REPORT OF THE ENGINEER

STREETS
1p North Sunset Drive was opened to traffic the day before Christmas over the
culvert that was replaced to carry Remington Creek. Replacing of the entire amount
of fill and the size of the road was not possible because of the supersaturation
of the soil would not allow the angle of repose that was desired. This work will
be completed in the spring. About two feet of crusher run stone was placed for a
traffic wearing surface of the road which should compact to give a good base. If
potholes appear in this crusher run because of traffic, they will be temporarily
patched with the winter bituminous mix and in the spring a bituminous wearing surface
will be applied to the entire road surface. Temporary fencing at the side of the
road is in place and after winter settlement of the soil on the aides of the road
guard posts will be installed on each side of the road.
SEWER LINES
Testing with our air pressure sewer line tester indicated that the sewer line
in Upland Road from Hanshaw to The Parkway was in very bad shape. The tests
indicated that almost the entire length showed leaks. The decision was made to
replace the entire line and the first three sections (about one -third of the entire
distance) have been completed. Near the Cayuga Heights School entrance a 2" or 3"
hole was discovered in a water.main next to the sewer line which allowed a continual
flow of city water into the sanitary line. When this line is completed, the men
will move to Sunset Drive to replace a line that has been tested and found to need
repair. It is planned to continue the testing and repairing of sewer lines through-
out the winter whenever the weather and work schedule will permit.
0 SEWAGE TREATMENT PLANT
Mr. Ralph Garvin retired as of the end of December 1972 and his work will be
temporarily taken over by Mr. Steve Oltz of our public works force. He will work
two days a week and four hours on Saturday and four hours on Sunday at the Sewer
Plant; the remaining time he will spend with the road and sewer line crew.
NSW_SEWER TREATMENT PLANT ADDITIONS AND AMERATIONS
On December 20, 1972 notice was received that the Association of General
Contractors had started legal procedures to prevent us from opening bids or awarding
contracts for the sewer plant additions. Upon the legal advice of the Village
Attorney bids were opened and made public on December 21, 1972 as scheduled. A
tabulation of the bids is as follows:

The two questions raised in the legal action were the requirement that the
successful bidder on Contract No. 2 should be required to do the coordinating of
all other contractors and that the specifications were written on specific items
indicating brand name with the term "and or equal" following it. The Mayor, the
Engineer and a partner from Teetor- Dobbins who was present at the bid opening,
met with the Village Attorney after the bid opening and it was decided that our
attorney should meet with the attorneys for Teetor- Dobbins to plan the action that
should be taken to clear the legal obstacle so that the bid could be awarded within
the 45 day period from the bid opening date during which time the contractors can
be held to perform for the amount bid by them on the contracts. If the legal action
delays the award of bidding past the 45 days it might become necessary to rebid.
If this occurs, indications are that it would be costly to the Village.
Plans should be made by the Village to authorize the Engineers to provide
field inspection men to be available when construction on the pending contracts
starts. This field inspection is not covered under the overall fee paid the
Engineers according to the contract signed with them in July 1967. The cost of
the field inspection as put forth in the contract is the actual salary paid to the
inspection staff by the Engineers times a factor of 2 plus incidental expenses
approved by the Village and such compensations shall be billed and paid monthly.
The alternative of having the Engineer hire a complete inspection staff is for the
Village to provide some of the inspection staff or all of it to work with the
Engineer. It is proposed that the Village hire at least one man as a full time
Village employee to act as an inspector during the construction period under the
supervision of Teetor- Dobbins with the understanding that he would remain in the
employee of the Village or County to operate this setter plant upon the completion
of construction. This plan would insure continuity between the construction and
the operation phases as well as give valuable information in the future to the
operators on how the plant was constructed.
NDT PACKER
Additional phone calls have been made to our supplier for the Garwood Packer.
We are now informed that delivery of our new packer will be made the week of
January 15 or the week of January 22. The smoke emission from the diesel powered
chassis for the packer was discussed with Al Grant of Cayuga Motors. He assured
me that all Federal Standards for smoke emission were met in the design of the
exhaust system for the truck and that there would be no smoke emission except on
starts on very cold days. At all other times the only emission that you would be
• able to see from the exhaust would be heat rays or water vapor. The question was
raised as to whether there was addditional smoke emission control manufactured by
Ford for their diesel engines that could be added to what was already part of the
exhaust system we had purchased. Mr. Grant's answer was that there was no addition-
al such device manufactured by Ford. Mr. Grant again requested that Cayuga Motors
be paid for the chassis as they had fully completed all their obligations under the

contract with the Village and have had to wait over three months for their payment.
It is recommended that to keep the good faith of our supplier, Cayuga Motors, the
Village should make partial or complete payment upon receipt of a letter from
Cayuga Motors stating that they would stand back of and correct any deficiency in
the specifications for the truck chassis as bid.
