MINUTES of a regular meeting of the Board of Trustees held Monday, October 19, 1970
at 7:30 P.M. in the Village Hall.
40 PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Harold R. Fisher,
Verne A. Fogg; Attorney Roger B. Sovocool; Treasurer Gordon B. Wheeler; Engineer
John B. Rogers; Police Chief Jack W. McGraw, Sr.; Fire Chief Ned G. Boice.
OTHERS: Representatives of the Ithaca Journal and Radio Stations WTKO and WHCU
and Mr. Norman Geer representing the Community Nursery School as their legal aid.
VOTED to approve the minutes of a regular meeting held September 21, 1970.
VOTED to approve the Abstract of Audited Vouchers dated October 19, 1970 in the
following amounts: General Fund - $6,166.78, Sewer Fund - $752.60, Trust and
Agency Fund - $4,194.50.
Mayor Marcham explained to the Board the request of the Community Nursery School
now operating in the First Congregational Church at 309 Highland Road for zoning
approval by the Board and the questions which arise, namely2 (a) will the school
take the necessary steps for fire protection required and will the First
Congregational Church consent to its installation, (b) does the Church understand
the possibility that the portion of the building housing the nursery school may
become taxable, if so will this effect the agreement they have with the school at
present.
The Mayor asked Mr. Norman Geer to explain the request of the Community Nursery
School. Mr. Geer said that zoning approval is necessary before the State will
recognize the school.
• The Zoning Officer gave his opinion that a site plan must be received and the land
owner should apply for zoning permission. The Attorney confirmed his statement.
Mr. Geer was asked to report this to the school and church and produce a site plan
which the Attorney and Zoning Officer can look over and recommend action by the
Board.
Mayor Marcham gave his report and it is on file in the Village Office. His report
contained information concerning the County Sewer Agency that a finance committee
had made progress in finding a formula for allocating capital operating costs.
Agway has abandoned the plan for a dog run which would sewer into our system. In
regard to sidewalk maintenance it was agreed to continue sidewalk snowplowing and
minimal maintenance.
RESOLUTION #1738 - VIRGINIA POWERS - TRUSTEE
VOTED to appoint Virginia Powers as Trustee to fill the vacancy created by the
resignation of Margaret McElwee. The appointment to take effect immediately and
to expire March 31, 1971.
The Engineer is to consult the Fire Chief and bring recommendations to the next
meeting for the construction of a room in the basement of this building to store
• Village records.
A provisional text of the Ordinances of the Village are to be provided the Trustees
for approval before having them reprinted.

A hearing on the condemnation of property adjacent to the present Treatment Plant
will come before Supreme Court Justice Frederick Bryant at the Court House on
• Monday, October 26, 1970 at 10;00 A.M.
The adoption of the Code of Ethics was put over to the next meeting when perhaps
we will have a full board in attendance.
RESOLUTION #1739 - PARTICIPATION IN PUBLIC EMPLOYEES
RELATIONS PROGRAM
VOTED to authorize the Mayor to subscribe for the service of the Public Employees
Relations Program for one year from November 1, 1970 to October 31, 1971 at a
cost of $50.00.
The Police Chief gave his report and it is on file in the Village Office.
The Fire Chief gave his report and it is on file in the Village Office. He with-
drew his request for reimbursement of $24.00 for attendance at the annual Fire
Conference.
Chief Boice had preliminary drawings from architects Tallman & Thomas of the
proposed addition to the fire station which the Board examined and discussed.
RESOLUTION # 1740 - RETAIN BONDING ATTORNEYS
I" VOTED to authorize the Attorney to retain Sykes, Galloway & Dikeman as Bonding
Attorneys to take responsibility for drafting the bonding resolution for the
Village on the matter of financing the addition to the fire station.
RESOLUTION # 1741 - TALLMAN & THOMAS PREPARE DOCUMENTS
VOTED to authorize architects Tallman and Thomas to finalize the drawings,
specifications and contract documents for the proposed addition to the fire
station and to prepare same for putting out to bid by the Clerk.
RESOLUTION #1742 - BIDS - FIRE STATION ADDITION
VOTED to authorize the Clerk, at the proper time, to advertise for bids on the
addition to the fire station after drawings, specifications and contract documents
have been examined and approved by Engineer Rogers.
The Engineer gave his report and it is on file in the Village Office. He also
told of the problem with the culvert on Cayuga Heights Road near the City line.
Mr. Giordano and the Engineer looked over the sidewalk on North Triphammer Road.
The time of over a year has elapsed since its installation. Mr. Fisher said that
• the construction of the sidewalk should be rechecked. Since the sidewalk is too
new for the spelling he wished to know when the job was declared to be completed.
Engineer Rogers said he would check into the contract and discuss action with
Mr. Giordano.

Attorney Sovocool gave his verbal report. The Morton Salt Co. has been sent a
Quit Claim Deed and when it is signed and returned it will be recorded and filed

in the Village Office.
RESOLUTION # 1743 - LEASE - FLAVIN'S JEWELRY
VOTED to authorize the Attorney to draw up a new lease with Flavin's Jewelry for
one year from December 31, 1970 at the rate of $200 per month rent with a 90 day
termination clause.
The Attorney is still working on his opinion of Village responsibility on general
surface water problems.
Bonding Attorneys are working on the resolution for the financing of the secondary
treatment project.
The Treasurer reported his findings on the Retirement System benefits and suggested
that the death benefits were comparable to life insurance benefits and thought
perhaps the Board would like to consider them for the next budget as a fringe
benefit in determining salaries.
The veteran benefits seemed too costly for the few we have who would benefit.
The Clerk gave her report and it is on file in the Village Office.
