MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga
• Heights held at 7 :30 P.M. Monday, May 152 1972 in the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees David J. Allee, Verne A. Fogg, Carl H. Nelson.
Claire C. Nulle, Rene F. Randolph; Treasurer Gordon B. Wheeler; Engineer John B.
Rogers; Attorney Roger B. Sovocool; Police Chief Harlin R. McEwen; Fire Chief
Ned G. Boice.
ABSENT: Trustee Harold R. Fisher
OTHERS PRESENT: Walter Wiggins, Attorney for Ceracche TV Corp., Mr. Hahn and
Ithaca Journal representative Dick Brass.
VOTED to approve minutes of the Organization Meeting held April 3, 1972 and a
Special Meeting held April 19, 1972 as previously furnished Trustees in mimeo-
graphed form.
VOTED to approve the Abstract of Audited Vouchers dated May 15, 1972 in the
following amounts: General Fund - $29,569.543 Sewer Fund - $2,732.18, Capital
Fund - $5.67.
Mr. Wiggins was asked to present to the Board his statements concerning the
proposed increase in cable rents as they affect the franchise for the Cerrache
TV cable.
After discussion Mayor Marcham told Mr. Wiggins we would take the matter under
• advisement and so advise him of the Board's decision. Trustee Randolph absented
himself from this discussion since there may be a conflict of interest.
Mayor Marcham gave his report and it is on file in the Village Office. Mayor
Marcham reported on the present status of the County Sevier District stating that
on May 23rd the referendum will take place. The Law allows each municipality to
urge voters to cast their votes: it does not allow them to advise voters which
cause to support. I shall, he said, write a letter to villagers setting forth
the facts as objectively as I can. One of the facts is that 15 months ago
villagers approved by a vote of 3 to 1 the formation of the proposed district
and they did so at a time when the unit charge in the new district was.caloxilated
to be about $90. The present estimnte is about $63.
The Mayor mentioned our good fortune in getting an increase in our Federal Grant
for sewer remodelling. The increase is $142,124.00 raising our total from this
sonrce to $882,354.00.
The Mayor also told of correspondence and telephone calls complaining about dogs.
The Police Department reports some 16 complaints since January lat. There were
four children bitten by dogs in that period of time.
A discussion brought out the complications of enforcing a dog ordinance and that
there are only a few perhaps under twenty dogs that are the real trouble makers.
It was decided that the Mayor should write to the owners of nuisance dogs as a
control effort but to write to the Conference of Mayors for any help they may be
able to give concerning Dog Ordinances. Attorney Sovocool is to check with the
• City of Ithaca to ascertain what parts of their Dog Ordinance would best suit the
Village. Perhaps the ordinance could be written so as to handle only the complaints
about dogs that had acted viciously or were a nuisance. The matter was tabled
for the present.

Mayor Marcham asked to be allowed to study the proposed sign ordinances before
it was discussed at the Board meeting so this matter was tabled. A committee
has been working on the financial problems of the Water Agency and we hope to
have a report in the near future.
The Mayor also reported that Mr. Roy Park has not moved the fence he installed
on Village property at the north end of Sunset Drive. He suggested that we tell
him that if the fence is still there at the end of this month, we will remove it.
There was a discussion on merit reward for the police for their efforts in taking
courses of study in Police Science. The Board agreed that they wished merits to
be given but have not arrived at the way to do it; therefore this matter was
tabled.
RESOLUTION # 1952 - APPOINT POLICE CHIEF - MCEWEN
VOTED to approve the appointment of Harlin R. McEwen as Police Chief on a six
months probationary period beginning April 24, 1972. The salary,to be $10,810.00 on
an annual basis from April 24 to June 1, 1972. From June 1, 1972 to the end of
the probationary period the salary to be $11,336.00 on an annual basis.
RESOLUTION # 1953 - REFUSE SIGN REQUEST
VOTED to refuse the request of the representatives of Nationwide Insurance to
erect a sign on a 2" pipe approximately seven to eight feet high 19 -5/16 x 35 -1/2 x
• 2 double faced - dimensional in front of their office at 408 East Upland Road.
Fire Chief Ned G. Boice gave his report and it is on file in the Village Office.
On the matter of the Village Hall connecting to the Fire Alarm system at the
Fire Station, it was decided that the Fire Chief find out the exact costs and
report back to the Board.
RESOLUTION # 1954 - APPROVE REPAIRS - FD
VOTED to authorize repairs to Engine 2 of rusted body panels and - compartments at
Auto Body Works Shop at a cost of $188.
RESOLUTION # 1955 - SCHOOLS - NED G. BOICE
VOTED to authorize the attendance of Ned G. Boice to the following schools:
Niagara Mohawk Training School, Oswego, New York, September 6 and 7, 1972, the
cost not to exceed $50.00 and Fire Inspectors Seminary at Montour Falls, New York,
October 17, 18 and 19, 1972 the cost not to exceed $30.00.

