HomeMy WebLinkAboutReg Mtg. Minutes 8/18/1975• VILLAGE OF CAYUGA MINUTES of a regular meeting of the Board of Trustees held at 7 :30 P.M. on August 18, 1975 in the Village Hall. PRESENT: Mayor F. G. Marcham; Trustees Shailer S. Philbrick, David Pimentel, Rene F. Randolph; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool; Engineer /Zoning Officer John B. Rogers; Police Chief Harlin R. McEwen; Fire Chief Lowell T. George. ABSENT: Trustees David J. Allee, Ronald E. Anderson; Dooley S. Kiefer. OTHERS PRESENT: Joseph Rosenblum of 1045 Highland Road. Mayor Marcham asked Mr. Rosenblum to voice his concerns. He requested the Board to consider the adoption of a "noise ordinance ". He offered to help in research or any way he could. Mayor Marcham explained some of the procedures which are generally necessary preliminary to a Public Hearing and final adoption of an ordinance of this nature and assured Mr. Rosenblum that the Village will pursue this idea of a noise ordinance and have the Attorney follow up on the details. VOTED to approve the minutes of a regular meeting held July 17, 1975, furnished Trustees in mimeographed form, with the following amendments: Change Resolution 2466 - Approve Payment - Fire Truck to read "VOTED to approve payment for the new Seagrave 1975 Model PB24068 custom pumping engine on one chassis E7 3400 Fire Truck in the amount of $67,066.00 as follows: Federal Revenue Sharing $15,000; Fire Dept. Equipment Fund $20,066; and a Capital Equipment Fund Note with the First National Bank for $32,000." Amend Resolution 2467 - Approve Capital Note to read "VOTED to authorize the Treasurer to negotiate with the First National O Bank for a Capital Equipment Note in the amount of $32,000 for the purpose of funding part of the cost of the 1975 Fire Truck. The note to be in three annual installments to be paid out of the Fire Department Equipment Fund. • VOTED to approve the Abstract of Audited Vouchers dated August 18, 1975 with the exception of the item, Town of Ithaca - Surcharge for water consumption in the amount of $226.95. After a discussion, the Treasurer is to write to Mr. Schwan for more information and express the concerns of the Board. Abstracts are in the following amounts: General Fund - $60,147.91; Sewer Fund - $5,210.13; Federal Revenue Sharing Fund - $152023.12. Mayor F.G. Marcham gave his report and it is on file in the Village Office. In referring to his letter to Mr. Schuler, Commissioner of the NYS Department of Transportation, the Mayor said that when he receives a reply, the Board will be sent copies. Motion made by Trustee Pimentel, seconded by Trustee Philbrick: RESOLUTION 2469 - WATER COMMISSION EMPLOYER VOTED to ask the Attorney of the Village to examine the resolution prepared by Attorney Buyoucos in connection with the designation of the Town of Ithaca as employer for the Southern Cayuga Lake Intermunicipal Water Commission for purposes associated with Social Security Agency's requirements. Unanimously passed. EWMN page 2 MINUTES of Regular Meeting of August 18, 1975 Mayor Marcham spoke of a resolution presented to him by Frank Liguori of the County pPlanning Board in connection with the Tompkins County Serer District #l. He said that time is needed in order to see whether the cooperating municipalities take steps to dissolve the District and create an intermunicipal commission for sewer similar to the Water Commission. The Mayor suggested we await further action from the other municipalities. When asked by Mayor Marcham, Attorney Sovocool reported that in essence the agree- ment concerning utilities in Tyler Road is complete, but time had not allowed him to put the words into a final draft. RESOLUTION 2470 - AGREEMENT FOR AND ACCEPTANCE OF TYLER ROAD VOTED to authorize Mayor Marcham to examine, approve, and sign an agreement regar- ding water and sewer mains and other utilities within the right of way of Tyler Road and extending westerly to the old railroad right of way, after which the Board of Trustees will accept and take title to Tyler Road; further, if the agreement is signed, the Attorney is instructed to record•the Tyler Road deed dated 11/2174. Unanimously passed. Mayor Marcham reported that Mr. Durland has an arrangement with Cornell to use the tennis courts on Cornell property which were not sold with the former President's house, known as 511 Cayuga Heights Road. These tennis courts r-re on Cayuga Park Road, and are being used by Mr. Durland and his invited guests. • After discussion, it was determined that Mayor Marcham approach Mr. Durland to convey the views of the Board that, if Mr. Durland wishes a firm legal decision, he should go to the Zoning Board of Appeals for an interpretation of the Zoning Ordinance or for