HomeMy WebLinkAboutPublic Hearing 6/18/1973PLC %c� VILLAGE OF CAYUGA HEIGHTS MINUTES of PUBLIC HEARING held Monday, June 18, 1973 at 7 :15 P.M. in the Village Hall to consider amending Article VIII - Sewers and Drains of the Ordinances of the Village of Cayuga Heights. PRESENT: Mayor F. G. Marcham; Trustees David J. Allee, Verne A. Fogg, Claire C. Nulle, Rane F. Randolph, Robert L. VonBerg; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen and Sergeant Floyd L. Darling, Jr., Fire Chief Ned G. Boice. OTHERS: Mr. Long ABSENT: Trustee Shailer S. Philbrick and Engineer John B. Rogers. The Hearing was opened by Mayor Marcham who explained that the hearing was duly advertised. He read and explained the desired changes and amendments to Article VIII. The Attorney suggested we add a new paragraph to Section 7. (o). Thepe being no further discussion the hearing was declared closed. MINUTES of a regular meeting of the Board of Trustees held at 7 :30 P.M. on June 18, 1973 in the Village Hall. PRESENT: 1¢ayor F. G. Marcham; Trustees David J. Allee, Verne A. Fogg, Claire C. Nulle, Rane F. Randolph, Robert L. VonBerg; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen and Sergeant Floyd L. Darling, Jr., • Fire Chief Ned G. Boice. OTHERS: Representative of The Ithaca Journal, Judith Horstman ABSENT: Trustee Shailer S. Philbrick and Engineer John B. Rogers. VOTED to approve the minutes of a regular meeting held May 21, 1973 and a Special Meeting held June 9, 1973 with one correction; substitute the work "reconciliation" for the word "compromise" in the fourth line after Resolution 2112 of the mimeo- graphed minutes. VOTED to approve the Abstract of Audited Vouchers dated June 18, 1973 in the following amounts: General Fund - $8,515.71, Sewer Fund - $3,674.26, Capital Fund - $1352948.19, Federal Revenue Sharing Fund - $5,677.35, Trust and Agency Fund $200.00. RESOLUTION # 2113 - STREET LIGHTING CONTRACT VOTED to request Attorney Sovocool to examine the contract between the New York State Electric and Gas Corporation and the Village of Cayuga Heights and report his findings at the next meeting. RESOLUTION # 2114 - CONTRACT FOR SEWER SERVICE • VOTED to instruct the Attorney to draw up a contract between the Town of Lansing and %:ne Village of Cayuga Heights for the Village to accept sewage from the Morse -Borg s ner plant which is outside a regular sewer district with the stipulations that ii. regulations in the Sewer Ordinances of the Village be met. Minutes 6/18/73 RESOLUTION # 2115 - DENY SEWER Page 2 VOTED to turn down the requests of MacDonald'a and Mr. Carl Winkleblech for sewer service because their property is located outside a sewer district and to inform the Attorney for the Town of Lansing, Robert I. Williamson, that these requests were denied because of two reasons, one being that other parties outside sewer districts might initiate similar requests and, two, the recollection that when an exception was granted the Holiday Inn the understanding was that steps would be taken to form another sewer district immediately. Mayor Marcham was instructed to write to the Convenient Food Mart to inform them that they must conform to the sign ordinance and that their request for a sign larger than allowed by the Ordinance was denied. RESOLUTION # 2116 - COMMISSIONERS APPOINTED TO SANITARY SEWER DISTRICT NO. 1 VOTED to approve the appointment by Mayor Marcham of David J. Allee to serve as a member of the Sanitary Sewer District No. 1 to represent the Village for a period of one year ending June 30, 1974 and reappoint Rane F. Randolph for the same term and office. There was a discussion concerning the request of Dr. Kenneth Felch to build a Medical Building which could accommodate three doctors on the lot of 110 North ® Triphammer Road. To allow the building, the need would be to change the boundary of the Commercial Zone or to make an exception to the zoning. The Board expressed regret but voted not to grant a change in zoning because it might open up the district on the north side of North Triphammer Road to commercial development. The Board instructed Mayor Marcham to write to Dr. Felch to express their deep gratitude for the service rendered the Village and to offer any assistance in finding a suitable location in the Village for his relocation. RESOLUTION # 2117 - CHARGES FOR SEWER INSPECTION AND WYE'S VOTED to raise the charge for outside sewer inspections from $5 per inspection to $10 per inspection beginning today and the charge for the labor cost to install a Wye connection $15 plus the cost of the Wye which at present is $15 for one 4" x 8" and $21 for one 4" x 10 ". The Attorney is instructed to negotiate the same with the Town of Ithaca through the present contract. ,t �t RESOLUTION # 2118 - REFUND $5 - FREDERICK BRYANT VOTED to confirm the $5 check written as a refund to Frederick Bryant for a zoning permit which he says was not issued correctly. .'he Board instructed the Mayor to write to Mr. Leonard C. Buyse stating that it is .;-,t possible to refund sewer rents when the status of the property on January 1st =arranted the charge. Minutes 6/18/73 Page 3 Received from Joseph P. Stone, Principal of the Cayuga Heights Elementary School, was a program for a Re- vitalized Playground Project for the School. The Board acknowledged receipt of the report and asked Trustee Nulle and the Mayor to make further inquiries and report back to the Board. RESOLUTION # 2119 - INTERMUNICIPAL WATER VOTED to cooperate with the Town of Lansing in their water crisis by allowing the transmission of water through the Village water lines on the basis that their will be no