Minutes 11/20/1972VILLAGE OF CAYUGA HEIGHTS S MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held November 20, 1972 at 7:30 P.M. in the Village Hall. PRESENT: Mayor F. G. Marcham; Trustees David J. Allee, Harold B. Fisher; Verne A. Fogg, Carl H. Nelson, Claire C. Nulls, Rene F. Randolph; Engineer John B. Rogers; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen; Fire Chief Ned G. Boice. ABSENT: Treasurer Gordon B. Wheeler OTHERS PRESENT: Mr. Lewis, Mr. Blanpied and two others. Mayor Marcham read a letter dated October 28, 1972 from Stuart Lewis of 105 Winthrop Drive in which he requested the Village to assist him by removing deposits of gravel, etc. from his property.left there by the flooding condition earlier this year. He asked if the Village equirment could cut a deeper trench on his property for the flow of water around his residence. The Board members discussed with Mr. Lewis all the legal aspects of his case and Attorney Sovocool said the Village might have recourse to obtain an easement of the stream in order to do work if in the opinion of the Engineer there existed a con- dition which might prove a hazard to the Village property such as undermining the road. The Engineer stated that there was no such condition. Mayor P4archam closed the discussion at 8:20 P.H. saying to Mr. Lewis that he would be notified of the decision of the Board. • VOTED to approve the minutes of the regular meeting of October 16, 1972 as sent Trustees in mimeographed form. VOTED to approve the Abstract of Audited Vouchers dated November 20, 1972 in the following amounts: General Fund $9,879.67; Sewer Fund $2,240.06; Capital Fund Sewer $559.65. Mayor Marcham gave his report and it is on file in the Village Office. He reported the slow progress we are making in our dealings with the Army Corp of Engineers to get a Permit to lay a new outfall pipe in Cayuga Lake. A decision on the Bolton Point Water Source is in and it is favorable. In the next few weeks all parties concerned will meet to discuss the intermunicipal contract which will form the cornerstone of the new development. The City shall be informed at all times how discussions are going and any developments as they occur and the intermunicipal body will take such action as the City may wish in connection with the city water supply. As it appears the city has three ways to go: 1) they may have no need for more water after the Town of Ithaca and the Village no longer have need of water from them 2) in an emergency the Inlet water source has been approved but seems more costly 3) Cornell may be used as a backup for water if a reed arises. The sign ordinance was again discussed and there are still a few details to be worked out before any final wording can be reached so this was put over until the 40 next meeting. Minutes 11/20/72 Page 2 • Mayor Marcham gave the Board material regarding the proposal of Mr. Schickel for "cluster housing" on the Sharp property on Highland Road. He suggested that when they have had opportunity to study the maps and other documents they are to decide whether they wish to consider the proposal again or not. Mr. Graves, Chairman of the Board of Representatives, has written to remind the Mayor that the administrative body to manage the new County Sewer District N1 will need two representatives from the Village to join with representatives from the other municipalities. He wishes to submit the names of all parties to the County Board of Representatives at its meeting on December 18, 1972. According to the agreement made by the County Sewer Agency the new district will not take title of the Village Sewer Plant until the remodeling is complete and until the funds granted by the Federal and State Government's are in the hands of the Village. RESOLUTION 2026 - APPOINTMENTS OF RANDOLPH & FISHER VOTED to authorize Mayor Marcham to recommend Rane F. Randolph and Harold R. Fisher as representatives of the Village to serve on the Administrative Body to manage the new County Sewer District N1 and to forward these names to Mr. Graves, Chairman of the Tompkins County Board of Representatives. � r x Mayor Marcham also reported that over 30 sets of plans and specifications have • been obtained by contractors and suppliers for the bid opening'December 21, 1972 on the final phases of the expansion program for the wastewater treatment facilities. The Mayor has a letter from Mr. Frank Hanshaw regarding the land he intends to develop at 114 North Triphammer Road. He needs 12 water taps for the 12 lots. When the City allowed to us and other municipalities 400 taps for the present year we made a provisional agreement with the other municipalities regarding the apportionment of the taps among us. I will find out how many taps are still un- assigned and also the City's plans for allotting taps during the coming year. The Engineer wishes a judgment on policy for salting the streets this winter. We have the alternatives of a maximum program which would try to keep the streets clear at all times. We could go to the other extreme and depend as much as possible on the snow ploughs. Or