HomeMy WebLinkAboutPublic Hearing 6/15/1970VILLAGE OF CAYUGA HEIGHTS • MINUTES of a PUBLIC HEARING of the Board of Trustees of Cayuga Heights held in the Village Hall, 836 Hanshaw Road on June 15, 1970 at 7:30 P.M. PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Harold R. Fisher, Margaret McElwee and Rene F. Randolph; Treasurer Gordon B. Wheeler; Attorney Roger B. Sovocool; Engineer John B. Rogers; Police Chief Jack W. McGraw, Sr.; Fire Chief Ned G. Boice and Village Justice William Tucker Dean. OTHERS: Representatives of the Ithaca Journal and Radio Stations WHCU and WTKO, Cornell University Vice President Thomas Mackesey and Assistant University Counsel Ralph R. Barnard. Mayor Marcham said that the notice of the public hearing had been duly advertised and posted. The public hearing is to consider amendments to the Village Ordinances to further define the penalties to be applied against persons who violate Village Ordinances. The proposed amendments were read. There being little discussion and no objections the hearing closed at 7:50 P.M. MINUTES of a Regular Meeting of the Board of Trustees of Cayuga Heights held in the Village Hall on June 15, 1970 at 8:00 P.M. PRESENT: Same as Public Hearing • OTHERS: Same as Public Hearing except Messrs. Dean, Mackesey and Barnard. VOTED to approve the minutes of a Special Meeting held May 12, a regular meeting held May 18 and a special meeting held May 293 1970 all previously sent to the Trustees in mimeographed form. VOTED to approve Abstract of Audited Vouchers dated June 15, 1970 in the following amounts: General Fund - $3,276.91, Sewer Fund - $381.58. Mayor Marcham gave his report and it is on file in the Village Office. He also showed the Board the two chairs loaned as demonstration chairs. It was suggested he look into the cost of purchasing Alumni chairs without the coat of arms. After discussion regarding the Codification of the Village Ordinances it was deemed preferable to have the entire ordinances put into a better form, perhaps a loose leaf pamphlet. RESOLUTION # 1687 - VILLAGE ORDINANCES VOTED to authorize the Clerk to prepare a master copy of the Village Ordinances as amended by the actions of the Board of Trustees to and including the meeting of June 15, 1970 and to distribute copies of the master copy to members of the Board, Attorney, Zoning Officer, Zoning Board of Appeals, Police Chief and all other interested officers of the Village. • RESOLUTION # 1688 - MAYOR AS MMM OF COUNTY SEWER AGENCY VOTED for the Mayor to serve on behalf of the Village of Cayuga Heights on the County Sewer Agency. Minutes 6/15/70 Page 2 Discussion was held on retaining Mr. Rodney Fellows as an appraisor in our condemnation proceedings for the taking of land from Mr. Liberman in our Sewer Plant expansion program. Mr. Fellows is to be approached in regards to doing the appraisal and what his fee will be. Mayor Marcham put over the item about the Improved Retirement System Benefits until another time. RESOLUTION # 1689 - ADOPT ORDINANCE AMENDMENTS VOTED to adopt the amendments to the Village Ordinances as proposed by the Village Attorney and as presented at the Public Hearing as follows: "Article I By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article II By e— 1— i ating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article_ iII By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." e Article IV By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article VII By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article VIII By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article IX By eliminating the last sentence thereof, and adding thereto, "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith." Article XI - Section 21 - By eliminating Section 21 and adding thereto, a new Section 21 reading as follows: "In addition to the remedies provided by Secs. 93 and 179(C) of the Village Law of the State of New York, failure to comply with this ordinance shall constitute a is violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith, and each day's violation shall constitute a separate offense." Minutes 6/15/70 Page 3 Article XII By eliminating Section 9 and adding thereto, a new Section 9, reading as follows: ` "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith, and each day's violation shall constitute a separate offense." Article XV By eliminating Section 7 and adding thereto a new Section 7, reading as follows: "Failure to comply with this ordinance shall constitute a violation as defined in the Penal Law of the State of New York, and any offender shall be punished in accordance therewith, and, in addition, the Village Court may order the removal and detention of the registration plate or sticker from such offender's bicycle for a period of not to exceed 90 days and /or impounding of such offender's bicycle for a period not to exceed 90 days. These amendments shall take effect June 30, 1970." Engineer Rogers gave his report and it is on file in the Village Office. Engineer Rogers is to check into the right of way across the Roy H. Park property to ascertain the conditions before proceeding with the replacement of the sewer line. Mr. Fisher told of the sidewalk peeling on North Triphammer Road and asked the Engineer to look into it. RESOLUTION # 1690 - ZONING VIOLATION - toll. LOCKE • VOTED to authorize the Zoning Officer to request the District Attorney to represent the Village if this becomes necessary in prosecuting action against Richard Locke for breach of the Village Ordinance and that in the event the District Attorney chooses not to do this the Village to ask Attorney Buyoucos to serve as Counsel. After discussion regarding the type of construction, etc. of the addition to the Fire Hall, it was decided that the Safety Committee and the Engineer meet with Mr. Fred Thomas, an architect, to find out what procedure the Village should follow