RESOLUTION # 1956 - APPOINT DARLING - SERGEANT
VOTED to approve the appointment of Floyd L. Darling, Jr. as Sergeant on a six
months probationary period beginning May 16, 1972 at an annual salary basis of
$9,915.00 until June 1, 1972. Beginning June 1, 1972 until the end of the
probationary period the salary to be on an annual basis of $10,517.00.

RESOLUTION # 1959 - AWARD BID FOR PACKER
VOTED to accept the bid of the Binghamton Equipment Corporation, Vestal, New
York for a new 20 cubic yard Heil Packer, Mark III for $6,692.00 plus Alternate
#1, 2 cubic yard bucket 80 inches wide - $50.00, minus Alternate #2, trade in of
International truck chassis with Truxmore packer body - allowance $250.00. The
cost to be $6,492.00 with delivery 10 days after the truck chassis is received
for mounting of the Heil packer body.
• The Engineer reported more problems with the digester at the sewer plant. The
original pipe placed under concrete seems to be the problem and a new pipe is
being installed which appears to be the correction solution.

It was decided that the large gasoline tank should be filled henceforth with
regular gasoline and the two fire trucks which use premium gasoline should

purchase from a local source.
Mrs, William T. Kerr has again requested a street light be installed near her
home at 706 Cayuga Heights Road. She requested this over a year ago and because
of the extreme darkness in this section of the Village, she had a power company
courtesy light placed on her property pending the Board's action on a street
light. After discussion it was decided to get more definite information and
costs before acting.
Attorney Roger B. Sovocool reported on the complaint of Charles Smith and that
negotiations are proceeding.
In the matter of a claim against the Village by Brian O'Neil, a youngster, who
received injuries from a fall on a sidewalk in the Town of Ithaca, the allegations
are that the Village of Cayuga Heights maintains the sidewalk and failed to
remove snow and ice from the same causing the accident. Attorney for our insurance
carrier, Robert J. Clune, in a letter dated 5/12/72 wrote, "There is an exam-
ination before trial scheduled for June 7, 1972, at 1:00 P.M. and it is required
that we have a representative from the Village of Cayuga Heights attend that
examination before trial.
It is my understanding that the Village employee involved was one, Larry Marshall
and I request that you have him in my office at 12:15 P.M. on that date with any
records that he has with respect to the plowing of that sidewalk so that I may
discuss his testimony."
• The Board decided that the Engineer should represent the Village in this matter.
The Attorney also reported that Mr. Liberman had filed an appraisal on the
condemned land for an amount of $172,200 claiming that it was suitable for a
high rise apartment complex. We on the other hand filed an appraisal of $3,500
claiming the land is suitable for no more than a parking lot.
The Clerk gave her report and it is on file in the Village Office.
RESOLUTION # 1960 - ACCEPT STATE AUDIT
VOTED to accept the Report of E::amination of the State of New York, Department
of Audit and Control, Division of Municipal Affairs for the period June 1, 1967
through May 31, 1971. This report has been examined by all members of the Board
of Trustees.

RESOLUTION # 1962 - PURCHASE ENVELOPES
• VOTED to approve the purchase of 1500 Government printed stamped envelopes for
$140.55. The check to be written and sent with the purchase order.