cost to the Village and the fire fighting capacity will not be curtailed by reason of pressure or water reserve. VOTED to record that we have received a letter of thanks from Mrs. Carl Nelson and her daughter for the contribution of $44.00 to the Shriners Crippled Children's Hospital in memory of Trustee Carl H. Nelson. Mayor Marcham reviewed the discussion which took place on the Bolton Point Water matter at the meeting held recently in the Town of Ithaca Office. Literature on this has been given all Trustees to study carefully and they are to be in a position to state their views when the Mayor calls a Special Meeting soon with the idea of signing the Agreement preliminary to the formation of a Commission to control the Bolton Point Water Project. Treasurer Gordon B. Wheeler reported his annual report is about done. He also reported on his attendance to the Annual Conference of Mayors meeting earlier this month which is on file in the Village Office. The Treasurer attended a State Inspection of the Sewer Plant Project on June 15, 1973 and the results are on file. The Treasurer is looking into the Appalachian Grant of $250,000 in addition to the Federal and State monies granted as aid in the sewer plant expansion program. Engineer John B. Rogers' written report is on file in the Village Office. It was previously sent Trustees in mimeographed form. Trustee Fogg suggested that the planting at the Fire Station now wait until fall for best results. Chief McEwen inquired about the condition of the shoulder of North Triphammer Road where cars pass on the right shoulder at its intersection with Winthrop Drive. Bob Tyrrell, Public Works Foreman stated the work was scheduled today but because of the rain it could not be done. The first day it does not rain the shoulder will be taken care of. Attorney Sovocool said he had nothing new to report. The Commissioners on the settlement of the land acquisition from Liberman had not reached an agreement on price as yet. Police Chief McEwen gave his report and it is on file in the Village Office. • RESOLUTION # 2120 - T. C. POLICE COMMUNICATIONS SYSTEM VOTED to authorize the Mayor to write to the Commissioner of Budget and Administra- tion of Tompkins County that the Village of Cayuga Heights has agreed to reimburse the County in the amount of $2,573.00 as their share of the Tompkins County Police Oamnunications System. It is understood that the equipment assigned to the Village will become the property of the Village of Cayuga Heights who will be responsible for the maintenance thereof. Minutes 6/18/73 Page 4 Police Chief suggested that the three abandoned bicycles be sold at the auction which the City of Ithaca is holding and the Board agreed it would be a good idea. • RESOLUTION # 2121 - APPROVE POLICE DEPT. PURCHASE VOTED to approve the expenditure of $12.95 by the Police Department to prepay when o --dering an E -Z Key Kit to be used to help in the situation where a person has been locked out of their car or house. Fire Chief Ned G. Boice gave his report and it is on file in the Village Office. The Fire Chief is going to get contractor's estimates on the repair of the roof of the older section of the fire station to correct the leak and report back at next meeting. RESOLUTION # 2122 - APPROVE PURCHASE FIRE DEFT. VOTED to approve the purchase of a one year old Motorola solid state radio as a replacement radio for the Chief's car at a cost of $300. After a short discussion concerning the transfer of one of the 1972 Police cars to the sewer department for use during inspection, it was decided not to do so but to have Mr. Tyrrell get prices on a pick up truck. • RESOLUTION # 2123 - ADOPT AMENDMENTS TO SEWER ORDINANCE VOTED to adopt the following changes and amendments to Article VIII as follows: "SECTION 1. USE AND PURPOSE The design of the sewer system is based on the collection of "sanitary" sewage only .....(the word sanitary replaces the word "domestic ") SECTION 7. IMPROPER USE OF SEWER AND PROPERTY. new (o) It shall be unlawful for any person, firm or corporation to discharge or cause to be discharged into any public sewer any water or wastes containing, in the opinion of the Village, any toxic or poisonous substance in sufficient quantity to injure or interfere with the Village sewage treatment process, to constitute a hazard to human beings or animals, or to create any hazard in the receiving waters of the sewage treatment plant or any waters containing, in the opinion of the Village, suspended solids of such character or quantity that unusual attention or expense is required to handle such materials at the sewage treatment plant. Change the present SECTION 10. PENALTIES to SECTION 10. POWERS AND AUTHORITY OF INSPECTORS • The Village Board shall authorize the Village Engineer and such persons as he may designate to make such inspections of sewer lines or connections, to collect such samples of sewer wastes, and to perform such other super- visory functions as may be necessary for giving effect to the provisions of the article. Minutes 6/18/73 Page 5 and renumber the following sections accordingly. • Effective June 25, 1973 Treasurer Wheeler suggested the Board study the solid waste disposal as he mentioned in his report on the Annual Meeting of the Conference of Mayors. Trustee Randolph suggested we appoint a representative to the Tompkins County Planning Board and have the problems of transportation reviewed occasionally. Trustee Fogg said that he was to report on a policy pertaining to sick leave but had not been able to get his information early enough for evaluation at this time but would report back later.
