• MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga
Heights held Monday, June 19, 1972 at 7:30 P.M. in the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees Harold R. Fisher, Verne A. Fogg, Claire
C. Nulle, Rane F. Randolph; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool;
Engineer John B. Rogers; Police Chief Harlin R. McEwen; Asst Fire Chief Richard
A. Vorhis.
OTHERS: Anthony Ceracche and his attorney, Walter Wiggins, Rocco P. Lucente, a
representative of the Ithaca Journal and Trustee Randolph's son.
Mayor Marebam asked Mr. Wiggins to state his requests which he did. After a
discussion about the State's assuming control of TV Cable next January and other
points the Board decided to hold a public hearing on matters pertaining to the
TV Cable rates. Trustee Randolph absented himself from the discussion.
RESOLUTION # 1971 - PUBLIC HEARING - CABLE TV
VOTED to hold a Public Hearing at 7:00 P.M. on July 17, 1972 to consider the
proposed changes in the contract between the Ceracche Television Corporation and
the Village of Cayuga Heights.
Rocco P. Lucente was asked to state his request. He requested a refund of sewer
• charges in connection with the payment under protest for the past two years of
sewer charges especially on his properties on Sapsuckerwoods Road.
Mayor Marcham and Zoning Officer Rogers discussed the occupancy etc. of these
properties with Mr. Lucente and he was requested to have in writing by the first
week in July, the occupancy of each apartment under question during that period.
The Board $rill study his written statements and arrive at a decision concerning
refund of sewer Tents at the next meeting.
VOTED to approve the minutes of a regular meeting held May 15, 1972 and a Special
Meeting held May 31, 1972.
VOTED to approve the Abstract of Audited Vouchers dated June 19, 1972 in the
following amounts: General Fund $16,o43.26, Sewer Fund $2,492.04, Capital Fund
Sewer $685.02.
Mayor F. G. Marcham gave his report and it 9.s on file in the Village office. The
Mayor related his observations concerning e. dog ordinance after going over some
copies sent to him by the Conference of Mayors. The Board asked Mayor Marcham
to draw up an ordinance as a start in order to reach a final solution and adopt
a dog ordinance.
The Engineer and the Mayor met with representatives of Teetor- Dobbins to discuss
possible study by Teetor- Dobbins of the Bolton Point Water Program. We said a
preliminary study was all we needed. They said they would read some of the earlier
• reports on the water problems of this area, would look at the recommendations
of the Lozier Company, and would tell us what they thought they might do. The
Village Board would then have the opportunity to make a judgment about the kind
of study proposed and the cost of it.

• RESOLUTION # 1972 - PUBLIC HEARING - SIGN ORDINANCE
VOTED to hold a Public Hearing at 7:15 P.M. on July 17, 1972 to consider the
wording of a sign ordinance.
Mayor Marcham requested the Board to fix procedure before we get any further into
the granting of Burglar Alarm Permits. Our normal procedure calls for payment of
the fee; issuance of receipt and appropriate entry in our records to be the
responsibility of the Clerk and the Treasurer.
RESOLUTION # 1973 - SELL POLICE CARS
VOTED to authorize the Clerk to advertise for bids for the selling of the two
used 1971 Ford Police cars at a price not less than $1500, to be awarded by the
Treasurer, Mayor and Police Chief.
The State Health Department and the County called the City of Ithaca and the
surrounding municipalities to a meeting on the 15th of June to hear the State
and County Officials affirm that they would not consider the Inlet and the Bolton
Point projects unless the parties involved agreed to one another's request for
a permit. Harold Fisher and Engineer Rogers represented the Village at the meeting.
Trustee Fisher spoke on this stating the State and County Department of Health
• insist that there must be cooperation before the Departments will approve either
project. The hearing for the Inlet is scheduled for June 29 and the State asked
for a letter of request to be heard at the hearing.
RESOLUTION # 1974 - INLET WATER SOURCE HEARING
VOTED to authorize Mayor Marcham to appear before the State Public Hearing, June 293
1972 to present the endorsement of the Village of the City's application for water
at the Inlet.
The Treasurer was asked to give his report. He attended the Annual Meeting of
the Conference of Mayors earlier this month. He thought he would be recommending
that the Village seek their share of the Sales Tax but wished to study it further.
He said he had met a man from the Federal Government and talked with him about
grants. He has received literature on these matters and will study them later.
Assistant Fire Chief Vorhis gave the report for the Fire Department in the absence
of Chief Ned G. Boice who was attending a Demonstration of Fire Fighting Equipment.
The written report is on file in the Village Office.
RESOLUTION # 1975 - TELEPHONE EXTENSION - BUNK ROOM
VOTED to authorize the installation of an extension of telephone number 257 -2377
to be located in the bunk room at the fire station with the understanding that no

personal long distance calls will be made from this phone. The installation
charges will be the responsibility of the present bunker but the Village will pay
the monthly charge of $2.46 for the extension.

RESOLUTION # 1976 - VILLAGE HALL CONNECT - FIRE ALARM SYSTEM
VOTED to authorize the connection of the present fire detection system in the
Village Hall to the alarm system at the Fire Station at the following rates:
Monthly charges for leased line $4.96; Installation Charge $50.00; Installation
of relay and switch $75.00.

