MINUTES of a regular meeting of the Board of Trustees held in the Village Hall
S at 7:30 P.M. on August 21, 1972.
PRESENT: Mayor F. G. Marcham; Trustees Harold R. Fisher, Verne A. Fogg, Carl H.
Nelson, Claire C. Nulls, Rane F. Randolph; Police Chief Harlin R. McEwen; Fire
Chief Ned G. Boice and Attorney Roger B. Sovocool.
ABSENT: Treasurer Gordon B. Wheeler; Engineer John B. Rogers; Trustee David J. All -
PRESENT: Dr. and Mrs. Sobel and Barbara Geehan, representative of the Ithaca Jour:-
The Mayor asked Dr. Sobel to state his request which was to erect a wall in front
of his property at 511 Wyckoff Road. After he explained why he requested the wall,
the Mayor related to the Board the opinion of the Attorney to the effect that the
wall would have to be placed on Village property and therefore the Village would
have to grant special permission. The Village Engineer thought it would very
definitely create hardship in snow plowing. After more discussion it was decided
that the Board members would make an inspection of the site and familiarize them-
selves with the situation and perhaps be better prepared to make a decision on
whether to allow the wall to be built or not, then report their findings to Dr.
and Mrs. Sobel.
VOTED to approve the minutes of the meeting of August 21, 1972 with the change as
follows: Omit the name of Bane F. Randolph from those present at the Public
Hearing held at 7:00 P.M. on the TV Cable Franchise.
VOTED to approve the Abstract of Audited Vouchers in the following amounts:
• General Fund - $16,391.57; Sewer Fund - $3,115.75; Capital Fund Sewer - $15,425.66
Mayor Marcham gave his report and it is on file in the Village Office. He reported
on a meeting of the Safety Committee with the Police Chief. It was agreed that
officers of the Police Department should be encouraged to take up and complete
training in Police Science courses. A possible formula is that officers whose
salaries are less than $10,000 annually be compensated at the rate of $200 per
annum for completing 30 hours of work and $400 per annum for completing 60 hours
of work. That if desirable compensation at this rate be awarded for lesser units
of work. Further that officers whose 'salaries are more than $10,000 annually be
compensated at the rate of $150 per annum for completing 30 hours of work and
$300 per annum for completing 60 hours of work. The Village will bear the expense
of tuition fees. It is understood that the rates of compensation set forth are
intended to apply to good academic work and may be varied upwards or downwards
according to the quality of the work performed by the officer.
There was a discussion on this and the Board decided to rework the wording and to
offer both an annual merit award and a plan similar to the one the Mayor presented.
The matter of the insurance coverage of the Village was brought up and discussed.
_t was decided to accept the coverage as presented by the Ithaca Agency for the
personal injury coverage to be decreased from $1,000,000 to $3002000. We will
u_ge our insurance carrier to pursue other insurance companies to cover the Village
on broader items of personal injury such as civil rights cases.
ire Mayor reported that the proposed new water system based on Bolton Point, stands
.a follows - a Public Hearing will take place on September 11th and that he has
r:giested that the Village of Cayuga Heights be allowed to be heard in favor of

Mr. Norbert Schickel and the Mayor met this afternoon to discuss his latest views
on development of the Sharp property located at 880 Highland Road. He proposed
a development that would provide 10 or 12 dwelling units, a number which, if
considered in terms of 5 or 6 houses on 5 or 6 lots, would be well within the
limits set by the Village. He proposes that he be allowed to locate these units
on this property in a central cluster. After a discussion it was decided by the
Board to have Mayor Marcham write to Mr. Schickel and have him present in writing
his plan before they could make any determination.
Mayor Marcham presented to the Board in the absence of the Engineer, a proposal
to have repair work done on a culvert on Winthrop Drive that was extensively
damaged during the flood for the amount of $612.00. Bob Tyrrell thinks the price
is reasonable and recommends we have it done. The Board concurred.
RESOLUTION # 1998 - TRAINING SCHOOL

VOTED to authorize the Mayor to send an officer to the secondary sewage treatment
seminar at Syracuse on September 149 1972 conducted by the Office of Environmental
Manpower.
Fire Chief Ned G. Boice gave his report and it is on file in the Village Office.
RESOLUTION # 1999 - REPAIR AIR CONDITIONER
VOTED to confirm the Mayor's action of approval for the air conditioner in the
resident driver's apartment to be repaired at a cost not to exceed $150.
Police Chief Harlin R. MCEwen gave his report and it is on file in the Village
Office.
RESOLUTION # 2000 - SCHOOL CROSSING GUARD
VOTED to dispense with the position of school crossing guard at the intersection
of Hanshaw Road and The Parkway during the coming school year with the understanding
that the officer be available as a replacement of the guard when necessary and
that the compensation for this work be at the prevailing rate.