a variance or decision that there was a pre- existing, nonconforming use. It was stated by the Zoning Officer that a house may be built upon the exist- ing lot and will meet all zoning regulations. Fire Chief Lowell T. George gave his report and it is on file in the Village Office. Motion made by Trustee Randolph; seconded by Trustee Philbrick: RESOLUTION 2471 - APPROVE TUITION FOR FIRE DEPT. OFFICERS VOTED to authorize the Fire Chief, at his discretion, to pay from Fire Department funds the tuition fees for Officers of the Fire Department in connection with their professional training. Unanimously passed. iF dF -)E Treasurer Gordon B. Wheeler noted a letter from Dr. and Mrs. Darling asking for a waiver of the 5-,3-% penalty because of a lost check. He will write to them and explain that the Laws of New York State are explicit on these matters. • page 3 MINUTES of Regular Meeting of August 18, 1975 • Engineer John B. Rogers gave his report and it is on file in the Village Office. He explained in more detail the precise measures being taken to get the new sewer plant into full operation. This morning it did begin the secondary treatment. He said the 0&M manual should be in final draft by September first. Additional lab equipment will be needed, and its cost will be included in the grants in aid. He will get a complete list of the equipment needed as soon as possible for Board approval. After a discussion on the walk and bikeways for Pleasant Grove Road, the Engineer was asked to pursue it further and report back. The Engineer estimated it would cost approximately $1,000 to'put in a 4 -ft wide sidewalk at the Crawford's, 210 White Park Road. The house at 511 Kline Road is now owned by Mr. Rosen who is remodeling and has talked with Mr. Rogers concerning what he wishes to do along the road. The Engineer was asked to produce some drawings on possible modifications and recommendations for this section of Kline Road. A dead oak tree between 210 and 212 Kelvin Place will be removed by the Village work force. . The Engineer read two estimates for the removal of the ten tagged trees on Village rights of way which are situated so that they have wires in the upper branches. The amount does not require that we formally put them out to bid. The estimates are: General Arborists - not to exceed $830 with removal within 15 days,also hauling to the land fill; S & S Tree Service, Inc. - $1,150 with hauling to land fill and deadline for removal as October lat. Motion made by Trustee Randolph; seconded by Trustee Philbrick: RESOLUTION 2472 - TREES REMOVED BY GENERAL ARBORISTS VOTED to accept the informal bid of General Arborists to remove the 10 tagged trees in the Village rights of way for an amount not to exceed $830 which includes the hauling to the land fill, the work to be accomplished within 15 days of the award of the bid. Unanimously passed. It was agreed that there was no reason to deny the occupancy by the Indian Manpower Planning and Action Consortium of the upper west one -half portion of the building at 186 Pleasant Grove Road. The Attorney had no written report and most of his concerns have already been taken UP. Police Chief McEwen gave his report and it is on file in the Village Office. The • Chief asked about the Police authority for Tyler Road. where it began, etc. He also asked about noise of builders who start work at 6:00 a.m. page 4 M1NUrEa of RrenlAr Mocting of August 18, 1975 He spoke of the chain of command when an emergency arises. Mayor Marcham said he, the Public Works Foreman Robert Tyrrell, and the Engineer would get together with him and work it out. The Clerk gave her report and it is on file in the Village Office. Motion made by Trustee Randolph; seconded by Trustee Pimentel: RESOLUTION 2473 - PURCHASE ENVELOPES VOTED to authorize the purchase of 2,000 government printed, 10¢ stamped window envelopes for the Clerk for $227.40 and 500 overnment printed, 10¢ stamped regular envelopes for the Police Department for 56.45 or a total of $283.85. Unanimously passed. Motion made by Trustee Philbrick; seconded by Trustee Randolph: RESOLUTION 2474 - ANNUAL TRAINING SCHOOL VOTED to authorize the attendance of the Clerk or Treasurer at the Annual Training School for Fiscal Officers and Municipal Clerks to be held at Grossinger's Hotel from September 23 through 26, 1975. Unanimously passed. 16 Motion made by Trustee Randolph; seconded by Trustee Philbrick: RESOLUTION 2475 - RUM SEWER RENT VOTED to refund one sewer rent unit in an amount of $52.50 to Mrs. Sally Gibb of 509 Marren Road. A statement that it is now a one - family house has been filed with the Clerk. The Clerk is directed to correct the record. Unanimously passed. Meeting adjourned at 10:03 p.m. 0 Rose M.
