the Village of Cayuga Heights held on July 19, 1976 at 7:30 p.m. in the Village Hall6 PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Rane F. Randolph, Jean R. Robinson; Treasurer Gordon B. Whcycisr; Attorney Roger B. Sovocool; Engineer /Zoning Officer John B. Rogers; Sergeant Larry S. Cooper for the Police Chief; Fire Chief Lowell T. George and Asst. Chlof Edward C. Collins. ABSENT: Trustees David J. Allee, Sheller S. Philbrick, and David Pimentel OTHERS PRESENT: Glen Campbell and associates in connection with the Convenient Food Mart and about 15 other residents. Motion made by Trustee Randolph, seconded by Trustee Anderson: VOTED to approve the minutes of a regular meeting held June 21, 1976 and a special meeting held July 9, .1976 as previously furnished Trustees in mimeographed form. Motion made by Trustee Randolph, seconded by Trustee Robinson: VOTED to approve the Abstract of Audited Vour;h3rs dated July 19, 1976 in the following amounts: General Fund - $21,194.41; Sewer Fund - $11,300.12; Capital Fund - $19,394.34; Federal Ravenue Sharinc Fund - $3,800.00. Mayor Marcham gave his report and it is on flic In the Village Office. He asked the Trustees to determine a date for mestin5 -alth •Fhe Sewer Committee of the Village of Lansing in connection with nogotlating a sewer contract. The Board • decided to try to hold such a meeting July 22, Thursday, at 4:00 p.m. Mayor Marcham called upon the visitors for comments after he explained that the flood of July llth was a most unusual event. He called upon Attorney Sovocool to clarify the Village position of doing leork on private property. Mr. Kalter of 620 Cayuga Heights Road told of his problems and offered a suggestion of three causes and possible solutions: 1) The culvert at Berkshire and Cayuga Heights Road seems to have a sharp angle which impedes the flow of water and gathers debris which clogs the culvert. This culvart does not seem to be adequate. 2) The road ditch on the east side of Cayuga Heights Road is not deep enough to carry run -off water. It should be deeper. 3) The upslope driveways should have a grid placed at the end of the driveways In the right of way of the Village. Mr. Donald Freebalrn of 310 North Sunset Drive, who desired to have his problem become part of the minutes, said that on Sunday, July 11, 1976, he had sewage back up Into his house through the bathroom. He wishes to have a qualified Englneer,who is registered with the State of New York,study the design and the capacity of the sewer lino. Mayor Marcham explained the constant discussions and studies by two registered Engineers which are on record. He also explained about the Infiltration and the vandalism problems. Engineer Rogers told of the replacement of sections of the sewer line In efforts to alleviate problems. Other residents spoke concerning various problems they have had on Iroquois Place, • 101 West Upland Road, etc. MINUTES of Regular Meeting of July 19, 1976 page 2 • It was suggested that a regular maintenance schedule be devised whereby the cul- verts and ditches should be kept cleaned anal repaired; and, If the budget Is not adoquate for this, futuro budgets includz it. Mr. Glen Campbell requested that the Convenient Food Mart, a grocery store, be allowed to stay open until 12:00 midnight. Mayor Marcham explained that the Village tries to maintain a position of having no businesses open after 10:00 p.m., except tho Laundromat, and also to reiterate the point that the Village Zoning Is to meet the needs of the Villagers. It was acknowledged that Mr. Campbell brought a petition which has been signed by over 500 Village residents which stares, °Pie, the undersigned citizens of the Vlilage of Cayuga Helghts,woUld have no ob,J,.)ctions If the Convenient Food Mart at 840 Hanshaw Road were to remain open untII Midnight rather than the closing at 10:00 p.m. as currently mandated by the Vlilage Board." Mr. Campbell and his associates asked for a trial porlod of perhaps one year for staying open until midnight. Mr. Robert North, who l.r- from Buffalo and was one of the persons who negotiai•gd the opening of the Convenient Food Mart three years ago, explained the convonienco angl•:, of The. c•tor•a as opposed to a regular grocery store. This discussion was very lengthy. Mayor Marcham turned the mp x Ing over to Dnporty Mayor Rang F. Randolph at 9:20 p.m. S with the suggestion that the matter of Mr. Posetti's request be put over until a later time. Fire Chief Lowell T. George gave his report and it is on file In the Village Office. Motion made by Trustee Anderson, seconded i:y Trustee Robinson: RESOLUTION 2587 - FIRE DEFT. PURCHASES APFROVED VOTED to approve the Installation of a lease telephone line from Cayuga Heights Fire Department to Central Fire Control For the purpose of setting off the moni- tors when there Is a flexainrm alert at a cost of $75.00 for Installation and a monthly charge of 318.22. Also, to approve the purchase of 5 five- gallon cans of 6% triple F foam at a cost of $381.25 to replace the outdated foam. Unani- mously passed. it W. ♦; The Fire Chief told of i•ha condition of the fire station roof. It leaks and has caused extensive damage to the building Itself. There is urgent need to have the roof repaired. He had two estimates. Motlon made by Trustee Robinson, seconded by Trustee Anderson: RESOLUTION 2589 - BID ON ROOF REPAIR - FIRE DEPARTMENT • VOTED to authorize the Engineer to draw up specifications and the Clerk to advertise for bids for the repair of the roof of the Fire Station. The Engineer to look into the warranty of the new building. Unanimously passed. * It * MINUTES of Regular Meeting of July 21, 1976 page 3 Motion made by Trustee Anderson, seconded by Trustee Robinson: RESOLUTION 2590 - APPROVE TRANSFERS VOTED to approve the following transfers for the fiscal year which ended May 31, 1976 as follows: 1'0 FROM $ A5110.1 Streets Salaries A8160.1 Refuse Coil Salaries 1;355.79 G8120.1 Sewer Line Salaries 61990.0 Contingency 250.81 G8130.21 S.P. Equip Maint 61990.0 Contingency 302.94 Unanimously passed. The Board accepted the 12••month report of the Treasurer fct•the fiscal year which ended May 31, 1976. The Treasurer said that,strtcz• wu have enough money, perhaps the sewer line repair Jobs should be contracted out. This would free the public works crow for other wcrl:. • The Police Chief's report is on file in the Village Office. Sergeant Cooper, who attended for the Police Chief, asked again for a solution to the emergency call - out problem. It was decided that the Fhgineer, along with Bob Tyrrell, gel to- gether with the Police Chief and decide upon a solution. Trustee Anderson suggest that Douglas Larison be complimented on his alertness in coming to help during the flood without bning called. Attorney Sovccool was Instructed to find the best mothod of handling the matter of closing hour restriction_ and bring it back to thi Board. No action was taken on the requr; =1• of •tho Convenlen•i Food Mart 1-n stay open until 12:00 midnight. Engineer John B. Rogers gave his r•apsrt end it is on file In the Village Office. He asked the Attorney's advice concerning the cleaning of streams where the problem Iles within private property lines. The Attorney said the Village could got either temporary or permanent sasemant to repair or dredgo streams which would be the proper way. The Engineer reported that the flow at tho sewer plant had dropped drastically which rimy man a break In a sewer 11na. It twill be investigated.