we could find a middle position. The police department and the work force need to know which standard to apply. The procedure now agreed upon is for the police officer to report to Bob Tyrrell when he thinks action may be necessary. On the basis of the information received, Bob Tyrrell will use his ,judgment in deciding what to do. The Board wished the same policy to be used as Was used last winter. The Fire Chief has raised a number of issues. He points out that to exercise his responsibilities efY.ertively he should have a standard set of rules to apply. If he is to work under the New York State Multiple Housing Law, he needs to be clear as to his duties regarding registry of owner, issuance of permits, certificates of occupancy, enforcement, records and so forth. Do we intend to adopt formally • as our standard the State Building Code? Further should there be integration of the Zoning Officer's duties with those of the Safety Inspector? I suggest Trustee Fogg be asked to consider these matters, with a view to establishing, what might be called, guidelines to efficiency without entangling the Safety Inspector's office in a mess a red tape. e Minutes 11/20/72 Page 3 RESOLUTION 2027 - APPOINTMENNT - TRUSTEE FOGG VOTED to appoint Trustee Fogg to consider the matters pertaining to the requests of Fire Chief Ned G. Boice as they relate to the Safety Inspector in regards to the New York State Multiple Housing Law and the Fire Prevention Code, with a view to establishing guidelines without entanglement in red tape. k M N RESOLUTION 2028 - PUBLIC HEARING VOTED to hold a Public Hearing at 7:15 P.M. on Monday, December 18, 1972 to consider an amendment to the Village Ordinance, ARTICLE II - Fumigation and Fires, by adding Section 3, Fire Prevention Code. The wording of the amendment to be drawn up by Attorney Sovoeool. w • • RESOLUTION 2029 - ZONING MAPS VOTED to authorize the Clerk to have two thousand new Zoning Maps printed. The size and price to be negotiated. • RESOLUTION 2030 - SEWER RENT QUESTIONNAIRE VOTED to instruct the Clerk to mail a sewer rent questionnaire to property owners soon after the first of next week which will give time for the Trustees to come forth with any suggested changes in the format which is given out tonight. The . suggestions to be incorporated in the document which is mailed to the property owners. e � e Frre Chief Boice gave his report and it is on file in the Village Office. RESOLUTION 2031 - SELL USED FIRE SIRENS VOTED to authorize the Fire Chief to have the two sirens taken down from their .locations at Christopher Circle and the Fire Station at a cost of $150 and to accept the offer of Webbs Mill Fire Department to purchase these two fire sirens for the sum of $350.00. e * � olice Chief McEwen gave his report and it is on file in the Village Office. RESOLUTION 2032 - PERt7ANENT APPOINTMENT - RABIN VOTED to approve the permanent appointment of Lawrence H. Rabin to Police Patrolman at his present salary to be effective November 6, 1972. • rtes Engineer Rogers gave his report and it is on file in the Village Office. The work on the North Sunset Culvert is progressing but will take a few weeks longer before it is completed. Minutes 11/20/72 Page 4 The new Garwood Packer should be delivered within a week. The question of whether the diesel fueled motor on the truck has an emission control or not could not be answered. The Engineer will check it out. The Board felt it would be preferable to have one installed. It was decided that any plans for a paddle tennis court should be presented to the Board of Trustees for study since it is not mentioned in the Zoning Ordinances. Attorney Sovocool reported that he and the Engineer made an on site inspection in and around that property in question for the use of the succesful contractor for the laying of the additional outfall pipe to be used in the expansion program for the treatment plant. After discussion of the Lehigh Valley Railroad's proposals in an easement, it was decided that Attorney Sovocool try to obtain a permanent right -of -way for the outfall pipe and give up the Village reversionary interest. Attorney said the three year lease for Flavin's Jewelry is about ready for signing. The Clerk have her report and it is on file in the Village Office. RESOLUTION 2033 - 200 CAYUGA HEIGHTS ROAD VOTED to approve a change in address of Tax Map No. 15 -1 -3 from 310 -312 Kline Road to 200 Cayuga Heights Road as requested by Gerald F. Seitz who-is building on this piece of property. The Tompkins County Assessment Department to be notified. RESOLUTION 2034 - PURCHASE STAMPED PRINTED ENVELOPES VOTED to approve the purchase of 2500 government printed 8¢ stamped envelopes as follows: 1500 window and 1000 regular envelopes at a price of $232.95. The check to be written and mailed with the order. * * e The Board of Trustees again discussed the matter presented by Mr. Lewis and his request for assistance by the Village of removing silt and gravel from his private property and again the Board felt that it had no recourse to go on private property to relieve water damage.