about design and bids and to let the Board know what it needs to do. Police Chief McGraw gave his report and it is on file in the Village Office. RESOLUTION # 1691 - CHIEF OF POLICE CONFERENCE VOTED to authorize the attendance of the Police Chief at the New York State Chief's of Police Conference, Albany, New York, July 26 -30, 1970 the expenses not to exceed $150 which covers the registration fee, room and board, mileage and other miscel- laneous cost. RESOLUTION # 1692 - SERGEANT ATTEND MORAN INSTITUTE • VOTED to authorize attendance of Sergeant MCEwen at Moran Institute on Delinquency & Crime, St. Lawrence University, Canton, New York June 21 -26, 1970. The expenses will be $95 plus mileage. MINUTES 6/15/70 Page 4 RESOLUTION # 1693 - PURCHASE AIR CONDITIONER VOTED to authorize the purchase of an air conditioner for the main office in the Police Department. The Engineer to be consulted as to the installation. The Fire Chief gave his report and it is on file in the Village Office. He commented on the report from the City on the hydrant maintenance and pressure. It is not satisfactory and pressure should be exerted on the City to do a better job. RESOLUTION # 1694 - PURCHASE AIR VOTED to authorize the purchase of the air conditioner in the apartment of the Fire Hall at a cost of $250. This air conditioner is about three years old and was purchased and installed by the former Chief Mr. Richard Vorhis at a cost of $375• RESOLUTION # 1695 - PURCHASE OF HOSE WASHER VOTED to authorize the purchase of a Portable Automatic Water Powered Hose Wash -n- Winder for $650.00. • Bids for fire hose were received from three companies as follows: Lawless Fire Equipment, Inc., Elmira, New York for 1000 feet of hose - $32023.92 National Auto -Weld, Inc., Ithaca, New York for 950 feet of hose - 1,977.26 Sanford Fire Apparatus Corp., East Syracuse, New York for 1000 feet of hose - 1,679.20 # 1696 - AWARD BID - FIRE HOSE VOTED to award the bid for 1000 feet of fire hose as per specifications to Sanford Fire Apparatus Corporation of East Syracuse, New York for $1,679.20 to be delivered by September 1, 1970. The Attorney gave his report. He reported that it will take special legislation to make it possible for the Village to sell their present Sewage Treatment Plant to the County Sewer Agency. The Treasurer reported he had yet to wind up the year end report but time wise was well under the deadline and would have it soon. • RESOLUTION # 1697 - AUTHORIZE MR. BRADFORD TO AUDIT ACCOUNTS 'DOTED to authorize Mr. Paul Bradford to audit the accounts for the fiscal year June 1, 1969 through May 31, 1970. Minutes 6/15/70 Page 5 The Treasurer stated that through investments in Certificates of Deposit the Village earned $5,000 last year. The Clerk gave her report and it is-on file in the Village Office. 'RESOLUTION # 1698 - FILE AND PUBLISH ANNUAL REPORT VOTED to have the Treasurer file the Annual Financial Report of the fiscal year 1969 -70 in the Clerk's Office within 60 days after the end of the fiscal year and to be published within 10 -days of filing. RESOLUTION # 1699 - ACCEPT CORNELL'S PROPOSAL FOR USE OF 310 TRIPHANMM ROAD VOTED to accept the proposal of Cornell University for use of the property at 310 Triphammer Road for the Africans Study and Research Center (1) As described by Vice President Mackesey in his presentation to the Village Board of Trustees as follows: Vice President Mackesey appeared before the Board to describe the conditions under which Cornell University wishes to operate the property at 310 Triphammer Road. It intends to use the building for the Africans Studies and Research Center. Vice President Mackesey said that the building would be remodeled • internally but not extended on the outside. The University wished to provide classrooms and-offices for the committees and clubs maintained by the students as well as offices for the faculty members of the Center. The Center would have a library; it would have a coffee room but would not serve meals except, perhaps, on two or three occasions a year. No one would live in the building, though from time to time visiting lecturers might occupy the one or two suites kept for that purpose. He assumed the building would be open 24 hours a day though rules on this subject would be set by the Center. The University intends, he said, to regard the building as an academic building and will provide the same surveillance, janitor service and trash collection as for the other academic buildings. Director James Turner will be the University officer responsible for the use of the building and will be available for, consultation with Village officials should any question arise regarding Village procedures and ordinances as they relate to buildings in the Multiple Residence District. The Trustees asked questions regarding the parking space available at the . building and the use to which it might be put. Vice President Mackesey agreed that room for 31 vehicles now exists. He said he thought this would be adequate. To the suggestion that students other than those actually using the facilities of the Center might find the parking lot a convenient place to leave their cars, he said that he thought this would not happen. If it did, the University would control it. • Minutes 6/15/70 Page 6 Police Chief McGraw said that the use of the two large lights at the roadside entrance to the property had proved to be a hazard to motorists using Triphammer Road. Vice President Mackesey said he would be glad to modify this lighting in accordance with the wishes of the Village Police and the Engineer. (2) As initially reported in his letter of June 4, 1970 (3) As set forth in the plans for remodeling of the building dated 6/16/70. The acceptance however to be conditional pending the issuance of a Zoning Permit and Certificate of Occupancy by the Village Zoning Officer. Meeting adjourned at 10:45 P.M. • C1 Rose M.
