Minutes 4/2/1973VILLAGE OF CAYUGA HEIGHTS MINUTES of a PUBLIC HEARING held at 7:30 P.M. in the Village Hall to consider the Budget for the fiscal year 1973 -74. There being no public in attendance the Mayor called the Public Hearing closed at 7:45 P.M. MINUTES of a regular Organizational Meeting of the Board of Trustees of the Village of Cayuga Heights held Monday, April 2, 1973 at 8:00 P.M. according to Village Law Section 87; PRESENT: Mayor F. G. Marcham; Trustees Harold R. Fisher, Verne A. Fogg, Claire C. Nulle, Shailer S. Philbrick, Rane F. Randolph; Treasurer Gordon B. Wheeler; Engineer John B. Rogers; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen. ABSENT: Trustee Carl H. Nelson; Fire Chief Ned G. Boice OTHERS: Judith Horstman, representative of The Ithaca Journal Mayor Marcham greeted our newly elected Trustee, Shailer Philbrick, and asked him to state his views concerning the student presentation of the Evaluation and Design of the Bolton Water Treatment Plant. This presentation was held in Hollister Hall, Cornell University today April 2, 1973 with consultants being Arthur H. Adams and Greeley and Hansen Engineers of Chicago. Trustee Philbrick said he thought attending this presentation gave him some back- ground for the Bolton Point Water project in which the Village is involved, and thanked the Mayor for suggesting he attend. VOTED to approve the minutes of a regular meeting of the Board of Trustees on March 18, 1973 copies of which were sent Trustees in mimeographed form. S VOTED to approve the Abstract of Audited Vouchers dated April 2, 1973 in the following amounts: General Fund - $1,595.23, Sewer Fund - $1,431.08. Mayor Marcham gave his report and it is on file in the Village Office. "The only item I have to present to you concerns the sales tax, specifically a proposal to alter the formula under which the Village receives its share of the tax from the Town of Ithaca. Under the present State Law the County distributes the Sales Tax collected in the County outside the City of Tthaca, on the basis of the population of the Towns. According to the population the Town of Ithaca receives its share. If a Village in Tompkins County asks for its share of the sales tax, as we did last fall, the Town must calculate the Village share in terms of the Village's assessed valuation, as compared to the Town's. The Torn of Ithaca has asked Mrs. Cook to introduce a bill with the following provisions: "Section 1262 -a. Sales Tax: Tompkins County outside the City of Ithaca. In the event that the County of Tompkins and the city of Ithaca both impose the same taxes described in sections twelve hundred two, three and ten of this chapter the county shall have power to impose or continue to impose such taxes on the area of the county outside such city up to the maximum rate authorized therefor. In such event, notwithstanding the provisions of the preceding section, the portion of the net collections received by the county by reason of its additional rate on such area, shall be allocated quarterly to the towns in such area in proportion to their • respective populations, and allocated between the towns and villages, if any villag el�ets to take its share in cash, in proportion to their respective populations, determined in accordance with the latest decennial federal census or special population census taken pursuant to section twenty of the general municipal law completed and published prior to the end of the quarter for which the allocation is made." 0 • Minutes 4/2/73 Page 2 No legal or other justification is offered for this change. The practical consideration, not mentioned at any point, is that in the eyes of the Torn of Ithaca, the Village gets too much money from the Sales Tax, alternately that the Town gets too little. Mrs. Cook has asked me to offer comments on the proposed change in the law. As the text now stands it appears that a section of the law applies solely to Tompkins County. I assume that the law which has been amended at least once since its original passage - allotted the Villages of Tompkins County their share of the sales tax on the basis of assessed valuation for a good reason. The Villages had no part in framing the law; the law conformed to the wishes of Tompkins County legislators or other local officials. My opinion is that the Board should recommend opposition to the proposed amendment. My opinion