MINUTES of a Public Hearing held at 7.00 P.M., July 17, 1972 in the Village Hall
to consider changes in the TV Cable Franchise.
• PRESENP: Mayor F. G. Marcham, Trustees, David J. Allee, Harold R. Fisher, Verne A.
Fogg, Claire C. Nulle, Rane F. Randolph; Treasurer Gordon B. Wheeler, Engineer
John B. Rogers, Police Chief Harlin R. MCEwen; Fire Chief Ned G. Boice.
ABSENT: Trustee Carl H. Nelson and Attorney Roger B. Sovocool
OTHERS: Walter Wiggins, Attorney and Mr. Ceracche, owner of TV Cable, Mr. & Mrs.
Ross, Mr. Charles Smith; Mr. Richard Locke, Barbara Geehan, a representative of
The Ithaca Journal and Mrs. Hall.
Mayor Marcham said that the public hearing on the TV Cable Service was being held
more to inform the Villagers and give them a chance to speak than it was for
setting rates, etc.
Mr. Smith asked Mr. Ceracche questions about all customers receiving a schedule
of the times channels will be switched from one station to another. He explained
the difficulty of keeping up with changes and the frustration it caused.
Mr. Ross complimented Mr. Ceracche on the previous news of Channel two and asked
why it could not be continued instead of what is on now which he doesn't
particularly care about.
The Public Hearing was closed and Mr. Wiggins and Mr. Ceracche left.

to consider the wording of the Sign Ordinance. A discussion was held but in the
absence of the Attorney for clarification no conclusions were reached.
PRESENT: Same except Wiggins and Ceracche
Mayor Marcham closed the Public Hearing, no action will be taken tonight but after
cnnoultation with Attorney, action will be taken at the next meeting.

Heights held July 17, 1972 at 7:30 P.M. in the Village Hall..

Mayor Marcham asked Mrs. Hall to express her opinions. She spoke of a fence
erected by Roy Park that cuts off access by the Halls to their own property. She
agrees with the idea of the fence and if a locked gate could be made in the fence
with a key which they would be able to use, she thinks this would solve their
problem. The Engineer said he thought such an arrangement could be worked out.
VCiTED to approve the minutes of a regular meeting held June 19, 1972 as previously
furnished Trustees in mimeographed form.
• VOTED to approve the Abstract of Audited Vouchers dated July 17, 1972 in the
following amounts: General Fund - $25,940.81, Sewer Fund - $4,710.42.
Trustee Fogg reported on his trip to Corning and Elmira when he represented the
Village as a member of the group of mayors surveying flood disaster.

Mayor Marcham gave his report and it is on file in the Village Office. He reported
on the progress of the Secondary Treatment expansion program and that we will
receive over a millon dollars towards the construction through various Federal
and State grants.
The Mayor has worked on a possible dog ordinance and all Trustees have a copy
which the Mayor will be happy to have them go over and offer suggestions for any
changes before we hold a public hearing.
Mayor Marcham spoke on the ways and means that the Fire Department and others
helped for flood relief in the Elmira - Corning areas. George Hanselman, Secretary
of the Fire Company gave the Village a complete file on all the donations received
for flood relief and it is on file in the Village Office. Mayor Conley has set
up a Mayor's Relief Fund which is statewide and the New York State Conference of
Mayors will administer the money without charge. A check was handed to Mayor
Marcham by Mr. Dunston in behalf of the Merchants of the Community Corners who
collected it among themselves and had the aid of the young persons who ran a hot
dog and coke sale on the Village Green. The check is made out to the Mayors' Relief
Fund. The Board concurred that this check should be sent to the Conference of
Mayors and registered as from the Village of Cayuga Heights and all other moneys
received should be handled in just such manner. The Mayor said he would seek news
coverage of the Village recommendation that Villagers give money to the Mayors'
Relief Fund in Albany. He said that the Village Office would be open to receive
and forward such gifts and that he himself would thank individually those who
contributed.
Mayor Marcham read a letter from Mr. Locke concerning the water situation at his
property located at 1003 Triphammer Road. He asked that a second culvert be