Roger B. Sovocool presented a sample resolution for the Village to
c ^:ire in money its share of the County Sales Tax.

At a Regular Meeting of the Board of Trustees of the Village of Cayuga Heights,
Tompkins County, New York, held at the Village Office Building, in said Village,
on the 21st day of August, 1972, at 7 :30 o'clock P.M., Eastern Daylight Saving
Time.
The meeting was called to order by Mayor Frederick G. Marcham, and upon roll
being called, the following were
PRESENT: Trustee Harold R. Fisher
Trustee Verne A. Fogg
Trustee Carl H. Nelson
Trustee Claire C. Nulle
Trustee Rane F. Randolph
The following resolution was offered by Trustee Nelson who moved its adoption,
seconded by Trustee Nulle, to wit:
WHEREAS, it appears to the Board of Trustees that it is to the financial and
economic advantage of the residents of the Village of Cayuga Heights and of the
Village itself that the Board of Trustees accept its share of the amounts of money
collected by the County of Tompkins from the proceeds of the sales and compensating
use tax enacted pursuant to Article 29 of the New York State Tax Law be paid
directly to the Village of Cayuga Heights, New York in lieu of applying said
proceeds to reduction of county and general town taxes levied upon real property;
and
WHEREAS, there is statutory authority enabling this Board to provide that payment
be made directly to the Village by the County and said authority is contained in
Section 1262 (d) of the New York State Tax Law.
NOW, THEREFORE, BE IT
RESOLVED, by the Board of Trustees of the Village of Cayuga Heights that under the
provisions of Section 1262(d) of the New York State Tax Law that the Village of
Cayuga Heights hereby elects to have its share of the amounts of money collected
by the County of Tompkins from the proceeds of the sales and compensating use tax
enacted pursuant to Article 29 of the New York State Tax Law be paid directly to
the Village of Cayuga Heights, New York, in lieu of applying said proceeds to
reduction of county and general town taxes levied upon real property, and that
such payments be made to the Village according to law and deposited in the
General Fund thereof, and the Village Clerk is directed to file copies of this
resolution, duly certified, with the appropriate state and county governmental
agencies as may be required.
The question of the adoption of the foregoing resolution was duly put to a vote
on roll call, which resulted as follows:

The Attorney also reported the Hearing to determine the value of the land taken
from L. Liberman by condemnation will begin Tuesday, August 22, 1972 and we will
Obhave as x•:itnesses Rodney Fellows and Engineer Rogers with others on standby if
they are needed.
Police Chief asked the Attorney to advise us concerning a case of soliciting which
was dismissed by Judge Dean on the premise that we cannot deny a person the right
to solicit for his services. Attorney said we could file a notice of appeal
irnich would give us time to decide definitely what further action we wished to
take and the Board did not need to act upon this now.
RESOLUTION # 2003 - CHECK CONFIRMED
VOTED to confirm the Mayor's approval to write check number 2762, dated 7/31/72
for $75.89 tot he County of Tompkins for taxes on the land taken by condemnation
from L. Liberman.

Bift were opened at noon today for the removal of diseased elm trees from the
Village rights of way. Two bids were received as follows:
General Arborists (55 trees $2,430 plus $90 = $2,520.00
S & S Tree Service (55 trees $2,740.00
RESOLUTION # 2004 - BID - TREE REMOVAL
VOTED to award to General Arborists, the bid for tree removal of diseased elm
to Crean from Village right of way for the sum of $2,430 for the 53 trees as
advertised plus two more trees on Hanshaw Road at $45 each or a total of $2,520.00,
with the approval of the Engineer.

RESOLUTION # 2006 - CLERK ATTEND SCHOOL
TOTED to approve the Clerk's attendance at the Annual Training School for Fiscal
Officers and Municipal Clerks to be held October 3 - 61 1972 at Kutcher's,
Monticello, N.Y.

=:`ter the Attorney read the proposed sign ordinance he advised the Board that a
list of non - conforming signs should be made. If the Ordinance is adopted as it is,
40 this would be necessary to meet that section which deals with non - conforming signs.

VOTED to authorize the Clerk to advertise a Public Hearing to be held at 7:00 P.M.
on September 18, 1972 in the Village Hall to consider the adoption of a Sign
Ordinance.
RESOLUTION # 2008 - SEWER CHARGE PENALTY
VI)TED to inform Mary E. Tilley that the Board finds it necessary for her to pay
•che penalty on the overdue Sewer Charges for her four properties on Winthrop Drive
in the Town of Ithaca as described in her letter dated August 21, 1972.