is that this proposal aims only at the Village of Cayuga Heights. Nothing is said of the effects on the other Villages in the County such as Trumansburg and Groton. The amendment seeks a single change for reasons not specified in a particular place, this Village." After a discussion the Board requested the Mayor to call Mrs. Cook immediately and request no action until the Attorney has researched the history of the law and has had time to give his recommendation to the Board. Robert I. Williamson, Attorney for the Torn of Lansing, came in with a request for sewer hookup of the proposed Borg Warner - "Morse Chain" - manufacturing plant which will be located outside the present Sewer District No. 2 of the Town of Lansing. His request is for a contract to service the plant the same as the Holiday Inn has a contract for sewer service. Engineer Rogers and T. G. Miller, Engineer for Lansing are to have a conference and formulate recommendations to bring before the Board as soon as possible. Lee Naegley appeared and confirmed Mr. Williamson's request. They both left the meeting. Trustee Randolph requested the Mayor to urge the Tompkins County Planning Department to present plans to solve the traffic problem facing the Village not only now but when the new Morse Chain plant is in operation. We are to invite Mr. Liguori to a Board meeting soon. Police Chief McEwen quoted statistics on traffic counts and said he was ready to make another. He will report his findings to the:Board soon. RESOLUTION •# 2078 - PURCHASE RADAR VOTED to authorize the award of the bid on the moving radar to Kustom Signals, Inc., Chanute, Kansas according to bid dated 3/23/73 as follows: 1 - MR -7 Radar System 11,970.14 less trade in for present Village system, $300 making a net price of 1,670.14. This price includes carrying case, tuning forks, mounting brackets, power cords and a guarantee for two years covering everything except abuse. In the absence of the Fire Chief no report was made. Engineer John B. Rogers presented a request from Frank Hanshaw on his formerly approved subdivision known as 112 North Triphammer Road. (Resolution No. 425 of the meeting of January 20, 1964.) # 2079 - HANSHAW SUBDIVISION VOTED to approve Frank Hanshaw - Spruce Lane Tract in the form now presented, as shown on a map dated 8/7/72 by F. Donald McKee, P.L.S., Walter J. Tennant, Jr. P.E. of Cortland, New York with the understanding that the sewer line be located off the pa,.ament of the road and that easements be obtained for access to the sewer line and that the cul de sac be enlarged to accommodate snowplowing and fire equipment for safe operation. Also to consult with the Fire Chief on the location of fire ln;:trant, and that the sight distance be approved by the Engineer. •7(• iF 9t Minutes 4/2/73 Page 4 Discussions took place concerning traffic, sight distances, etc. Trustee Fisher suggested thought should be given to setting a time limit on future approval of subdivisions. 40 RESOLUTION # 2080 - SPRUCE LANE - ESCROW VOTED that an escrow agreement be entered into between the Village and Frank Hanshaw whereby Mr. Hanshaw deposits with the Village a certified check in an amount to be approved by the Village Engineer for the final paving of Spruce Lane, the final paving to be completed within 18 months or such time as approved by the Board of Trustees. The escrow agreement to be prepared by the Village Attorney and executed by the Mayor. RESOLUTION # 2081 - REQUEST WATER SERVICE VOTED to authorize the Mayor to request the Ithaca Board of Public Works to grant a sufficient amount of water to serve the proposed main for Spruce Lane and the fire hydrant to be located there. The Engineer was instructed to have advertised in the trade journals etc. an ad for applicants for a sewer plant operator. Bolton Point Water source was a topic of much discussion. Mayor Marcham said we will have an informal meeting to look again at the proposed contract. Mr. Philbrick • said April 12 and 13th would be best for him. Engineer Rogers reported on the trouble Lawrence Marshall, Motor Equipment Operator, has been having with his back and the time he has had to be off work. The Engineer was told to write to the Mayor and get his recommendations along with a doctor's report. Attorney Sovocool reported on the status of the Lehigh Valley contract and the Liberman litigation. The appeal of the