MINUTES of a regular meeting of the Board of Trustees held Monday, September 20,
1971 at 7:30 P.M. in the Village Hall.
• PRESENT: Mayor F. G. Marcham; Trustees David J. Allee, Harold R. Fisher, Verne A.
Fogg, Carl H. Nelson, Claire C. Nulle, Rane F. Randolph; Treasurer Gordon B. Wheeler;
Engineer John B. Rogers; Attorney Roger B. Sovocool; Police Chief Jack W. McGraw, Sr.'
Fire Chief Ned G. Boice.
OTHERS: Representatives of The Ithaca Journal and radio stations.
VOTED to approve the minutes of a regular meeting held August 16, 1971 as previously
furnished trustees in mimeographed form.
VOTED to approve the Abstract of Audited Vouchers dated September 20, 1971 in the
following amounts: General Fund - $16,582.88; Sewer Fund - $12,353.27; Fire Station
Building Fund - $1,275.79•
The Mayor gave his report and it is on file in the Village Office. He reported on
the progress of the construction and reconstruction program of the Waste Water
Treatment Facilities. It is moving forward at the intended pace.
RESOLUTION # 1868 - CONFIRM LAST RESOLUTION
VOTED to confirm resolution number 1867 of meeting held September 7, 1971.
e RESOLUTION # 1869 - REINSTATE FULL TIME POLICE PROTECTION
VOTED to reinstate the full time police protection coverage program at 11:00 P.M.
September 25, 1971 with the understanding that the added cost of the program will
stay within the existing police budget with the exception of any emergencies that
may arise.
Mayor Marcham is to write a letter to the Fire Council explaining the feeling of
the Board on matters reported in a letter from the Secretary of the Fire Council,
and in addition the Board agreed that the Mayor transmit a copy of the Fire Council
letter to the Engineer and Superintendent Tyrrell with the suggestion that they
accomplish as much landscaping as they can in the next two months and that in
technical matters relating to road building and the like they do such work as they
think necessary and at such times as they think appropriate, in the light of their
own professional judgment.
Mayor Marcham reported also that the Village is eligible for an advance payment of
up to 5% of the estimated reasonable cost of the Waste Water Treatment Project to
defray expenses incurred prior to project construction.
RESOLUTION # 1870 - DESIGNATION OF FISCAL OFFICER
RESOLUTION of Village of Cayuga Heights Designating a Fiscal Officer to Make
• Application for, to Receive and to Distribute Funds (Section 1263 -b of the Public
Health Law)
WHEREAS, Section 1263 -b of the Public Health Law of the State of New York provides
financial aid for the construction of sewage treatment works with an advance payment
for the purpose of assisting the municipality in defraying expenses of an eligible
project incurred in advance of construction; and

WHEREAS, Village of Cayuga Heights, 836 Hanshaw Road, Ithaca, New York 14850,
hereinafter called the APPLICANT, has made Application for STATE Aid for Construction
of Sewage Treatment Works, State Water Pollution Control Project Number WPC -NY -605;
and
WHEREAS, the municipality has formally accepted the Offer of Federal Pollution
Abatement Assistance pursuant to the provisions of the Federal Water Pollution
Control Act and amendments thereto; and
WHEREAS, it is necessary that an application be made for such State Aid on behalf
of Village of Cayuga Heights, now
THEREFORE BE IT RESOLVED BY The Board of Trustees, the governing body of said
APPLICANT, as follows:
1. That Gordon B. Wheeler, Treasurer be designated as the Fiscal Officer of said
Applicant to make application for advance grant and to receive and distribute such
funds as the authorized Fiscal Officer of the Applicant in connection with said
project; and
2. That five (5) Certified Copies of this Resolution be prepared and sent to the
New York State Department of Health, Albany, New York, together with the signed
voucher; and
3. That this Resolution shall take effect immediately.

RESOLUTION # 1871 - PUBLIC HEARING
VOTED to hold a Public Hearing at 7:00 P.M. on October 18, 1971 to consider
amending Article VI, Section 60 Stop and Yield Intersections by adding a stop sign
on Winthrop Drive.

RESOLUTION # 1872 - APPOINTMENT OF PATROL44AN RABIN
VOTED to provisionally appoint to full time patrolman, Lawrence H. Rabin, effective
September 21, 1971 at the rate of $7,384 annually.
VOTED to approve the attendance of two patrolmen at the State Police Breathalizer
School, State Police Academy, Albany, New York for one week each at a cost of
$65.00 per man.
The Fire Chief gave his report and it is on file in the Village Office.
i RESOLUTION # 1873 - APPROVE PURCHASES BY FIRE DEPARTMENT
VOTED to approve the purchase by the Fire Department of the following items:
One Base Radio Station - $915, Decoder - $202, Scanner - $200, and miscellaneous
wires, switches and lights - $75, for a total of $1,392.00.

The Treasurer gave his three months report and it is on file in the Village Office.

RESOLUTION # 1874 - ACCEPT REPORT OF AUDITOR
VOTED to accept with thanks to Mr. Paul Bradford his report of audit of the books
of Treasurer Wheeler for the fiscal year 6/1/70 - 5/31/70.
The Engineer gave his report and it is on file in the Village Office. He mentioned
that the infiltration at the plant is improving and after the rains of last Sunday
there was virtually no indication of infiltration above normal.
Engineer Rogers also spoke of the esthetics of the new plant design. The Board
requested Mr. Rogers to seek from Teetor- Dobbins various preliminary designs and
costs so they can better make a decision as to what type of plant they desire.
RESOLUTION # 1875 - ENGAGE WHITE'S NURSERIES
VOTED to authorize the Engineer to make an agreement with White's Nurseries to
the effect that for the maximum suns of $250 they will undertake to restore to the
satisfaction of Mr. and Mrs. Roy Park, the area where the Village replaced a sewer
line in the right of way. Trustee Fisher dissented.
As Zoning Officer, Mr. Rogers remarked on a report by the Fire Inspector that the
Mr. Donut Shop had some cooking facilities on the premises. There was a discussion
on this matter and it was decided to wait and see if anything was actually cooked.
Attorney Roger B. Sovocool reported on the progress of the condemnation proceeding.
He should have more information after a meeting Wednesday, September 22, 1971.
The following resolution was offered by Trustee Verne A. Fogg, who moved its
adoption, seconded by Trustee Claire C. Nulle, to -wit:
RESOLUTION # 1876 - BOND RESOLUTION - FINANCING TREATMENT PLANT
BOND RESOLUTION DATED SEPTEMBER 202 1971.
A RESOLUTION AUTHORIZING THE CONSTRUCTION OF ADDITIONS TO AND THE
RECONSTRUCTION OF THE WASTE WATER TREATMENT PLANT IN AND FOR THE VILLAGE
• OF CAYUGA HEIGHTS, TOMPKINS COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST
OF $2,684,000, AND AUTHORIZING THE ISSUANCE OF $2,684,000 SERIAL BONDS
OF SAID VILLAGE TO PAY THE COST THEREOF.
BE IT RESOLVED, by the Board of Trustees of the Village of Cayuga Heights,
Tompkins County, New York, as follows:

Section 1. The construction of additions to and reconstruction of the
existing primary waste water treatment plant in and for the Village of Cayuga
• Heights, Tompkins County, New York, to provide for secondary (biological) treatment
and phosphate removal facilities, including the construction of a new influent
sewer, a new outfall sewer, together with original furnishings, equipment,
machinery and apparatus necessary in connection therewith, is hereby authorized
at a maximum estimated cost of $2,684,000.
Section 2. The plan for the financing of such maximum estimated cost consists
of the issuance of $2,684,000 serial bonds of said Village hereby authorized to
be issued therefor pursuant to the Local Finance Law; provided, however, that
there shall be applied in reduction of the amount of such serial bonds to be
issued therefor any moneys received by such Village as state or Federal grants -in-
aid.
Section 3. It is hereby determined that the period of probable usefulness of
the aforesaid specific object or purpose is forty years, pursuant to subdivision 4
of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further
determined that the maximum maturity of the serial bonds herein authorized will
exceed five years. Pursuant to the provisions of Section 107.00 of the Local
Finance Law no down payment is required in connection with the issuance of the
serial bonds herein authorized.
Section 4. The faith and credit of said Village of Cayuga Heights, Tompkins
County, New York, are hereby irrevocably pledged for the payment of the principal
of and interest on such bonds as the same respectively become due and payable.
There shall annually be apportioned and assessed upon the several lots and parcels
of land within said Village which the Village Board shall determine and specify
to be especially benefited by the aforesaid improvement, an amount sufficient to
pay the principal and interest on said bonds as the same become due, but if not
paid from such source, all the taxable real property in said Village shall be
subject to the levy of ad valorem taxes without limitation as to rate or amount
sufficient to pay the principal of and interest on said bonds as the same shall
become due.
Section 5. Subject to the provisions of the Local Finance Law, the power to
authorize the issuance of and to sell bond anticipation notes in anticipation of
the issuance and sale of the serial bonds herein authorized, including renewals of
such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer.
Such notes shall be of such terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Village Treasurer, consistent with the
provisions of the Local Finance Law.
Section 6. The validity of such bonds or bond anticipation notes may be
contested only if:
1) Such obligations are authorized for an object or purpose for which said
Village is not authorized to expend money, or
2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with,
. and an action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the provisions of the
Constitution.

Section 7. This resolution, which takes effect immediately pursuant to the
• provisions of subdivision 5 of paragraph a of Section 36.00 of the Local Finance
Law, shall be published in full in The Ithaca Journal, the official newspaper of
said Village, together with a notice of the Village Clerk substantially in the
form provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was duly put to a
vote on roll call, which resulted as follows:

The resolution was thereupon declared duly adopted.
Attorney reported on his findings regarding the right of way of the Village
at the end of the existing Sunset Drive. The right of way states "for street
purposes" if and when we wish to use it, therefore we have not lost any rights
in connection with the right of way. The fence erected on this right of way
should be dedicated to the Village or permission should be given and filed for
its use or the Zoning Officer should determine if there is a violation.

RESOLUTION # 1877 - ZONING MAP
VOTED to request the Engineer to draw up a preliminary zoning map of the Village
incorporating the changes since 1960 and to present it along i•H.th the probable
cost for printing.
Mayor Marcham will present at the next Board meeting a suggestion on printing
the Village Ordinances.
Mayor Marcham asked Trustee Nelson to look into the erection of a vault or
other means of fire proof storage of Village records.