RESOLUTION # 1977 - FIRE DEPT. PURCHASE
VOTED to authorize the Fire Department to purchase from the Clerk's Office the
used IBM typewriter for the proposed trade -in value of $115.00.
RESOLUTION # 1978 - FIRE DEPT. PURCHASES
VOTED to authorize the following purchases for the Fire Department: Air horn
alerting system, $1,300.00; Standby 3.5 Kilowatt generator, $414.00; Conversion
parts for two masks, $263.34; First aid equipment, $150.00; Fire Police Equipment,
$100.00; Bolt cutters, $31.05; Tone Alerting Encoder, $400.00; Portable
resuscitator, $300.00; 2 spare air tanks, $142.50. These have been approved by
the Fire Council and total $3,100.89.
Police Chief McEwen gave his. report and it is on file in the Village Office. A
Stop Sign was placed on Oak Hill Place at its intersection with Oak Hill Road on
• a temporary basis as of June 2, 1972. The trial period will be 120 days.
RESOLUTION # 1979 - DEAD END SIGN
VOTED on the recommendation of the Chief of Police to erect a temporary dead end
sign as specified by law near the intersection of Texas Lane and North Triphammer
Road. Also to notify the Supervisor of the Town of Ithaca that a dead end sign
should be erected in the Trnm of Ithaca near the end of Texas Lane as specified
by law.
Engineer John B. Rogers gave his report and it is on file in the Village Office.
Bids for a Refuse Collection Packer Truck Body were opened June 16th and the
Engineer has recommended we accept the bid from Southern Tier Truck Equip. Inc.
as it is the lowest bid which meets the technical requirements of the specifications.
Bids received were as follows:

RESOLUTION # 1980 - AWARD BID - PACKER
VOTED to authorize the purchase of a refuse collection packer truck body from
Southern Tier Truck Equipment, Inc. for the price of $8,374.20 as quoted, this
bid offering the lowest priced truck body that meets the specifications at the
opening of bids.
The Engineer was requested to check into the specifications of the Loadmaster Model
111 120 demonstrator included in the bids and offered for $16,928.
RESOLUTION # 1981 - BID FOR TRUCK CHASSIS
VOTED to authorize the Clerk to advertise for bids on a truck chassis for the
20 cubic yard refuse collection packer body and the Engineer to draw up the
specifications to be advertised. The specifications to have alternates for a
gasoline and a diesel fuel engine.
RESOLUTION # 1982 - BID - INFILTRATION DETECTING MACHINE
VOTED to authorize the Clerk to advertise for bids for a piece of equipment using
air pressure for the detection of leaks in setter lines and the Engineer to furnish
the specifications.
Mayor Marcham turned the meeting over to Deputy Mayor Rene F. Randolph at this
time - 9:45 P.M.
# 1983 - MRS. KERR - STREET LIGHT
VOTED to authorize the installation of a street light on Cayuga Heights Road just
south of the north line of the Village.
RESOLUTION # 1984 - STREET LIGHTS - NORTH SUNSET DRIVE
VOTED to authorize the installation of three street lights on North Sunset Drive
between the intersections of Remington Road and Cayuga Heights Road.
Engineer Rogers reported that with the recent rains although we have a sizeable
flow at the sewer plant it did not overflow indicating that we are making progress
on the infiltration and that the Towns of Ithaca and Lansing were working at the
problems in the respective sewer lines.
The Engineer also asked the Board to press the enforcement of the Ordinance
concerning certain properties which are going to rack and ruin.

RESOLUTION # 1985 - ENFORCE ORPINANCE - ARTICLE III
VOTED to authorize the Mayor to send formal notice of violations to property
owners whose property does not conform to the requirements of Village Ordinance
Article III and further, if the owners do not bring their property into conformity,
the Board of Trustees shall cause the work to be done and assess the expense,
including time of supervising officials, against the property.
Zoning Officer Rogers gave his report and it is on file in the Village Office.
He also reported the action of the Zoning Board of Appeals on the hearing appeal
of Mr. Rosenblum. The Board denied his petition to erect a fence on a lot line
higher than the four feet allowed. Also reported is a hearing called for 8:00 P.M.
on June 26, 1972 to hear an appeal from Mr. Klaer for a division of his property
at 106 Highgate Road into two properties.
Mr. Roy Park has signed a statement that he conveys the title to the six foot
fence erected at the end of the turn around on Sunset Drive to the Village of
Cayuga Heights and specifically acknowledges that this act in erecting the fence
does not operate to vest any property rights in himself or to deprive any other
persons who now have property rights from their right of enjoyment thereof.
Roy Park further agrees to maintain the said fence and if he fails to do so the
Village of Cayuga Heights shall have the right to take it dolrm or to replace it
with any other type of fencing. In return, the Village agrees to leave the fence
in its present location so long as it shall not interfere with the rights of the
Village or their use of the property.
iThe Village further acknowledges that the erection of the said fence should not
affect any property rights of adjoining land owners either to the east or to the
west.
Attorney Sovocool will push for a hearing on the settlement of the Condemnation
on the land taken from L. Liberman.
Attorney Sovocool spoke of the request of Mr. Flavin to renew his lease of that
portion of the Village Hall now used as Flavin's. His wish is for the lease to
terminate at a more convenient time of year. It was decided to refer the matter
to the Treasurer for recommendation as to whether the amount of rent should be
increased or not.
RESOLUTION # 1986 - REQUEST PROPERTY TO BE EXEMPT
VOTED to authorize the Attorney to request that the Village property within the
Town of Ithaca on East Shore Drive be made exempt from property taxes and authorize
the Mayor to sign a petition for the exemption if it is necessary.

RESOLUTION # 1987 - TRUSTEE NELSON - RECOVERY
VOTED to request the Mayor to write a letter to Trustee Nelson to send wishes for

a speedy recovery and regrets that he has been unable to attend the meetings.