General Contractors of New York will be Argued on Ploy 14, 1973. The Clerk gave her report and it is on file in the Village Office. The report of the canvass for the elections held March 20, 1973 is as follows: David J. Allee 102 votes Verne A. Fogg 166 votes Claire C. Nullee 189 votes Shailer S. Philbrick 192 votes Francis W. Saul 84 votes Robert L. Von Berg 138 votes The three Trustees elected were notified within three days. VOTED to approve the appointment of Rane F. Rogers, Engineer for one official year at an annual salary of $5,355. John B. Rogers, Zoning Officer for one official year. Roger B. Sovocool, Attorney for one official year at an annual salary of $3,200. Rane F. Randolph, Acting Treasurer for one official year. David Pimentel, Village Forester for one official year. Paul Bradford, Auditor on a fee basis as authorized by the Board of Trustees. Harry G. Henn, Acting Village Justice for one official year at the rate of $15.00 per week of service. Carl B. Norberg, Member of the Zoning Board of Appeals for three years. (Carl B. Norberg's term expires.) Ronald E. Anderson, Member of the Zoning Board of Appeals for three years. (Ronald E. Anderson's term expires.) Ann McLaughlin, Member of the Zoning Board of Appeals for one year. (Fill vacancy created by the resignation of Orrin J. VanDyk.) RESOLUTION # 2082 - OFFICIAL DEPOSITORIES VOTED that the First National Bank and Trust Company and the Tompkins County Trust Company, both of Ithaca, New York be designated as official depositories of the Village funds for the 1973 -74 fiscal year. RESOLUTION # 2083 - OFFICIAL CHECK SIGNATURES VOTED that the Clerk be authorized to notify the official banks of the following names to be honored on checks for the fiscal year 1973 -74 (two signatures required). 40 1. Tierney, Clerk, or Helen B. Thomas, Deputy Clerk. RESOLUTION # 2084 - OFFICIAL NEWSPAPER VOTED that the Ithaca Journal be designated the official newspaper for the 1973 -74 fiscal year. RESOLUTION # 2085 - CLERK TO EXTEND AND LEVY TAXES VOTED to authorize the Clerk to extend and carry out upon the Assessment Roll, the amount to be levied against each parcel of real property shown thereon, according to the total levy of $161,814.22. RESOLUTION # 2086 - LEVY - SEWER LINES Vt7PED that the amount of $25,472.40 be levied upon the benefited properties in the • r_llage for the 1973 -74 fiscal year as special assessment on sewer lines. Minutes 4/2/73 Page 6 RESOLUTION # 2087 - LEVY - WATER IMPROVEMENTS • VOTED that the amount of $8,476.24 be levied upon the benefited properties in the Village for the 1973 -74 fiscal year as special assessment on water improvements. RESOLUTION # 2088 - LEVY - SIDEWALK VOTED that the amount of $5,725.65 be levied upon the benefited properties in the village for the 1973 -74 fiscal year as special assessment on the sidewalk district. RESOLUTION # 2089 - CLERK TO EXTEND SPECIAL ASSESSMENT CHARGES VOTED to authorize and direct the Clerk to extend and carry out upon the Assessment Roll as the amount to be charged against each benefited property shown thereon according to the total levies as follows: For Special Assessment - Sewer Lines $25,472.40 For Special Assessment - Water Improvements 8,476.24 For Special Assessment - Sidewalk District 5,725.65 RESOLUTION # 2090 - LEVY SEWER RENTS • VOTED that the amount of $115,972.50 be levied upon the benefited properties connected to the Village Sewer System for the 1973 -74 fiscal year. RESOLUTION # 2091 - CLERK TO EXTEND SEWER RENTS VOTED to authorize the Clerk to extend and carry out upon the Sewer Assessment Roll the amounts to be charged against each benefited property shown thereon according to the levy of 115,972.50. RESOLUTION # 2094 - REGULAR moriNG DATE VOTED to set the date for the regular meetings of the Board of Trustees for the 1973 -74 official year as the third Monday of each month. The next regular meeting will be May 21, 1973 with the Mayor calling a special meeting if the need arises. Trustee Fisher tendered his resignation due to his changing jobs and leaving the Village. He voiced his regrets and the Mayor and Board Members in turn said they were sorry to see him go. The Board decided Mayor Marcham should approach Mr. Robert L. VonBerg to succeed Trustee Fisher since he had the next highest vote count in the past election. Meeting adjourned at 10:25 P.M. Rose M. Tierney Village Clerk
