REPORT OF THE ZONING OFFICER

During the past month no zoning permits have been issued.
Upon examining the proposed development of the Sharp property,
I note that the setback distance to the south of buildings is
25 feet from the C. E. Treman property where 15 feet is required
under the present zoning laws and that on the north side of the
property there is no setback distance for the 5 foot fence
enclosing a small patio from the Remington Road property line.
There is a setback distance of 10 feet to a garage in one instance
and 22 feet to a building in another instance. The required setback
distance from all road right of ways is 25 feet in the present
zoning ordinance. In examining this request it should be kept in
mind that there is additional open land to the south of the Sharp
property extending some 700 feet. If approval is granted for the
Sharp property development, how would similar requests be handled
for development of the property to the south. I am also concerned
about the maintenance of property where it is done by a non - resident
owner. My observations throughout the Village have been that rental
property does not receive the same care as that of the individual
owner. I feel that the surrounding land in the Schickel proposal
which would be jointly held and maintained by a third party might
fall into this category.
Request has been received from Dr. Kenneth H. Felch for the procedures
necessary to rezone or grant a variance to him to build a medical
building at 110 North Triphammer Road. If such a building were
erected as his residence and an office for himself to practice in the
building there would be no rezoning or variance required. He has been
instructed to submit a plan to the Zoning Officer so a decision for
proper procedure can be determined.