installed. Mr. Locke was reminded that the position of the Village is that the
engineering study does not require a second culvert because his building at one
point is lower than the top of the present culvert but it would agree to another
culvert being installed at his expense should he wish it for his peace of mind.
Mr. Locke does not agree with this engineering determination. It was decided to
contact Mr. Buyoucos again as the Village Attorney on this particular situation.
Fire Chief Ned Boice has carried out an inspection of fire hydrants in the Village
to determine how easily recognized they are and whether they stand free so they
can be readily used. He reported many are surrounded by growth and hedge type
plantings and suggested a determination be made as to who should do the work of
clearing. After discussion it was decided that the Clerk is to write to the
property owners near the hydrants to ascertain if they wish to clear the hydrants
which are hidden by weeds or their plantings. If not, the Village workmen will do
it. The letter of the Clerk will set forth the standards to be met in clearing
the hydrants and the time when the work must be done.
RESOLUTION # 1988 - APPOINT RONALD ANDERSON TO ZBA
VOTED to confirm the Mayor's appointment of Ronald E. Anderson to the Zoning Board
of Appeals from June 26, 1972 to April 1, 1973 to fill the unexpired term of
William D. Gurowitz.
• The Mayor also reported that the Tompkins County Comprehensive Health Planning
Council, a body which seeks to persuade citizens and officials of the County to
offer recommendations for remodeling Tompkins County Hospital, will hold a meeting
at 8:00 P.M. on July 27, 1972 at the Women's Community Building in Ithaca. At
that time it will seek the advice of persons from the City and Town of Ithaca.

Trustee Randolph absented himself from the discussion on the TV Cable Franchise.
is RESOLUTION # 1989 - TV CABLE FRANCHISE
VOTED to take no action on the Ceracche TV Cable Service for the increase of
service rates in the Village but this decision is subject to change at the advice
of our Attorney who will be free to say whether we do or do not have jurisdiction
in the matter.
No action was formally taken on the Public Hearing to consider the wording of a
Sign Ordinance.
RESOLUTION # 1990 - CONFIRM RESOLUTION # 1968
VOTED to confirm the action taken at a Special Meeting held May 313 1972 on
Resolution # 1968.

RESOLUTION # 1991 - REFUND SEWER REND
VOTED to refund to Mr. Paul W. Eldridge, 223 North Triphammer Road the sum of
$30 representing an overpayment by him on his sewer rent for the current year
resulting from a lack of notice. The property drill be registered as a one family
dwelling unit for the remainder of the year.
Trustee Fisher asked how this type of misunderstanding could be avoided in the
future; perhaps be put into the ordinance. Mayor Marcham said perhaps it was
time to again send out a Sewer Questionnaire to ascertain the sewer units of all
properties connected to theffillage sewer system.
Ned G. Boice as proprietor of Ned's Corners Station (Esso) has requested permission
to change one of his service islands to a self service operation and to erect
certain signs which would be appropriate for this service.
Mayor Marcham told Mr. Boice that he wishes the Zoning Officer to study his
proposal and report back at the next meeting.
Fire Chief Boice gave his report and it is on file in the Village Office.
RESOLUTION # 1992 - PURCHASE REFRIGERATOR FOR APT.
VOTED to authorize the purchase of a refrigerator for the apartment used by the
resident driver in the Fire Station for the sum of $316.95. This amount to be
charged against the Fire Department Equipment Fund.

Police Chief McEwten gave his report and it is on file in the Village Office.
• RESOLUTION # 1993 - POLICE CHIEF ATTEND CONFERENCE
VOTED to authorize Police Chief McL%,7en to attend 'the Police Chief's Conference at
Niagara Falls, July 23 -27, 1972 and the necessary expense to be met by the Village.

Engineer Rogers gave his report and it is on file in the Village Office.
RESOLUTION # 1994 - REPRESENTATIVE FOR FLOOD DAMAGE
VOTED to authorize Engineer John B. Rogers as the Village representative who has
authority to represent the Village in all negotiations for Federal reimbursement
for flood damage.

VOTED to award the bid for a truck chassis to Cayuga Motors for one 1972 Ford
LN -8000 F.O.B. Rayne, Michigan, 225 H.P. Caterpillar V8 diesel engine truck chassis
for $10,559.00. Delivery to be within 60 days of award.

• VOTED to award Erb Company, Inc. of Buffalo, New York the bid for a Cherne Air -Loc
System, complete with 6 ", 8", 10" and 12" air -loc balls at a price of $3,963.00.

Engineer Rogers reported that he and Roger Morse have examined the situation
concerning the bees in the wall of the Judge's Office. A program will begin soon
to remedy the condition.
As Zoning Officer Mr. Rogers has received a request for a subdivision of a lot
owned by Mr. Bradfield on Sheldon Road. There are circumstances which require
that Attorney Sovocool look over the deeds to the property and determine if they
support Mr. Bradfield's view that his property originally consisted of 4 lots,
or one lot, as shown on the present Village map.
Police Chief asked the Engineer about the striping of the streets and cross vialks
as he has had complaints from the PTA and others. Engineer related the reasons
why they are not done as yet but should be done soon.
Trustee Fisher asked the Engineer if perhaps the wrong tar was used this year in
the road resurfacing because it seem to liquify so readily in hot weather. Trustee
Mee confirmed this. The Engineer will check it out.
The Treasurer gave his report for the fiscal year 1971 -72 and it is on file in
the Village Office. The Board accepted the report which included the following
balances:
