VILLAGE OF CAYUGA HEIGHTS
REPORT OF THE ZONING OFFICER
JUNE 1971
During the past month there was one zoning permit issued for the
construction of a breezway and carport for an estimated $2,800.
A question has been raised about the legality of a building
containing three apartments in the residential area if this building
had a history of three apartments prior to the time it was annexed
to the Village. It is my opinion that if the house still remained
in the original owner's hands, a preexisting use would exist and
• three apartments would be legal. But if the property had changed
hands that the new property owner would not acquire the right to have
three apartments and therefore three apartments would not be legal.
I would request an opinion of the Village Attorney on this matter.
